California sheriff complies with ICE subpoenas on jail records

| February 22, 2020

ICE served the subpoenas on San Diego County Sheriff Bill Gore for the jail records of four Mexicans in the U.S. illegally, according to reports.

A sad state of affairs when compliance with Federal Law Enforcement makes the news. But this is Sanctuary State California where such cooperation is rare indeed, nearly unheard of. In fact, Immigration and Customs Enforcement (ICE) agents have reportedly arrested two people at a Northern California courthouse, ignoring a recently introduced state law barring immigration agents from making arrests at such facilities.

So a California Sheriff working with ICE to turn over the jail records is a breath air. From the article:

A California sheriff is refusing to ignore subpoenas for information from the U.S. Immigration and Customs Enforcement.

ICE served the subpoenas on San Diego County Sheriff Bill Gore for the jail records of four Mexicans in the U.S. illegally, according to reports.

Gore issued a statement Thursday announcing that he was complying with the demands.

“A truly authorized federal administrative subpoena has to be honored,” Gore said, according to NBC 7 San Diego.

Similar administrative subpoenas have been issued to law enforcement agencies in Denver, Connecticut, New York City and Oregon.

Gore is the first to comply, ICE spokeswoman Lauren Mack said.

The subpoenas are among several recent moves by the Trump administration against what it considers “sanctuary” jurisdictions, which adopt laws and policies to limit cooperation with immigration authorities.

In his statement, Gore said a subpoena trumps California’s sanctuary law.

The four Mexicans targeted in the subpoenas were arrested for charges such as sexual assault of a child, robbery, battery, and drug possession, NBC 7 reported.

Each man, ranging from ages 28 to 42, was arrested in the last few months by the San Diego Police Department, according to the station. Two remain in county jail and two have been released, according to ICE.

Of course the Libs are outraged, dragging out tho old trope that “ICE’s issuance of subpoenas, and Sheriff’s Office’s potential compliance, endanger public safety and community trust.”

Except it doesn’t.

ICE Policies

Sanctuary policies aren’t necessary to report crimes without fear of deportation. Section 101(a)(15)(U) of the Immigration and Nationality Act provides legal authority for a non-citizen who reports a qualifying crime to local authorities, and assists, or may be of assistance, in the prosecution of the crime, to become eligible to apply for authorization to remain in the U.S.

So BZ, Sheriff Gore, hope you are just the first of many. Read the entire article here: Fox News

I thought that Federal Agents were charged with enforcing Federal Law, and that Federal Law
“Trumped” State Law. Seems like that particular question was decisively answered back around 1865.

Guess what most rational people consider an assaulting, thieving, child molesting, dope head, the Commiefornication politicians call a voter. Taking out four of them is at least a start.

  2. Comm Center Rat says:

[Sheriff] Gore said a subpoena TRUMPs California’s sanctuary law.

    I reckon so.

  3. Fyrfighter says:

Seems like a subpoenas like this should have a minimal time frame for compliance, and if they are ignored past that date, federal agents should immediately arrest the Sheriff and charge them with whatever they can get to stick.

  4. The Other Whitey says:

About time Gore did something besides be a piece of shit—see Peruta vs San Diego. Of course he’s only doing this because he knows the sanctuary bullshit is unpopular here in San Diego County and he wants to get re-elected. That guy is a human windsock.

EXACTLY. Unless your connected Gore would piss on your carry conceal permit and tell you to get lost. He is just pandering to get elected.

  5. Commissar says:

This is right wing propaganda nonsense.

It is conflating “sanctuary policies” with honoring subpoenas.

Sanctuary policies are based on the constitutional FACT that states have ZERO authority to enforce immigration law or our borders, that is an undisputed FACT. Border enforcement and immigration enforcement is ENTIRELY federal jurisdiction and it CANNOT be delegated to states.

Unlike most of you armchair keyboard warrior border enforcement militiamen I actually have apprehended border crossers, drug smugglers, and human traffickers and turned them over to Border Patrol or Federal officials.

