Leroy Foley and the DD-214

You may recall the recent post that we did on Leroy Foley.  Foley is currently a Clyde Texas police officer and is running for Sheriff of Callahan County.  The election is March 3, 2020.

Well, a DD-214 has surfaced and had multiple postings on Facebook.  A copy of this DD-214 was also sent to admins at Military Phony.  We straightened it out for readability / aesthetic purposes and redacted information that should not be released to the public.

Although it looks official, having a partial stamp at the bottom with a seal from the County of Williamson, it should be pointed out that this DD-214 does not have a clean chain of custody as it has passed through many hands.  Therefore, we cannot speak to its authenticity.

Oddly enough, some have presented this document as “proof” that Foley’s claim of Airborne Ranger, Sniper, and having been awarded both the Silver Star and Purple Heart are true.  Others have presented it as proof that he is not being truthful.

Whatever its origins, and whatever people believe in terms of helping/hurting this case – we can tell you with certainty that this DD-214 is a fake and forgery.  The commenters at TAH have combed over it and pointed out some things that help to draw the conclusion it is a fake.  We will list them below with credit to the person making the comment.

Also, we would like to post a marked up one for convenience and quick reference.  This input was consolidated in order to make it easier for civilians in Clyde Texas, Callahan Texas and the media to focus on what to look for.

We would encourage everybody concerned with the facts of this case to order Foley’s official military records in order to have the results sent to you directly and compare it with military claims and this document that has been floated around.


COMMENTS – BLOCK BY BLOCK

OVERALL:

TOP RIGHT: “Areas render form void” the word Void is misspelled “VIOD.” (martinjumper)

BLOCKS: My Army DD214 has light tan blocks for some of the sections. (e.g. name, SSAN, and etc. Other blocks are white, e.g. Primary Speciality, Decorations and etc. You would think that the copy of Leroy Folly’s DD 214 would at least have a darker shade, even after running through a copy machine, the tan blocks. SCHOOLS: My DD 214 lists my schools by the name of the course, e.g BASIC ABN; not Airborne Certification. The names come right off of the Officer or Enlisted record briefs. I am sure the course names are standardized. (Mustang Major)

WHITE SPACE: Blocks 13, 14, and 18 of my DD 214 are filled from the left edge to the right edge and single spaced. My blocks 13 & 14 are completely used up and the last entry in block 18 is the issue date//NOTHING FOLLOWS. This is done to avoid typing in bogus info after the DD 214 is issued. Blocks 13, 14, 18 of Leroy Foley’s DD 214 have plenty of space. (All of the Army types reading this, take a look at their DD 214 and see how the format on yours compares to Leroy Foley’s DD 214.) FONT:

  • Proportional vs. Mono-Spaced Font.  Mixed case and lower case vs. CAPS for entries. (Daisy Cutter)
  • Fonts and Font Sizes on the DD214 are INCONSISTANT. (ninja)
  • Should be ONE Font with ONE Font size. (ninja)

BLOCK 1:  Typo on Defense Department form vs entry area – Name “(Last, Frist, Middle)” (Mason)

BLOCK 6: Reserve obligation term date has a 1997 year but the form was purportedly filled out in 1999 so that should be blank. (martinjumper)

BLOCK 7b: “City and state” should be “City and state, or complete address if known” (Compton)

BLOCK 8a: His DD214 has “FORCOM” followed by “RC.”  The correct wording is “FORSCOM” and “FC” should be after that, not “RC” unless times have changed.  Is he is thinking RC for the 75th RANGER Regiment (Reserve Component)? If so, that’s wrong. (ninja)

BLOCK 8b: “Place where separated” – “SEPARATED” is spelled as “SEPERATED” Same misspelling as in 12b. (martinjumper)

BLOCK 9:

  • Says “ARPERCEN ‘stLouis'” and it should be “ST Louis” (ninja)
  • USAR Control Group and ARPERCEN should be on one line. (ninja)
  • If this DD214 was dated 1999, Block 9 should have read Army Reserve Personnel Command (AR-PERSCOM) as opposed to ARPECEN. (ninja)
  • AR-PERSCOM was officially activated on Oct. 1, 1998, replacing ARPERCEN. (ninja)

BLOCK 11:

  • Claims to be airborne ranger, MOS should be 11B2V if he was a buck sergeant (E5.) 11B – Infantryman 2 – skill level for an E-5 Sergeant V – Ranger Parachutist. If not Ranger qualified but airborne qualified it would be 11B2P. (martinjumper)
  • In Block 11, the DD-214 claims “United Nations Service Medal” but that medal was awarded for the 1950-1953 Korean Conflict. (ninja)

BLOCK 12: “Years(s)” should be “Year(s)” (Compton)

BLOCK 12a-h: Zeros (0) are typed as the capital letter “O.” Notice in 12c where it says “10” for Years(s) (also misspelled with an extra “s”). That “10” is correctly typed with a zero, but the rest of the numbers throughout Block 12 had the captital letter “O.” (Dave Hardin, Compton)

BLOCK 12a-h:

  • In block 12a, he entered service 890612. In block 12b, his EAS was 990511. In block 12c, total active service is 10y/00m/00d. His math is off. Should be 09y/11m/00d. This isn’t a typical mistake personnel would make. (NHSparky)
  • Just did the math in Block 12: 89 06 12 | 99 05 11| is 9 yrs 10 months and 29 days. NOT 10 years (An Old Arty Sgt)

BLOCK 12b: “Seperation” is misspelled on the form vs. data entry. (Daisy Cutter)

BLOCK 12f: Out of 10 years, he was OVERSEAS for 7 Years? Well, where are his Overseas Service Ribbons on his DD214? (ninja)

  • That’s not how awards are written on a DD-214. They all run together and fill up the white space. (martinjumper)
  • He is claiming 7 ARCOMs and 14 AAMs in 10 Years – unlikely. (ninja)
  • There’s no such thing as a “sniper badge” or an “airborne badge.” (martinjumper)
  • Section 13 also shows the award of the “Sniper Badge.” No such badge exists. (T1B)
  • The correct term for airborne wings is “Parachutist Badge.”  (martinjumper)
  • The Ranger award is called a “Ranger Tab” not a badge (martinjumper, rgr1480) but I don’t have one so I may be wrong on that. (martinjumper)
  • There’s no such thing as a “Saudi Arabian Liberation Medal”. (martinjumper)

  • This DD-214 claims that ranger training was fifteen (15) weeks. The longest Ranger school has ever lasted is nine weeks back when they had that desert phase. RIP was only three weeks, so where does he get 15 weeks? (rgr769)
  • Is that supposed to be “Combat Diver” or “Combat Drive?” (ninja)
  • Advanced Non-Commissioned Officers Course (ANOC)?  I thought he got out as a SGT/E5!! And in 10 Years? (ninja)

BLOCK 15a: In regards to the Post-Vietnam VEAP, the form uses a spelling of “VIETAM” (martinjumper)

BLOCK 15b: The military writes “high school” as two words, not one. (martinjumper)

Your typo was quite funny, when you look at all the typos on that exhibit form.

The part that is cut off at the bottom is the attestation from the Registrar of the County. In full, it should say something like “This is to certify that the above is a true and accurate copy of a document presented for recording on [date and time] and has been duly recorded at [book and page] of the official records of Williamson County Texas.”

The actual DD-214 could be — and obviously is — a total forgery, but the “wrap around” authentication printout, probably from a microfilm or record, should allow anyone else at the Registrar’s office to validate when and perhaps who recorded the document.

While it is obvious from the FOIA records that Foley is embellishing, up to and including outright lying about his service, dirty trick campaign supporters have been known to create obviously phony documents and make them appear to have come from the target.

It’s called “Black Propaganda.” Every SF soldier knows that, so I’d like to confirm the source of the above DD-214 copy before I would attribute it to Foley.

Implied from your post before that you “Official Records Search” and the obvious choice is “Military Discharge Index – Web” but typing Foley’s name yields nothing.

Can you be more specific or is this just a speculative pointer and you believe it is there without seeing it with your own eyes.

(a) If any military veteran or any person authorized to receive a certified copy of a record pursuant to paragraph (2) of subdivision (b) of Section 6107 requests the recordation in any county in this state of any military discharge document, including a veteran’s service form DD214, the county recorder shall record the document and maintain the document information in a nonpublic index.

(b) No copy of a recorded military discharge document may be issued except as provided by Section 6107.

(c) The index of a recorded veteran’s service form DD214, provided that it was recorded on or after January 1, 1980, shall be moved to a nonpublic index at the request of the military veteran or the person authorized to receive a certified copy of a record pursuant to paragraph (2) of subdivision (b) of Section 6107.

