Robert Livingston sentenced

| May 19, 2018

We wrote about Robert Livingston late last year when the former mayor of Lakeland, Minnesota pleaded guilty to pretending to have a military career. He stole more than $137,000 in veteran healthcare and disability payments from the VA. He was sentenced to two years probation this week according to KSTP;

He admitted to federal agents that he went through 35 drafts to make his fraudulent discharge papers look “believable” before submitting them to the Veterans Administration, according to court records.

[…]

A dozen VFW members were in federal court in St. Paul as Livingston was sentenced.

“Justice was denied today,” VFW member Darrin Ewing said. “He was not sentenced to jail for the crimes he committed. This sends a message anybody can steal from the government and get away with it.”

[…]

But federal judge Paul A. Magnuson said prosecutors asking for 10 months of prison time despite Livingston’s numerous health issues was a case of the government “not having a heart.”

“It’s not going to happen,” Magnuson said before putting Livingston on probation instead of sending him to prison.

The government isn’t supposed to “have a heart” when dealing with criminals. They are supposed to give them a sentence that is in line with the crime that was committed.

The judge was obviously the mayors good buddy, so let the judge serve the time that thieving lying mayor isn’t serving! imho

Tom Whitey

Fuckers have no heart for me. I was in the service and I got into a car wreck and was almost killed after I got out. I busted all my teeth and look like shit for the last 10 years. You would think I could get the VA to pay for or help getting these things fixed, be reAL these people say because the ass who hit me is responsible I have to go through his insurance. Guess what? He had none and the hospital bill is 130 grand alone and guess who they want to pay? Yep the one who was going to work one morning minding his own business. LIFE DESTROYED IN SECONDS

Green Thumb

Hopefully the court of public opinion will worse for him than prison.

Turd.

Years ago it was proposed to allow the poor to seek health care from the VA. Don’t recall the details but it quickly vanished. Seems they have a record of treating anybody regardless of service anyway. They link your health care to every agency under the sun but confirming actual service seems to be left out.

I can imagine the riot that would ensue when clintoon’s project to put welfare clowns in the VA hospitals.
The American Legion, VFW, and lord knows how many pissed off Veterans threatened to literally cut the balls off of any moron that sent a bunch of welfare queens into our hospitals…….
It was a serious threat too, the press downplayed it, but I went to a couple of meetings in Madison and believe me, the State, Federal and Local Representatives and Senators got an ass reaming like nobody’s business !!!
It was grand.
Same thing will happen if they try to delete the Second Amendment…
Only worse…

Claw

If it took him 35 drafts to get the DD214 to look believable, he should have gotten somebody like Forgin’ Frank Visconi to help him out, because when I paused the video and looked at the 214, I was able to spot at least a half dozen errors within the first minute of looking at it.

As far as paying back the 137K before he dies, that’ll never happen. It’s not the money so much as him taking up a slot(s) in the VA health care system that should have went to a real veteran in need.

Is the son of a bitch too incapacitated to empty bed pans at the VA? give the dirty bastard the dirtiest jobs they have at VA and let him do his time that way…..thats a punishment that would deter a lot of other worthless turds imho

2/17 Air Cav

The thief and fraud is 75 who, according to his lawyer, needed the VA health care. Okay, whatever happened to Medicare and Medicaid? And, why, if it was all about health care, did this worm take disability payments? As for the prosecutor not having a heart, as the ancient judge said, it’s not the prosecutor’s job to extend mercy or leniency. That is the judge’s province.

Ex-PH2

Yes, he did get disability payments, Air Cav. That’s pure fraud. He should have considerably more than probation.

Steve

Way more than probation. 6 figures……

USAFRetired

I look at this shit heels case and wonder.

In 2010 he was over 66 so what of his medical needs wasn’t being met by Medicare?

He was past his full retirement age so he would be getting his full Social security, what about his other pensions, IRAs 401ks, etc.

No he decided to stick the taxpayer for the bill by fraud.

A Proud Infidel®™️

I wish for him to have diarrhea and sneezing fits the next time he is out in public, ditto with the Judge that took it easy on him!

Mr. Livingston I presume. No, it’s Norman Crimp you creep, got any gum. TV chewing gum commercial back in the 70’s or 80’s, can’t remember. I have to lighten up today and keep the BP normal.

OWB

Disgusting all around.

He has health issues? Not my problem. Not the justice system’s problem. The only up side I see to this mess is that we will be paying no more for his care. Or will we…

chooee lee

Screw his bad health, they have medical facilities in the joint.

OldSoldier54

Yep.

3/10/MED/b

Hopefully these “health issues” will succumb to gravity soon.
At the top of a long flight of stairs.

Twist

Last time I checked jails have health care. Why not send him to jail so he can get all the “free” health care he wants?

