Supreme Court Allows Public Charge Immigration Restriction

| January 27, 2020

The US wants legal immigrants who will be self-sufficient, it’s the American way. “Progressives” have a different definition of what is “the American Way”. (Rick McKee)

The Trump Administration implemented a public charge restriction on immigration. If the US government felt that someone seeking to immigrate would take advantage of assistance funding, they could be denied immigration.

Democrats and other “progressive” groups opposed this move. They pushed this to the court system and managed to get trial judges to halt the government from enforcing this policy. The “progressive” justices wanted to support the block. The conservative justices argued against using wide-ranging injunctions for the whole nation when such was outside of their lane.

From Fox News:

While a “public charge” inadmissibility standard has long been part of U.S. immigration law, it had not been formally defined by statute. The rule, announced by U.S. Citizenship and Immigration Services in August, defines a “public charge” as an immigrant who received one or more designated benefits for more than 12 months within a 36-month period.

“The principle driving it is an old American value, and that’s self-sufficiency,” USCIS Acting Director Ken Cuccinelli told Fox News in an interview last year. “It’s a core principle — the American Dream itself — and it’s one of the things that distinguishes us, and it’s central to the legal history in the U.S. back into the 1800s.”

Those benefits that would be designated included Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), as well as most forms of Medicaid and the Supplemental Nutrition Assistance Program (SNAP), commonly known as food stamps. The rule expands the number of benefits that can be considered from interim guidance issued in 1999.

The public charge rule has faced fierce opposition from immigrant activists, as well as many Democrats — who have opposed measures to limit welfare for immigrants, while also calling for the extension of various forms of government aid to illegal immigrants as well.

Good! I’m all for some social safety net stuff like SS disability, food stamps, and unemployment. Those things are for our people though and should have some reasonable limits on them. What right does anyone have to walk into my house and start taking food from the fridge?

  2. 5th/77th FA says:

‘Bout damn time. If you aren’t a citizen of this country and haven’t at least paid a little bit in taxes, get your ass back to where you came from. Or get you a job, pay you some taxes, and apply for citizenship in the legal accepted manor. Anybody that doesn’t think that the invasion we have seen over the years of illegals wasn’t because they knew they could join the free sh^t army, well I’ve got a bridge leading to ocean front property to interest you in.

These mofos need to read the rest of the inscription on the Statue of Liberty; ie that part where it talks about becoming an American. We don’t need any more parasites imported. Lord knows we have enough that were born here.

President Trump has access to a phone and a pen like Obama did.

Seems to me the left doesn’t like it when their own rules or tactics are used by other people.

    • Cameron Kingsley says:

Goes to show you why you should be careful with the rules you use. Especially when you’re trying to stack the deck in your favor, you never know when the other side might just get control over it.

  4. SSG Kane says:

I’m more thrilled with the commentary from Justice Neil M. Gorsuch and Justice Clarence Thomas on the nationwide injunctions issue.

OF COURSE the D-rats are going to get their panties in an huge wad when we threaten handouts to illegal aliens. One, it gets in the way of their buying votes with our tax dollars and it gets in the way of them feeling all smug and superior because they’re “compassionate”. The inscription on the base of the Statue of Liberty says” Give me your tired, your poor, your huddled masses yearning to breathe free” not “Give me your dope dealers, your freeloaders, your hustlers looking for an easy free ride.”

    • rgr769 says:

You left out an adjective that goes with “buying votes.” They are buying “illegal votes,” as illegal aliens, in fact all aliens, even the legal resident ones, are not entitled to vote in our federal elections, period. That was the principal impetus for the D-rats efforts to give drivers’ licenses to illegals and use motor voter laws to give them an easy opportunity to register to vote. They are only one motor-voter form check box away from getting a ballot, once they get a license.

      • A Proud Infidel®™ says:

That and the PRoCA passed a law allowing illegal aliens to vote. Liberal TARDOs still screech about Foreign Interference in the 2016 Election, yet they want to allow Foreigners, illegal or not to vote, liberalism is truly a Mental Disorder!

  6. Skippy says:

    About damn time
My wife’s mom was a French Canadian
She came to the US because she married to a Navy sailor
She met in Alaska she was a nurse
Long story short they got a divorce
    She met my wife’s dad,
were my wife was raised in Las Vegas Nv
The whole neighborhood turned into a barrio most of the people
Worked there ass’s off to make a living
But there was a few that lived off the system
It would piss my mother in law off like you wouldn’t believe
She would always tell me if she could do it on her own
    Then why couldn’t they
What’s crazy about this ruling is that 4 justices thought it was OK
To let there turds stay here instead of kicking them out off here

  7. Hack Stone says:

Hack Stone recalls when he filled out the paperwork to sponsor his fiancée Rosetta to come to America, there was a stipulation that she was not entitled to public assistance. That was 30 some years ago, so this shit ain’t new, it’s just being enforced.

  8. The Other Whitey says:

There is no logical reason to oppose this. Giving any kind of welfare benefit to illegal aliens makes no sense of any kind. It’s essentially lighting taxpayer money on fire.

Tells you everything you need to know about leftists.

    • A Proud Infidel®™ says:

Like I said earlier, it not only buys illegal votes, it helps libtard politicians look down their noses and feel superior because they’re being “compassionate” with our tax dollars. The vast majority of liberals won’t give much of shit to private charities, but they think that spending barge loads of government Money on programs is just great, liberalism is truly a Mental Disorder!!

  9. Sapper3307 says:

Next they wont let green card holders in federal elections.

  10. Veritas Omnia Vincit says:

The interesting thing about this entire subject is the Democrat’s previous position that all these people come to do jobs no Americans want. If that’s true why do they need public assistance?

If they are coming to fill jobs, let them work and fill those jobs. If they are coming to free load that’s a different issue.

The law still allows for public assistance to true refugees to help them resettle and become acclimated, which I think represents a positive undertaking for true refugees.

  11. RetiredDevilDoc8404 says:

Supergenius Alexandra Occluded-Cortex is all up in arms about it, calling it a wealth test…anything she’s up in arms about has to be a good thing. Since the Dummycraps are so worried about EVERYBODY paying their fair share, why shouldn’t EVERYBODY also be contributing their fair share when they come here? Oh, wait, Dummycraps think like Napoleon in Animal Farm. About damn time they go back to this way of doing things!

  12. David says:

As I understand this, it does not apply to illegal aliens since it concerns people applying for legal entry or bumping up their citizenship status; ie. from visa to green card. They have to provide some indication that they will not be a public charge, which hopefully would catch some who want only to emigrate and live off governmental largesse. I don’t think this has any effect on illegals who bypass the system (and then try to live off governmental largesse, but that is a different argument.)
