Judge Prevents Trump Administration from Refusing Asylum Between Ports of Entry

Left leaning groups took action when President Trump provided an order to refuse asylum to those who don’t go through an authorized port of entry. A judge, chosen by President Obama, issued an order preventing President Trump’s administration from enforcing President Trump’s order. This appears temporary.

U.S. District Judge Jon S. Tigar, who was nominated by President Obama in 2012 to the U.S. District Court for the Northern District of California, issued a temporary restraining order after hearing arguments in San Francisco. .
According to the article, about 100 asylum claims are being addressed, daily, at the crossing from Tijuana to San Diego. Additionally, there’s a notebook floating around among the migrants that have over 3,000 names. This is before the caravan arrives. Once they get there, we’re looking at over 10,000 people in that area waiting to come in.
The Mexican government offered asylum to these migrants as they were headed north. Many turned these offers down.

During a conference call with reporters Monday afternoon, homeland security officials said “most of the caravan members are not women and children” and that more than 500 criminals are traveling with the group that has amassed on the other side of a San Diego border crossing.
Yet, there are people out there that believe that our borders should be easily crossed… That it doesn’t matter if those crossing are doing so illegally.
Meanwhile, the troops sent to the border are close to accomplishing the mission they were sent to the border to do. They should soon start pulling back and returning to where they’re normally assigned.

I call the 9th circuit coury the progressives hit man. Right, wrong, legal or not, enfircing laws not on the books thr left just sends in their hitman. It is my hope that everyone killed by these invaders are in this judges family.

Many of the newsies are calling this the “Trump asylum ban.” What Trump said in his proclamation, issued on 9 November, was that foreign nationals must present themselves at official ports of entry to have their asylum claims processed. The horror. That’s like expecting me to stand in a line at some gov’t agency. I should be able to slip in the back door and cut the line. And if I’m caught, they would probably tell me something absolutely crazy, such as, “Get in line, if you want help.” This just ain’t right!
It’ll take a while for Barry’s activist judges to fade into the sunset. This is why it’s so important to populate the bench with Trump’s picks, and give him another bite at the SCOTUS apple.
The good news is the decision maker was only a Fed Dist Ct judge. The bad news is that the 9th Circuit is no better. If you read the proclamation, you will see the line of argument that will be used on appeal.

This is ridiculous. If you want asylum, go to a port of entry, an embassy, or consulate. If you break the law coming here you shouldn’t be allowed to then say “Oops, I meant to claim asylum.”
This will take up to the end of Trump’s second term, but I hope to God we get this immigration “system” fixed.
I could see if they were Mexicans making the argument that time is of the essence and they need to jump the border instead of waiting at a gate in Mexican territory. That’s not the case here. They’re safe in Mexico, but just don’t want to be there.
The asylum stuff for Mexicans, Central and South Americans is just a scam used by illegals to try to stay here. I had a case involving a plaintiff Mexican who was illegal. He had lost his foot due to his own stupidity and misuse of a large paper baling machine. His “immigration” lawer filed a petition seeking asylum so he wouldn’t be deported. He claimed he would be persecuted in Mexico because he was an amputee. As a result, he was allowed to stay here with a green card for the next four years while his asylum petition was litigated. Once he received his $1 million plus settlements of his PI and Workers’ Comp cases, he voluntarily went back to Mexico to live large on his Gringo money.
This is an attempted invasion/ forced illegal entry to our country. It should be treated as such. It is that simple. As many of us have posted; those people that want to let these illegals in should be willing to feed, clothe, and house them.

That’s the law. That’s the link to the page with the citation by the DHS. But that judge graduated from UC Berkley. Anyone with an operation brain knows they’ve been kaput for decades.
The law is very clear on this matter USAF, but that judge doesn’t know the law. In point of fact his ruling was null and void when he issued it because the federal law on the matter is both settled and has been upheld in previous cases. This willful ignorance of the law is a big reason why the 9th Circus is overruled on appeal more than all the other Circuit courts combined.

A few possible actions for Trump to take:
Ignore the judge. Obama did it pretty regularly and the liberals loved it. He has no ability to enforce the order at all. It also is only applicable in the ninth circuit area, not the entire country. That judge is federal, but he cannot enforce it outside his district/circuit.
Declare it a matter of national security, and tell the judge if he continues to meddle he will be jailed until such time as Trump sees fit to release him. (a potential Obama solution). Not sure how Executive orders and judges interfering with them work.
Do what should have been done in the first place and put direct fire on anyone seen coming through the border.