When I was a deputy along the US-Mexico border and I detained a suspected undocumented immigrant I was doing so ENTIRELY as a private citizen, I had ZERO legal authority to hold them for longer than the laws I had jurisdiction to enforce allowed. That means I could detain them only for violating a state, county or local law, and hold them only as long as it took to enforce that law. And I could only ask them questions related to things for which I had jurisdiction unless it was a voluntary interaction. When I pulled a vehicle over it was a DETENTION and thus the interaction was never voluntary.. I and other deputies were putting ourselves, our department, and our county on the hook for potential lawsuits since we were acting beyond our jurisdictional authority if we detained them for anything outside our jurisdiction or if we detain3d them for longer so the Border patrol could get to us.

Sanctuary cities simply refuse to act outside their jurisdictional authority. They do it for generally ideological reasons but they are actually acting far more in compliance of the constitution than those that honor federal REQUESTS to detain and turn over suspected undocumented immigrants.

Sanctuary cities also prevent entire communities from being potentially victimized because they cannot safely call, cooperate with, comply with, or rely on local law enforcement. This increases gang activity and “shadow” street justice in the form of organized crime and racketeering.

This sheriff is not choosing to honor a “REQUEST” he is honoring a subpoena. Which he is legally required to do unless he challenges the subpoena in court. Which few sheriffs or mayors do. Anywhere in California.

Generally the communities that challenge subpoenas in court are wealthier communities that can afford the time, money, and effort.

Most federal subpoenas are complied with in California. Every single day.

And challenging a subpoena is a legal and constitutional act. Challenging a subpoena is not the same as defying a subpoena.

Defying a subpoena is a criminal act.

Which makes this entire discussion on this thread hypocritical as hell, because the Trump administration has ordered the entire executive branch and all employees in the branch to defy dozens of subpoenas involving any investigation of anyone connected directly to trump.

And some of you asshats have utterly vilified LTC Vindman for complying with a subpoena.

Which he was legally required to do so according to both the federal, law and the UCMJ. He was doing is duty.

      Oh fuck off stupid commie.

    • David says:

Zero legal authority? Isn’t illegally crossing the border a crime? Now, simply BEING here is only a civil offense. But now you are saying you were detaining them a) because you pulled them over for some other offense or b) had no reason to, so you were just harassing them?

      • Commissar says:

It is not a crime state and local authorities have the legal or constitutional jurisdiction to enforce.

Which means they have no more authority to apprehend a border crossers than a private citizen executing a citizens arrest.

        • A Proud Infidel®™️ says:

You sound about as idiotic as the “Sovereign Citizens” I see getting their asses handed to them by Law Enforcement and the Courts!

    • SgtM says:

The fat jelly doughnut of a LTC did comply with a subpoena. The problem is they already knew what he was going to say. Fatboy gave his opinion of what he thinks Trump meant. Opinions are not facts. He gave his opinion of his CIC. Now he pays the price. He should have resigned his commission, had Omar make him a suit and then given his opinion. The local, mostly Mexican churches around here opened their churches to illegals. After weeks of feeding them, housing them and cleaning up all their messes, the churches kicked them out. Seems it takes money and a lot of time and effort to feed house and cleanup after a bunch of free loaders.

    • Ret_25X says:

No, dumbass, sanctuary policies are not based on state laws or lack thereof.

They are based on the political strategy of replacing working class white voters with imported people to exploit. Period.

They have to be illegal aliens for the left’s new slavery concept to work. If they come here legally, it is almost impossible to exploit them completely.

The left is the ideology of “you work, I eat” and slave ownership is core to it. They just rebranded it to social justice to fool others.

Now that at least half of the nation is no longer fooled, you guys are playing the “its a right wing conspiracy” card.

Its crap, and if you don’t know that you are even smaller intellectually than I believed.

Here’s a pro tip. Don’t be a minion to a political movement founded on the ownership and exploitation of humans. Otherwise, you are literally on the same moral and ethical level as that hero to the left, Huey Long.

Thanks, Lars, for your comment. If we all agreed it would be a very boring site indeed.

For those worried about personal attacks on members being deleted, this is the exception that proves the rule. The Commissar Exclusion, if you will. Lars well knows what he’s in for when he comments here, and he gives back as well as he gets. As far as I’m concerned he’s earned the privilege as most here have- he’s a Vet. Not necessarily a requirement to opine here, but he deserves to be heard.
