Boulder Residents Given Just Days To ‘Certify’ Rifles Or Face Consequences

 

Colorado used to be a fairly pro-gun state, but all that changed shortly after a shooting in an Aurora, CO movie theater. While the killer was caught and isn’t a risk to the public anymore, that didn’t mean anti-gun forces didn’t seize on the opportunity.

Since then, the state has seen a progression of anti-gun incrementalism. Unfortunately, the stupid doesn’t just stop with the state legislature. It seems the People’s Republic of Boulder wants to get in on the action and is now giving people who own so-called assault rifles just days to “certify” their weapons or face repercussions.

Residents of Boulder, Co., have until December 27 to “certify” their “assault weapons” or remove the firearms from city limits. Those who fail to comply could face fines, jail time, and confiscation and destruction of their firearms, according to the Denver Post.

Boulder police say they have certified 85 firearms since the city council passed an “assault weapons” ban in May. Residents who already owned prohibited rifles, pistols, and shotguns were given the chance to keep their firearms by certifying prior ownership with police. The council also voted unanimously to ban “high-capacity” magazines and bump stocks.

“My hope is that we will see more bans at the state level and one day at the federal level so these weapons will no longer be available,” Councilman Aaron Brockett said in May.

It seems no official records are being kept and police only have a handwritten count of how many of these “certifications” are being done.

They also don’t have a clue about compliance levels either.

It’s difficult to estimate compliance levels, and police and city officials have admitted that they can’t do much about gun owners who refuse to certify their rifles.

“This is a very divisive issue where people have very strong feelings,” City Attorney Tom Carr told the Daily Camera. “The folks who oppose these kinds of bans … some of them suggest they’re not going to cooperate. I can’t predict what people are going to do, but I respect the feelings.”

That’s putting it mildly.

A lot of people aren’t going to comply and are sitting there, counting the days and thinking, “Molon Labe, jackwagons.”

Philadelphia tries to do this in PA every couple of years. They get taken to court over preempting state laws and lose every time.

Yeah, 2B, but problem here in Colorado is that with our new side-saddle governor, they’ll end up passing a bunch of new guns laws that will be ignored.. Sadly the repubs that got voted in due to disgust over the previous laws (magazine limits, “universal” background checks, etc) did absolutely NOTHING to repeal them as they promised, so they got voted out again… I am counting the days till I can retire and get out of this once great state that’s become a liberal shithole….

Okay, so let’s say that you register your AR with the police on Monday. On Tuesday, you take your registered rifle, waltz into a crowded something and start shooting. Um. I guess that I’m missing the point of the ordinance.

There is no point except as a precursor to confiscation.

The cops knowing you have one stops zero crimes with that weapon, it’s simply a means to an end when the goal is confiscating firearms.

And exactly how does the City of Boulder plan to enforce this breach of the Second Amendment? The PDRofMD passed much the same thing in 2013, and owners of scary looking guns in uncounted tens of thousands simply ignored the new law. Not one has been charged, arrested, tried, and convicted yet.

Exactly- this is “feel good” legislation so they can say they “did something” to curtail gun crime.

The fact that with the stroke of a pen, an unknown number of law-abiding citizens were turned into instant criminals for ignoring a violation of their Civil Rights is just collateral damage.

Haven’t been to Boulder yet, and it looks less and less likely I ever will. I’m OK with that.

It was a casing registry that was nothing but a money pit for the taxpayer. The thought was to ID the expended casing(s) to a specific handgun, but it resolved exactly zero crimes. I had to wait for my S&W 686 to be fired by a gun shop employee so they could provide a casing- the 686 is a revolver.

One of the first things governor Hogan did was to shitcan the whole thing. Unfortunately that was about the only thing he’s done that I agree with.

Just as the civil rights movement of the 1960’s gained the momentum required to overturn Jim Crow laws through acts of civil disobedience, the 2d Amendment Movement is going to need some brave, defiant patriots to refuse to comply with local laws that blatantly deny them their constitutional freedoms.

Whether such civil disobedience results in violence is largely in the hands of the authorities just as it was in the civil rights movement. My suspicion is that this time around, there is a great deal more sympathy in the nationwide law enforcement community for the violators although that may not hold true in very liberal local communities. Only time will tell.

I believe the purpose of such laws is to drive one or more folks into defiant public disobedience, and to gain enforcement funding.

That will justify the “example” SWAT raid, just as Ruby Ridge and Waco were intended to send the twin messages of “obey, or else” and “more budget needed to swat the yahoos”.

I was a bit surprised the 2005 gun grab in New Orleans did not produce such a “disobedience” case.

For those relying on sympathetic local Sheriffs and other LEOs to defy grab orders, note that NOLA imported compliant cops. That template is established, and will be re-used

Remember, as you make your individual choices, that some of the opposition are actively looking forward to killing a loud and proud “Molon Labe” type refusenik as an example to the rest.

If you really believe in Molon Labe, remember the fate of the guy who said it the first time. Do not assume that you will be allowed to reach a court of law, or that the court that sits in judgement of your oppr sorts will in any way be a respecter of your Rights.

What exactly constitutes an “assault rifle” in the eyes of the Boulder city council? Any rifles I may or may not own would be classified as “defensive rifles”, and therefore exempt. In other words:

maybe it will be like New York. under the new safe act “Assault weapons” definitions.the estimations between 1 mil- 3.8 mil firearms fall under that heading now. no solid numbers to actually base it on, but i am going with the higher, at least in my area.so far less than 300k registered. unless your naked, drunk and shooting street lights out the chances of you getting hit with a AWB violation are pretty slim by local LEO’s.

as a side note, i seem to be selling at least one stripped lower a day, sometimes 3 or 4 in my little mom and pop shop since “Il Duce” Cuomo and his Ilk have gained control over the state government, i have sold 0 state compliant stocks or uppers, you tell me what to make of that….

IIRC, the courts have ruled that such registration schemes don’t apply to criminals, because it would violate their 5th amendment rights, seeing how, as felons, they’re not allowed to own guns in the first place…

This will come to a head in Boulder when a legally owned but “noncertified” weapon is lawfully used for self defense in a home. Then an aggressive, liberal prosecutor will charge the person with at least not certifying their weapon, even if it is a justified shooting. They will push for jail time and confiscation. Just wait for it.
