…gets her to accept gift basket at ‘real home’ in Tennessee

Georgia Democratic Rep. Lucy McBath was the target of some creative trolling by the Republican Party over her widely disputed claim that she actually lives in Georgia, after receiving and signing for a gift basket the GOP sent to her address — in Tennessee.

McBath, a racial justice activist who defeated Republican incumbent Karen Handel in November, has been dogged with questions since the election campaign on whether she actually lives in the state she now represents.
 
The state’s Cobb County Tax Commissioner’s Office, which refrained from issuing a decision during the election due to appeals, confirmed last month that McBath didn’t meet the requirements to call her Cobb County home her primary residence for the three tax years leading up to the election, meaning she was a Tennessee resident when she was elected to Congress.

To point out McBath’s deep Tennessean roots, the National Republican Congressional Committee sent a goody bag containing coffee infused with Jack Daniel’s Tennessee Whiskey, Memphis-style BBQ sauce and a hat of the Tennessee Volunteers to her Rockford, Tenn., home.

The other funny thing is that Cobb County, Georgia permits some residents to decrease their property tax liability through a Homestead Exemption to residents.

That is exactly what McBath’s Husband has been doing since 2000.

However, according to documents reviewed by AllOnGeorgia.com, her Husband has been ordered to pay back taxes for the last three years as the exemption was revoked for having vehicle registrations, voter registrations and driver’s license applications in other states.

This resident question came up during the campaign and was squashed using that “special card” and the massive amount of questionial voters in that area. K Handel didn’t lose by much IIRC

US Constitution, Article I, Section 2, Clause 2 (emphasis added):

2: No Person shall be a Representative who shall not have attained to the Age of twenty five Years, and been seven Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State in which he shall be chosen.

It would appear that this “fine individual” is Constitutionally inelligible to serve as a Representative from Georgia. And in theory, the House could indeed expell her from Congress on that basis.

But since her party controls the House, I really wouldn’t recommend holding your breath waiting for her expulsion.

How does that work? Because she’s been seated, would the House be the only ones able to remove her?

I assume she could be impeached for it as well. Forgetting the Constitutional implications, her election was predicated on fraudulent filings in Georgia.

I wonder if, because she did not meet the Constitutional means to be seated that a lawsuit could be initiated and have her removed.

While both the House and Senate can in theory (and I believe have in practice) refused to seat Members due to electoral fraud questions, it appears that after a member has been seated Expulsion would be required.

The first US Impeachment case – that of Senator William Blount, NC, in 1797 – appears to have established the de facto principle that Representatives and Senators are not “Civil Officers of the United States” and are thus not subject to impeachment and removal under the Constitution. So I thus don’t think impeachment, trial, and removal is an option here.

Further, the Constitution also specifies that each House of Congress is the sole judge of “the Elections, Returns and Qualifications of its own Members.” (Article I, Section 5, Clause 1) However, although Powell vs. McCormack (1969) established the principle that Congress could refuse to seat someone who failed to meet Constitutional eligibility criteria, it also held that Congress could do so only for failure to meet those specified Constitutional criteria. And once seated as a Representative or Senator, the individual’s election has been formally accepted by the House/Senate. Afterwards, Expulsion appears to be the only way to remove from office involuntarily a sitting Senator or Representative.

The fact that each House of Congress is the sole judge of elections, returns, and qualifications for it’s prospective members would appear to exclude a successful judicial challenge at this point due to lack of Federal court jurisdiction.

Just for info there was a guy named Howell Cobb who wrote a book “A Scriptural Examination of the institution of Slavery in the United States With its OBJECTS and Purposes” His and the southern statas way of saying yea slavery.Can’t help but wonder if the county was named after him;altough I think he had a brother who was pretty high up in the rebel army

Cobb County named for Thomas W. Cobb, a cousin to Howell Cobb. Died 1830, wife was Mary after whom Marietta GA was named. Howell Cobb had several positions in the CS Government and was a General of Volunteers. His Brother was TRR Cobb killed in the war. Howell Cobb ended up being a Major General of the Georgia Militia and was imprisoned for a while afterwards. He was the atypical political appointee General of the period (happened a lot…on both sides) and was a politician at heart. He thought he could have done a better job than either Jefferson Davis (who narrowly defeated him for the Presidency) and Georgia Gov Joe Brown.

That war was started by politicians, primarily over money and power. The slavery issue became the focus as it drug on and Lincoln needed to make sure the French and the Brits stayed out of it.