Document Examiners here scrutinize real estate type docuuments before accepting or rejecting them for recording.
DD-214’s are accepted for recording on good faith and are never rejected.
Additionally,most recording clerks have no military knowledge whatsoever and DD-214’s might as well be written kin Greek.

The first thing that struck me about this yesterday looking at it was it a Nov 88 version of the form and I’m pretty sure there were intervening versions between then and when this form was purportedly accomplished all of which included a disclaimer previous versions were obsolete?

I separated in 1995 and my DD-214 is the Nov ’88 version. I have another DD-214 dated Feb 2000.

I have a third DD-214 dated Aug 2009 issued when I separated in 2011.

I’m not sure if there was another edition of the DD-214 form printed between Nov ’88 and Feb 2000.

Regardless, Foley’s work is a poorly forged document.

I have a DD-214 from a reserve mobilization that ended in May of 1998 and it was the Nov 88 version so that may be one of the few things on Foley’s bogus DD-214 that is technically ‘correct.’

I retired in Sep 1992 and my DD 214 is the Nov 88 one. All the fonts are the same and it was in all CAPS. Not that many blank spaces at the end of each line and all the space were used. A lot of // between each award and assignments too. Box 12 RECORD OF SERVICE was a lot smaller.. All the numbers seem centered and the numbers filled the box. Box 8.b STATION WHERE SEPARATED (misspelled on his) has a zip code for the place.

I agree Skippy. I was a telecommunications specialist, ordnance specialist, administrative officer, personnel officer, logistics officer, and a PSYOP officer. I was a mustang with six years enlisted service and over seven years of foreign duty with deployments to AFG and Iraq.

As a retired Career Counselor (2013), I’d say this is a complete forgery and false document. 214s are normally completed at the transition center and I’ve never seen this style of font. For an official form, why so many misspellings on the document, time is not figured correctly, form not filled out correctly, awards are not properly annotated. Official signature is suppose to be a Warrant Officer or higher, even a GS personal in charge of a transition center, what is a PHOC SEC in block 22? Those signature look similar with the curves and final swipe of the pen.

Well, that works out to about $352/month over a period of 9 years 2 mo. For two or more kids, that may not be excessive – no experience there, so dunno.

And I’d guess that $39k+ total includes court-ordered interest on the unpaid balance, so the actual monthly amount he was ordered to pay may be quite a bit less than $350.

I don’t know about ANCOC, but it is only at Fort Benning.

Believe it or not, both Hondo and I looked up the Federal forgery laws and were not able to find anything making it a Federal crime to alter a DD-214 or to present an altered DD-214 as a genuine one.

Some states consider forgery to be presenting any altered document and representing it as being genuine in order to obtain some benefit from it. I don’t know how Texas defines forgery.

Federal forgery laws apply to specific instruments and the DD-214 is not one of them.

I went to the Williamson County online services site:

and searched for FOLEY LEROY, FOLEY LEROY G and FOLEY LEROY GRANT. Various documents popped up, as mentioned above, these include deeds, mortgage notices, and yes, a child support lien.
But no DD-214!?*
Could this be in fact a “double forgery”?
That is, a forged DD-214 cut and pasted onto some other document from the Clerk of Williamson County, TX?
Both State and Federal forgery?
To the best of my recollection on TAH, if so, that’s a first.

*I’ve noticed that some jurisdictions, such as California, will NOT permit public viewing or copies of DD-214’s, even redacted. Only the servicemember can obtain a copy from the official record book.

I ran into that problem trying to get a DD-214 from California for that lying fraud with the Elko POW-MIA Awareness Association … what was his name? Oh yeah, Les Brown. May be remain famous.

Unless he was assigned to FORSCOM HQ, it would identify his actual assignment. His unit was assigned to FC, not him.

My 214 block 8 a from this same time frame is shown as such: FTS USA 81 REG SPT CMD FC

Note how FC is the last code on the line identifying 81st as a FORSCOM unit. Also note that I was NOT assigned to FORSCOM, but FTS USA 81 REG SPT CMD. I was assigned to 81st and that unit is assigned to FC.

This is a dead giveaway that this is fake. No PERMS clerk at the transition point would make this mistake.

Also, block 9 is wrong. First, AR PERSCOM ST LOUIS had an address which is not in the block. Second, soldiers must be assigned to some form of unit (UIC). in his case it should be USAR CON GP (IRR) etc. If he had served all of his 8 year initial commitment and had not executed a retention contract with the USAR and had fully completed all obligations, this block would indicate that by NOT assigning him to a new unit.

