Yesterday, I noticed an uptick in traffic to our post about Major General David Haight from late last month. HMC Ret sent us link this morning from MSN which explains why there was an interest in the story. They drilled down into the details of the salacious story; how Jennifer Armstrong, 49, a government employee, was attracted to the general’s smile and began a torrid love affair with him that lasted ten years.

Armstrong, who told USA TODAY in interviews that the relationship began with a flirty email and ended after assignations with multiple partners at swingers’ clubs, hotels and her home, says Haight had promised a future together. “I gave him the best years of my life,” she said.

In a statement issued after news of his reprimand broke, Haight vowed to work with Army investigators untangling his dark, off-duty life.

The general had built an enviable career in special operations and light infantry assignments, but one “aw, shit” is all it takes.

Apparently, the general had “Haighters” (see what I did there) who left anonymous tips with the Army Office of Inspector General

In 2015, anonymous tips about Haight’s extramarital affairs were brought to the Pentagon’s inspector general. Ultimately, the Army’s inspector general took the case. The Army ordered Haight to sever contact with Armstrong. Investigators interviewed her and others and substantiated allegations that he had “had an affair and lived a ‘swinger lifestyle.’ ” Investigators also determined that he had spent nearly 24 hours on his government cellphone and sent more than 800 emails on his military computer to Armstrong.

The letter of reprimand effectively ended his 30-year career. A board will determine his retirement rank. A clean record could have earned Haight as much nearly $123,000 in his first year of retirement. If he’s busted back to colonel, his pay could drop to about $98,000.

Full basic pay for a BG is about $100,000 per year.

Retirement pay is 50% of that.

Retired pay for GOs/FOs is computed using the same rules as for anyone else. But two provisions work to allow quite large retirement pensions for some GOs/FOs – in my view, too large.

1. About a decade or so ago, the cap of 75% for military retired pay was lifted. Since GOs/FOs and a few other grades are allowed to serve past 30 years of service, this means individuals at these grades can earn a pension greater than 75% of base pay.

2. For GO/FO ranks, base pay received while serving on active duty is limited by law – I believe it’s limited for both grades to pay equivalent to Level II of the Executive Schedule. However, that legal prohibition only covers active duty service; retired pay is apparently calculated based on published DFAS pay scales, which for 3- and 4-star GOs/FOs are higher than the legal limit. (Federal civilian pay scales don’t do this – they “flatline” at the higher grades when they hit a statutory limit.) This means that under certain circumstances a 3- or 4-star GO/FO can actually receive MORE in monthly retired pay than they ever earned in base pay while serving on active duty.

I have no problem with people who serve beyond 30 years continuing to accrue a larger pension. However, IMO the latter case – a select few qualifying for a monthly pension that exceeds any monthly base pay they ever received – is simply ludicrous.

A simple solution that fixes this stupidity would a one-line addition to Federal law in the appropriate part of Title 10, reading as follows: “The maximum monthly military retired pay due any individual at time of retirement shall not exceed the maximum monthly base pay that individual received while serving on active duty.”

Addendum: Federal law has apparently been changed to fix the problem I noted above – now, calculation of retired pay is also capped by being based on Level II of the Federal Executive Schedule for GOs/FOs retiring in the future, which means the max is now no more than 100% of highest base pay received (for a 40-year career). The article Tony 180A linked above goes into more detail regarding the history and mechanics of the changes. I hadn’t heard or read about the last change (2014) listed in the article before reading the article today.

That latest change in Federal law (2014) fixes the second issue (retired pay for senior GOs/FOs exceeding max base pay ever received) that I listed above. However, the change is being phased in, with those serving on 31 Dec 2014 at least partially “grandfathered”. So some 3- and 4-star GOs/FOs currently “on the books” may still be able to retire and receive pensions larger than any base pay they ever received on active duty.

Base pay for a BG or RDML (O-7) is substantially higher than that – try well over $12,000 and change monthly with over 20 years of service, or over $144k annually.

I also don’t think you’ll find too many O-7s with less than about 25-30 years of service, either – which equates to retired pay that’s between 62.5% and 75% of base pay (2.5% per year of service).

That’s in the ballpark if not dead on. Would have to do a “high-3” average using the last 3 years’ pay scales to double check you – base pay this year for an O7 over 30 is $12,347.70 monthly, but it was lower in 2014 and 2015. How much lower, dunno – and don’t really care.

I’m thinking he’s going to be worried about a considerably lower pay scale for computing his retired pay. Since the affair continued while he was an O6 and O7, I’m thinking there’s a good chance he may be retired as an O5.

The USA Today article about Haight implies that the affair may have begun while he was CO of one of the ranger Battalions in 2005. Presumably, that means he’s at risk of losing O6 as well as O7/O8. And if he didn’t have 3 years TIG as O5 before the affair began, he might lose O5 as well on retirement – I’d guess not, but it could theoretically happen.

There is indeed precedent. MG John Meher ended up losing both stars and retiring as a COL under what I recall were substantially less salacious circumstances.

It seems to me that if his misconduct spanned a decade and an investigation can substantiate that, then he needs to be shown the door with whatever retirement pay he rates based on the rank he honorably served in.

In other words, if he started his bullshit as far back when he was a Major, then he goes out the door with that rank and the retirement pay that goes with it.

(As someone else stated, these senior officers should be hammered to the wall with the full force of the UCMJ behind their punishment because you can bet, at one point in their career, they adjudicated over an enlisted member for similar shenanigans, and probably hammered them)

Yes, this is an issue. It’s an issue because we have a GO or FO who’s set himself up to be a primary target for blackmail – and has also demonstrated a pattern of reckless behavior and bad judgement lasting a decade.

I wouldn’t care too much if the guy was single, or if he’d simply had a discrete affair. But hitting swinger clubs and engaging in numerous instances of multipartner sex while married (and presumably unknown to his wife) is a bit beyond that. And in my book that becomes a significant issue when the individual concerned is is also simultaneously holding a position that could make him a very lucrative target for blackmail by foreign intelligence services.

I knew both Dave and Jennifer. My wife and I were introduced to them at Ft Knox. About 5 years ago. I thought they were married to each other. He introduced her to me as his wife. She’s a beautiful blond and that at that time had just recovered from breast cancer. I don’t agree with what they did, I’m just confirming that they acted very married (to include the wearing of wedding rings). Such a shame. Now I question where was the real Mrs in all this? Can someone for that long be so naive? This obviously wasn’t just an affair. This was a another life/marriage and commitment. One question why not just get divorced if you love someone else?
