Instead of turning them over to the Senate as prescribed by the Constitution, San Fran Nan is withholding the two Articles of Impeachment voted on just last night, accusing Trump of abuse of Presidential power and obstruction of Congress, neither of which rise to “treason, bribery, and other high crimes and misdemeanors.”
She claims that Senate Republicans are unlikely to conduct a so-called “fair” trial, a pretty extreme position considering the Star Chamber-like Impeachment Hearings conducted by her henchmen, Congressmen Schiff and Nadler.

Pelosi’s comments came as she declined to confirm when she will send the articles of impeachment to the Senate. The California Democrat said she is waiting to see what procedures will be adopted for the Senate trial.
Her remarks echo her own comments made Wednesday evening, when she was noncommittal on transmitting the impeachment articles, citing claims that Senate Republicans are unlikely to conduct a so-called “fair” trial, a term which House Democrats have thrown around in recent days.
“We’ll make that decision as a group, as we always have, as we go along,” she told reporters after last night’s vote. “So far we haven’t seen anything that looks fair to us.”
Prior to Pelosi’s press conference, Senate Majority Leader Mitch McConnell (R-KY) denounced the impeachment vote and blasted the speaker for being “too afraid” to send “their shoddy work product to the Senate.”
“The framers built the Senate to provide stability,” McConnell said in a Senate floor speech. “To keep partisan passions from boiling over. Moments like this are why the United States Senate exists.”
She’s clinging on to what little leverage she has left, but does not help the Democrat Senators running for the Primary by anchoring them in DC.

Rush Limbaugh brought up an interesting point today: If Donald Trump couldn’t ask for Joe Biden to be investigated because he may be his opponent in 2020, then how is it that Senators Sanders, Warren, Booker and Klobuchar, any one of whom is a potential rival candidate of Trump’s in 2020, can sit on what amounts to a jury panel to determine Trump’s political fate? The balls on these people. They outright deny a fair hearing in the House, forget any past precedent or even an appearance of fairness. Then they complain, even before anything is done, that the Senate NEEDS to bow to their demands for fairness.

Pelosi is either delusional, or she’s being extremely brazen.
My understanding is that once the House votes to impeach, the matter becomes like a grand jury indictment; the applicable charges go to a regular trial for consideration before a judge. Once that’s done, the original grand jury then has no control over how the regular trial is conducted.
What Pelosi seems to be saying is that even though an indictment exists, the House isn’t going to show it to the Senate until the Senate agrees to House terms about how the Senate trial process should work. Something which would extend the power of the House into the realm of what should be limited to the Senate.
Considering the track record of Pelosi, Schiff, Nadler et al, it also wouldn’t be a surprise if the Democrats’ dictated terms were issued with non-disclosure rules such that the public never sees the actual conditions. Also to consider is this:
Pelosi’s apparent assumption being that whatever the Senate does, it’s not going to meet with Pelosi’s approval unless, again, the House is able to dictate how the Senate trial is carried out.
Somehow, that bears a remarkable resemblance, in a different context, to Pelosi’s famous “We have to pass the bill to see what’s in it.” Such an inclination by Pelosi to make a decision based on politics and emotion instead of all known evidence is also, demonstrably, not an anomaly.
Earlier this week, Pelosi received a six-page personal letter from President Trump in which he detailed his objection to the House’s impeachment process. Pelosi then announced loudly to the news media that the contents of the letter were “sick.” What most of the mainstream news media failed to mention was that Pelosi hadn’t even bothered to read the letter when she made the pronouncement.
I can’t believe there is no way to force her hand.
If it goes on too long it’ll end up in front of the SCOTUS. And then it’ll be up the Executive Branch to enforce the ruling (either way).
That would be gold.
Mitch McConnell passes a Senate resolution that there are no valid Articles of Impeachment unless they are delivered to the Senate within 24 hours of passage by the House. Any lapsed articles are Void and the President presumptively Not Guilty on any such charges.

That’s what I’m wondering. It’s not like the articles are super secret. They’re a matter of public record. Just go get a copy.
But that pesky 6th Amendment. It affords THE ACCUSED a fair trial…not the prosecutor.

I think the principle definitely extends to an impeachment trial, but that amendment only references criminal cases. Impeachment (though often contemporaneous with a criminal trial) isn’t criminal.