For example: My last 214 assigns me to USAR CON GP (RET) 1600 SPEARHEAD DIVISION AVE, FT KNOX, KY 40122
This is an actual “unit” within the IRR created specifically for managing retirees until they are past recall age.

His 214 and records would go straight to NARA, not the USAR.

I was “parachutist” qualified since 1993 and I don’t think any of my subsequent DD214s had a “P” in my MOS. Though, they did all have my wings in the awards section.

That’s because the “P” SQI is for Enlisted Personnel, not Commissioned Officers. Commissioned Officer MOS’s were all numeric.

For example, the MOS for a Jump Qualified Infantry NCO was 11B4P, while a Jump Qualified Infantry Commissioned Officer was 71542.

Correct for at least part of the Vietnam era. However, prior to 1980 some if not all Army officer specialty abbreviations had transitioned to three-letter alphanumeric codes as well – first two numeric, 3rd position alphabetic. Officers also began receiving ASIs to show qualifications such as Parachutist, Ranger, etc . . . then or shortly afterwards.

I’m not sure precisely when the change occurred, but it was definitely pre-1980 for some if not all officer career fields. I’m reasonably sure it was implemented across-the-board when it was implemented and was implemented sometime during the early/mid 1970s (it certainly didn’t seem to be brand new in the late 1970s), but I’m not positive and haven’t been able to find a definitive reference.

FWIW: this is one case where Wikipedia is not a good source. Their article on Military Occupational specialty codes is at best misleading and at worst is incorrect or incomplete. That article leads one to believe that the change occurred in the Army in 1983, and I know with certainty that many if not all Army specialties had gone to alphanumeric officer speicalty codes prior to 1980. As I recall the 1983 change aligned the officer and enlisted codes more closely, changing a number of them, but was not when officer alphanumeric specialty codes were introduced.

Weren’t you an officer? I don’t think officers have SQI’s on their MOS’s. Not sure about that, I retired as an E-7 and never looked at any officer DD-214s in detail.

S1 types can chim in, but I’m pretty sure the P or V is only there if it’s part of your DUTY MOS at the time of discharge.

So, for example, someone who is assigned to an airborne unit and was ALSO airborne qualified at the time of their discharge will show the P on their duty MOS at the time of discharge: 11B2P or 11B2V if they were also ranger qualified.

But if even if they were airborne and ranger, if they were assigned to a non-airborne unit at the time of discharge it would only show the duty MOS of 11B20

Yah, I’ve about 40% more jumps than most “5 jump chumps” …. I’m a 7-jump chump and was a “leg” Ranger graduate of 14-80 (busted my cherry at Camp Mackall, not Ranger School).

Anyway, my retirement DD214, Block 11 (Primary Specialty … etc.) states:
11A INFANTRY, GENERAL, 14 YRS & 6 MOS//39C
CIVIL AFFAIR OFFICER, 14 YRS & 6
MOS//NOTHING FOLLOWS.

If you are parachutist qualified, your ASI is “P”.

You do not have to be in a “P” designated billet to have the ASI.

The same will go for “V”.

ASI and SQI identify the soldier’s skills, not the unit’s.

Well, yes and no. I’m not sure what the reg says but I have 5 DD-214’s, 4 of them were issued to me after I was airborne qualified.

I qualified for two MOS’s, 96B (all source intel analyst) and 95B (military police.) I’ve been active to Federal service out of the RC in both MOS’s.

The two that were issued to me when I was discharged from an airborne unit show my MOS as 96B3P (96B, skill level 3 for E-6 and P for Parachutist qualified) which was my duty MOS during the deployment (I made my last jump in ’03 after returning from Afghanistan.)

The two that were issued to me following Reserve Component Mobilizations with non-airborne units are split. One shows an MOS of 95B3P (Military police, airborne qualified) even though the unit I was mobilized with (2125th GSU out of Fort Bragg) was not an airborne unit. The other one shows 96B400 from the 115th Field Artillery Brigade of the WY National Guard following a mobilization and deployment to Kuwait in 2004.

So at least for me, it’s 50/50 on whether an airborne qualified soldier will show the “P” as their duty MOS if they weren’t in an airborne slot when they were discharged. Others can chime in based on their experiences but that’s mine FWIW.

I don’t think any of my DD214s had the “P” qualifier.