Claw

Been doing a little deeper checking into his story.

According to the paperwork he submitted to the VA (and the VA took his word for it), he was direct commissioned into the Army in 1973 as a Captain, and after only six weeks of flight training, became a OV-1 Mohawk Pilot.

He claims he spent some time in Berlin as an MI Officer (but the time periods are reversed on his altered DD214) during the Cold War and that was where he was awarded both the Bronze Star w/V and an ARCOM w/V.

But I’m guessing that since he’s on probation, he won’t be traveling out of state to attend the yearly Mohawk Pilots Convention in Reno this coming October to say Howdy to his classmates./smile

Mason

Just imagine what his first draft looked like!

Probably done with crayon… in the “dear teacher” font

No doubt written by Epstein’s mother.

It’s interesting to me that journalists who want to be taken seriously continue to refer to “Veterans Administration,” when the agency became Cabinet-level as the “Department of Veterans Affairs” in March 1989. It’s almost 30 years ago, yet no one seems to get it right.

Tallywhagger

Old habits die hard 🙂 It’s been more than 40 years since I was in the Army. In those days, it was the VA.

Same with airport names, Reagan is Washington National, Washington International Thurgood Marshall is BWI, Loius Armstrong International is Moisant Field (NOLA), and so.

I’ve lost track of which football teams are from where and can no longer name the countries on a map of Africa.

True story, I asked a former student what country he was from, he answered, South Africa. I asked him what part. He was not born when that area had been called Rhodesia.

Judge Magnuson (born February 9, 1937) was nominated by President Ronald Reagan to a seat on the United States District Court for the District of Minnesota. He was confirmed by the United States Senate, and received commission on October 29, 1981. He served as Chief Judge from 1994 to 2001.

The 81 year old has been a Federal Judge for 37 years- time to hang up the robe, yerhonor.

timactual

He only did it to survive–he needed the health care. All those ribbons were just an accident.

ALVO

Fucking TRAVESTY of Justice. If I had stolen 100k plus from Uncle Samuel I expect I’d spend AT LEAST 5 YEARS in the pokey. How does he not spend a day in jail? If I’m dying of cancer and kill a guard in the commision of a bank robbery, netting $137,000 do I get a pass just because I have cancer????!!! It’s a full blown WTF.

Alice

Unbelievable. Minnesota has become California with winter. Pay the money back. Public apology. At the least.

desert

minnesota has become the a.h. of the country, started with electing that muslim scum sucking pig, now its everything that comes out of there is communist/liberal bullshyt! imho

Skippy

jonp

Did he have “heart” when he stole valor, money and slots from a vet that needed them??????

Fuck that asshat. He should be in jail and that judge should be removed from the bench

Jarhead

Smug looking tubalard sitting there with a chest full of medals. Would like to hear his stories representing each and every medal he likely found in a pawn shop. How is it such big fat ass loud mouth phonies CONvince people to elect them to office?

NHSparky

Betcha if shitbag was impersonating a judge old Magnuson would be hammering someone’s dick flat.

FatCircles0311

What a shitbag judge. The Law is supposed to be removed from emotion. 2 year probation for such fraud isn’t justice it’s a mockery. The judge obviously is past his prime and is identifying with scumbag criminals over the law, justice, and victims.

Mark Lauer

That decision was an example of the government without a fucking BRAIN.

Just by the pure fact that this ass monkey went to so much trouble to forge a DD214 should have told the judge that this guy was a total criminal, and should serve hard time. I don’t give a whore’s left nipple that he has “health issues”.
I have health issues, but don’t think I’d get much of the break if I committed fraud.

desert

You got that right, I am a legitimate vet and have “numerous” health issues, didn’t stop the VA, from causing me to be ripped off for 1700.00 dollars, guess it was to cover this piece of shyt?

Jarhead

Suddenly my paranoid half of my brain says, “Hey, has anybody looked into this judge’s background?” Just seems odd that a judge would utter a meaningless so-called “sentence” as such in this day and age. Don’t suppose he’s been guilty of the same and wants this to be over, done and hopefully forgotten before people start digging, do you? Naw, surely not such a respected politician.

Thunderstixx

Since it was Minnesota, home of the clown senator and more liberals than mosquitoes, and that’s a lot, I’m surprised that he even got probation.
I just hope he goes to a good solid level of Hell when he passes on.
There are so many that deserve to go to Hell for their actions, I wonder and hope that they get theirs in the end, over and over and over…..
Maybe we’ll get lucky and he’ll get Shingles that last him until he dies of stupidity…

Brown Neck Gaitor

Judge is a Senior Justice (semi-retired) and has been sine 2002.

Bastard ought to be in jail! Don’t give a sh*t if he’s on his death bed, still should be in jail.
