New York indefinitely cancels Donald Trump’s sentencing

Donald Trump’s defense team just received permission to file motion to dismiss the charges. Judge Juan Merchan granted this request and removed the sentencing from the schedule. Trump’s attorneys have until December 2 to file their motion, and Bragg has until December 9 to respond to the motion to dismiss.

Merchan said Trump attorneys have until Dec. 2 to file their motion for dismissal. Merchan said Bragg has until Dec. 9 to respond.

Merchan also confirmed the stay in sentencing for Trump, which was requested by both Trump’s and Bragg’s attorneys. The sentencing was scheduled for Nov. 26, but on Friday, Merchan said that date “is adjourned.”

Trump spokesman and incoming White House communications director Steven Cheung reacted to Merchan’s ruling on Friday, telling Fox News Digital it is a “decisive win” for the president.

“In a decisive win for President Trump, the hoax Manhattan Case is now fully stayed and sentencing is adjourned,” Cheung told Fox News Digital. “President Trump won a landslide victory as the American People have issued a mandate to return him to office and dispose of all remnants of the Witch Hunt cases.”

Cheung added, “All of the sham lawfare attacks against President Trump are now destroyed and we are focused on Making America Great Again.”

In a letter to Merchan on Wednesday, Trump defense attorney and now-nominee for Deputy Attorney General Todd Blanche demanded the case against Trump be tossed.

“On November 5, 2024, the Nation’s People issued a mandate that supersedes the political motivations of DANY’s ‘People,'” Blanche wrote. “This case must be immediately dismissed.”

So Trump will never have been technically convicted of a felony as he was never sentenced. And the phony conviction will be tossed. That is a clean record. It was intended to hurt him politically, but it back fired on the left.

You are correct. A jury verdict is not a judgment of conviction. Only the judge can sign the judgment and cause it to be filed by the clerk of court.

It’s funny, people kept calling him a “convicted” felon. It’s funny that words have actual meanings. A jury voted that he was guilty of charges as bs as they may or may not be but he is NOT convicted until a judge enters a conviction into the record at sentencing. So, he got to vote, has his firearms rights, etc.. etc.. another word has meaning, woman but, a lot of people just can’t seem to speak fact anymore.

I guess we can’t call him a “returning citizen”, which is the politically correct term in DC for ex-convicts, because technically he hasn’t been convicted. Sure would love a Trump Hater explain how it is legal to file charges and hold a trial that was a misdemeanor and that the statute of Lin has expired, and he has no jurisdiction over. If you want to drag every person who settled and signed a non disclosure with a litigant, then you’re going to need a bigger courthouse. We’re looking at you Bill Clinton, Matt Lawler, Representative John Conyers, and others.

Remember, the corrupt New Yawk governor reassured the state’s business community that other business owners had nothing to worry about because this lawfare was only aimed at Trump. This tortured application of this misdemeanor statute as felonies would not be applied to them.

Merchan is trying to save his ass at this point. This is going to have a big effect on his career going forward. The demons would love to have this guy on the Supreme Court. And Trying to fill your resume with law fare against a president could also get you disbarred or even some jail time. I’m hoping for disbarment.

Generally, disbarment results from attorney misconduct while practicing law. Bar associations do not litigate the conduct of judges performing judicial functions, no matter how egregious their conduct on the bench is. Most states have a judicial council that performs that function.

In most states, judges are no longer members of the Bar Association. They resign from it when they are appointed or elected to the bench.

I would say if the case were actually anything other than naked lawfare against political enemies than continue to press. But it has been laid bare.

It won’t matter whether the dismissal, if granted, is with prejudice. I don’t think Trump can be reindicted because of double jeopardy. It attached as soon as the first juror was sworn in at the trial.
