…”Lawn Dart Danny” tied the zero’ AGL altitude record. From Jonn’s post on the subject:
If you haven’t heard, and even if you have heard, Daniel Bernath was killed in an airplane crash on January 22, 2018 in the afternoon. About 15 minutes after taking off from Page Field in Fort Myers, Florida, the tower received a Mayday call and Mr Bernath went down with his craft in the woods near a golf course in Bonita Springs, Florida. According to reports, the area was so overgrown, rescuers needed a bulldozer and machetes to reach the crash site.
Mr Bernath was the sole occupant of the airplane at the time.
The incident is being investigated by the National Transportation Safety Board and basically, I’m going to avoid commenting until that investigation has been completed. I ask that you do the same.
As you may be aware, Mr Bernath has accused us of sabotaging his aircraft in the past. Of course, that wasn’t true. No one I know would stoop to that level of stupidity. I wouldn’t know how to even begin to sabotage an airplane and the fact that I’m wheelchair-bound doesn’t make me stealthy enough to pull it off, if I did. I’m sure his accusations will be part of the investigation, though. For that reason, I will not comment publicly until the investigation has ended.

There was a news photo/ video of them hauling off the wreckage on the back of a flatbed. It looked like it had been ran through a shredder.

I check the NTSB site every week to see if any progress has been made on ole Danny. I would also love to see the toxicology/autopsy report, as I have my suspicions on why he asked for a 8000′ altitude for such a shot hop and was confused when talking to ATC. Something about this accident screams “intentional”.
The ATC wouldn’t have given him 8000′ as a cruise altitude because VFR flight cruise altitudes have to be at even or odd thousands plus 500 feet. Bernasty, the incompetent pilot, could not cruise at an even or odd thousand altitude because that would require an IFR (instrument flight) rating which he did not have.
Well yeah but he did have an app for his smartphone that was almost the same thing as an IFR system. I think his app actually computed his ground speed!
The last thing he heard was the GPS app saying “Recalculating”.
He was likely hearing that a few seconds before the last thing on his mind upon impact, which would be his ass as his head hit the glare shield (top of the instrument panel, for you non-aviators).
He was probabaly wondering why his airspeed indicator read 362MPH while his speed over the ground GPS app read 0MPH.

I agree. It’s one of the things you learn relatively early in ground school. The point I was making was: who does a 50nm cross country in an RV-12 by climbing to 8,000 feet? Even if it was legal, it gains you nothing but a higher fuel burn that you’re not going to make up for because you’re only going to be in cruise flight for a few minutes before they vector you back down to get into the pattern for landing.
None of this makes sense, which is why I think he had it all planned out.
Bim, your suspicion is one I’ve long shared primarily because of it coming right on the heels of another legal defeat. Even someone as thick-headed as Bernath had to see he was losing bigly.
Another thing I’ve always wondered was where he got his money if he was unable to practice law. Perhaps he had family money or married into money. Or, if he was running out of money, that could be another motivation for an intentional “accident.”

Ever since I first heard of the crash I thought that the nut behind the yoke and controls was the fatally flawed part!

Well, based on what I know about Bernath, it is my opinion he killed himself because his other past caught up with him.
During his stay in jail … interviews were conducted.
I wouldn’t be surprised if he did indeed purposefully lawn dart himself. At the same time I wouldn’t be surprised if he was trying to do another law suit of some sort.

In my humble opinion there are two things wrong with his headstone. The bird in flight grapic seems inappropriate because flying was not his forte. Second, the implication that he served in the Viet of the Nam is misleading as he never set foot in Vietnam or flew over it. (Yeah, I know everyone on a float in the South China Sea was awarded the Vietnam Service Medal, my bff has one and likes to say he “was in war,” but he knows I know what he actually did in the CIC of a non-combatant ship as a radarman.)
Was he a radarman aboard the USS Maddox on 4 AUG 64? If so…

I would venture to guess that she got tired of his shit and left him. He was probably abusive towards her for years/decades and she had it when he started getting called out for Stolen Valor. His stay in jail was probably the last straw for her and she left him while he was in the lockup.
There’s probably more stuff that we don’t know about Lawn Dart Danny… MCPO has hinted to it for a while. I’m sure it will show a darker side of Daniel A. Bernath than what we have seen.
After his crash in 2013, where he ran out of gas he tried to sue the plane company for not warning about what would happen if the plane was low on fuel, as in what would happen if he ran out of gas…duh.
