Former Mayor Robert A. Livingston pleads guilty
KSTP reports that former Lakeland, Minnesota mayor Robert A. Livingston pleaded guilty to receiving veterans benefits from the Veterans’ Affairs Department with a forged DD214 and “numerous false documents”. He ran for office on his nonexistent military record;
The plea agreement said Livingston never served in the military and created “numerous false documents,” including a DD-214, when he applied to the VA for health benefits and compensation.
Livingston obtained $110,566.21 in medical care from the Veterans Health Administration and $27,198.66 in tax-free disability payments to which he was not entitled, according to court records.
Yeah, the article quotes a VFW member complaining about Livingston collecting VA benefits, but there’s a picture of Livingston in a VFW hat. And Congressman Tim Walz who pretends to be an Iraq veteran when he campaigns complained to the VA about Livingston getting vet benefits. Perhaps they should should clean up their own yards.

The local VFW jumped through hoops to make sure that their “buddy” didn’t get screwed over, yet ROBERT A. LIVINGSTON fucked the VA and vets out of nearly $140k in care and benefits.
I’m guessing that he’ll never pay back the entire amount.

You got that right! I was on the floor and couldn’t get up, EXTREME back pain, paramedics took me to E.R., hospital filled me up with pain meds (morphine etc), and sent me to ICU for 14 days! I was out of it for a number of days, 4-5 I think, VA doesn’t want to pay for the hospital bill because I didn’t call them to get authorization? What freaking moron in the VA came up with that one, how in hell do you call when you do not have your mental faculties? Yet they will pay these bastards and never blink an eye!!
You have to schedule accidents and illnesses in advance and there’s a long waiting list.
My wife is a teacher. If she’s deathly ill she has to get lesson plans to the school by midnight and find her own sub for the next day(s).

I have never understood the need of criminal defense attorneys to get in front of a camera and reporters and make excuses for their criminal clients after they have been convicted or pled guilty. I can see why they do it before their client has been convicted or essentially confessed on the record in court, but afterwards, it is just as ludicrous as it is disingenuous.
I can only guess that they do it either for possible leniency in sentencing or to lay groundwork for appeals (where applicable).

This guy’s client is not a good guy. We the public may respect Livingston’s privacy when he has paid back every cent he stole (plus interest) and begs for forgiveness when he gets out of prison.
Until that point, he deserves every ounce of scorn, ridicule and venom directed his way for not only betraying his oath of office, and people that elected him but stealing money set aside for real vets with real disabilities and real needs.

I understand how a VSO might be fooled by a forged DD214, but how the heck does the VA pay disability and other benefits without official medical or other service records not provided by the beneficiary?
And stealing $140K, not to mention how this impacted veterans waiting for services, better result in some incarceration.
Because too many simply do not care about anything other than drawing a paycheck and future benefits for doing as little as possible to earn either. Too many others are completely incompetent, with supervisors who do not care. When a competent or caring individual tries to cull out the idiots, fools, and otherwise undeserving employees they soon discover an army of those willing to protect bureaucrats who should long ago have been removed from the public payroll.

The process of my getting to 100% took years during which every word ever written in my AD health record was read and reread, many times over several years. What did the VA base the decision to grant this guy disability which resulted in him being paid? Did he gundeck an entire health record also? I’ve heard of certain events being gundecked, often quite elaborately over years by someone with ready access to a health record. How did this guy pull off this coup?

They probably have a simple computer program that any fool can use, except that most of their fools simply don’t care enough to do it.
I picture buildings full of needless bureaucrats who shuffle claims around among themselves for months. Then there is a room full of bureaucrats who stamp every claim “DENIED.” All appeals go to either a different building or a separate floor of bureaucrats who shuffle the appeals around for additional months. And around and around they go.
Verification for eligibility should never come from the claimant. Why the DoD and VA still don’t have a simple verification process in place is beyond disgusting.

Two different issues need to be concurrently addressed by independently operating folks: one group needs to be purging the rolls of those receiving bennies they have not earned while a second group is working on clearing those who have earned the benefits to receive them.
Since apparently the computer system has still not been developed that would allow the VA to tap into the DoD to verify service, assign a few folks to physically work at NPRC (or wherever else official records are also secured) whose only job is to check the records of those applying for VA benefits. And hold them accountable. Same with those verifying those already drawing bennies.
This really isn’t as difficult as some would have us believe. Use telephones, computers, and physical records. Just get it done.
Ask any of those actually working with the records on these idiot…. records can be and have been salted. Citations have been forged and entered into records. Phony record edits have ended on on DD214’s (SgtMaj Richard Barr Cayton for example.) Those checking records must be smart enough to read and think – if there are combat awards – were they in a combat zone, or Philadelphia? If there is a POW medal – were they noted by DoD as captured? Do the tales only exist in the mental health exams (Otis Ashley) or does a Medal of Honor and captivity show in historical records?

I’ve worked for the VA the last 4 months (finally hired after 30 tries after retiring from the Army 2 years ago but that’s another story)
But to answer your question it’s based on procedure codes. Every time a Veteran is seen by a provider every encounter is tied to a procedure code.
These procedure codes have costs associated with them.
Which is how the VA not only requests funding but gets reimbursement from private insurance

We need to take these guys aside and make them an offer: They show real vets how to game the system like they did and get the level of care and benefits that they scored. Do that, we discuss a sentence reduction and not naming you publicly.

I went to the VA in 1992. I thought I had cancer. I had experimental vaccines. Fired 1000 rounds of DU. Destroyed chemical munitions in Iraq and a chemical factory. Fought at the burning Rumaylah Oil Fields.
I was sick to my stomach every day. Slept 2 hours a day or not at all.
Heard about Gulf War Syndrome.
They started treating me for PTSD. 7 years, 2 dozen MD’s and tons of tests and they rubber stamped me with PTSD and gave me a 10% rating for PTSD and 0% rating for hearing loss.
Thank God I have a great personal support system and will power or I would be in a gutter somewhere maybe talking to a telephone pole.
Another 3 years to get 30% rating. I don’t know how the hell I went to work and did stuff from all the meds I was on.
2 more years and 4″ of documentation to make 50%. I am blessed to have compassionate people in my organization that put up with my ups and downs.
Another 2 years of saying, “I can’t afford a hearing aid and I can’t understand what people are saying to me unless I am in an isolated room with one sound source only.”
I said some kind of magic phrase – sorry, I don’t recall what it was – and the audiologist had an epiphany and offered me whatever hearing aid I needed. No, I didn’t threaten to boil her pet rabbit.
A good chunk of my life is missing and 1/2 of it is from the early years of my daughters. I can’t get that back.
