Bergdahl sentencing delayed

According to CNN, justice is delayed yet again. Bergdahl’s sentencing, which was supposed to happen today, has been rescheduled until Wednesday because of a lawyer’s family emergency.

Is anyone as tired as I am of the news media calling this idiot SGT bergdahl ? He wouldn’t make a pimple on a real SGT’s ass . So much for gratuitous promotions by obummer’s folks .

Yeah. I know why they promoted him and wasn’t too happy with the decision then. I just wish that when they bust his ass and take away his unearned stripes that they would do it Branded style.

Not as dramatic as the opening to Branded, but one time I was at a Captain’s Mast where the skipper awarded the Sailor punishment to include a bust to Seaman (he was a frocked PO2).

Right after announcing his decision, the CO directed the MAA to cut off the Sailor’s crow. You should have seen the kid’s eyes as the MAA did it.

The CIB goes bye-bye when the GCM sentence is approved by the convening authority. Conviction of desertion during wartime automatically revokes ALL special skill and combat badges.

Not sure about any decorations and campaign/service medals. The GCMs likely go away; the others may or may not stay. AR 600-8-22 isn’t clear on that like it is regarding combat and special skills badges.

I understand and appreciate promoting prisoners of war in their absences. A man who gets held for years shouldn’t have to come back two or three grades below his peers, for arguably tougher service.

However, didn’t they know pretty much from the start that this hat of ass walked away of his own accord? Don’t understand why we’d promote a deserter.

They knew. I emailed with people from his platoon just days after it happened. They knew already. (The biggest talk of the town then was that he left his rifle behind. An infantryman leaving his rifle.)

Then just weeks later CIA (unverified what agency) started doing their own investigation. It wasn’t a long one.

The first reports said he was fallen behind on patrol, and that he was drunk. The people from the units knew exactly what he took.. a couple of knives, water, compass.

Like it or not, once he was tagged as a POW he was given advancements and promotions according to his Time in Grade/Service. The same happens for any POW.

Until he’s sentenced, he’s a Sergeant. Hopefully the delay isn’t too much longer so they start calling him Inmate Bergdahl.

You and I are thinking more or less along the same lines. I think that a DD, total forfeitures and reduction to E-1 are pretty much a lock. I think he’ll probably get some prison time (although not much in light of length and conditions of his captivity), but if he gets none it won’t shock me.

Not really…he was very young and stressed out in CG boot camp…as kids sometimes do. He tried the Army when he was a little older and did perfectly fine in training. (In fact he was a PT stud and imagined he was going to try for SF training…but a deployment with “lesser mortals” got in the way, and then there was the Article 15…) Based on what the Army knew at the time (’08, when he enlisted) there was nothing wrong with giving him a second chance.

The Defense has done a really good job of selling their talking points to the public…but the blame here lies entirely with Bergdahl himself, and not with the Army or his unit.

Well then they should also consider the current President (at the time) and his “positive” commentary, as well as that of his staff’s, about Bergdahl too. I’d say that makes it a wash. They offset each other since he was just a candidate at the time.

I appreciate his lawyer doing whatever he can, but Bergdahl is going down, period.

Why? Because in the military justice system the accused (ANY accused) is entitled to be tried and sentenced by an unbiased military judge who is free from any taint of unlawful command influence. That’s why.

Then by that same standard he needs to be asked what influence comments by Obama and Susan Rice have had on his sentencing decision.

They after all said he served with honor and wasn’t a traitor.

Or maybe while we’re at it we can ask the judge whether or not his sentence recommendation was or will be somehow influenced by GEN Abrahams decision override the determination of the Article 32 hearing and go forward with the most serious charges.

I mean if we’re going to go down the road of making sure the judge is completely unbiased…

You’re mistaken. Unlawful command influence comes from the chain of command at the time the proceedings are taking place – nowhere else. Of all the people you’ve named, only one is currently in the military judge’s chain of command: President Trump. And even Trump’s pre-election comments probably wouldn’t be a problem now, given that he was not CinC at the time he made them, except that he appeared to have recently reaffirmed them.

That is quite likely to happen. The Defense is perfectly capable of asking to voir dire the judge on any bias that he feels or considers himself subject to. And I don’t doubt the judge will grant the request if so, and answer all the questions.

(I was expecting the Trump “walk-back” much sooner after his inauguration, as a way of keeping the taint of UCI away from this case completely. Had I been his legal advisor, that’s what I’d have recommended.)

Apparently, future inmates arrive at USDB in full uniform.

Punishment starts when you arrive.

Intake includes, removal of all awards, badges and insignia from uniform.

Then you are given your skivey whites and orange INMATE uniform.

I do not know if this true, policy or different.

I’d guess so. As I recall, award of the POW Medal requires the captive to have served honorably while a POW. The conviction for misbehavior before the enemy strongly suggests that Bergdahl did not – as do multiple news reports that indicated he actively collaborated with his captors.

I would think a requirement would be that you were captured while engaged in combat operations against the enemy. Bergboi just walked into the arms of his captors after asking locals how to get in touch with the Taliban.

They didn’t say which lawyer. I suspect it was Berghdal’s lawyer. If it was then I’d say this was possibly a delaying tactic to try and get a more lenient sentence. After Berghdal saying being in the Army is worse than the Taliban I hope they have no mercy.

He’s admitted guilt, nothing less than, E-1, restitution of back pay, DD and 50 years in prison.

Now they claim a remark by Trump is responsible for Bergdahl’s delay in sentencing. After looking at the recent evidence I’m thinking Bergdahl is getting life in prison. The soldier who can’t speak and is in that wheel chair needs some justice.

I think I read an article that stated the Judge will sentence him today.
The gist of it was Judge Nance stated that he was perfectly capable of not letting any statements made by the President affect his decision.

As an aside; if anyone thinks that a military judge is so weak as to be influenced by a public comment by POTUS; then what the fuck are they doing on the bench to begin with? Thinking that, it is a discredit to the judge, the Army, and to the UCMJ.
