Guillermo Aillon, convicted murderer booted from veterans’ cemetery

On of our ninjas sent us a link from the New Haven Register which tells the tale of how Kevin Dacey saw a wrong and sought to correct it when he discovered that Guillermo Aillon, a convicted murderer, was buried in a local veterans’ cemetery.

Dacey took an interest in the case because he grew up in the same North Haven neighborhood as Donald Montano, the brother of victim George Montano. Aillon was convicted of murdering his estranged wife, Barbara, and her parents, George and Bernice Montano.

While doing research on the Veterans Affairs website, Dacey said he discovered this federal law: “Internment or memorialization in a VA national cemetery or in Arlington National Cemetery is prohibited if a person is convicted of a federal or state capital crime, for which a sentence of imprisonment for life or the death penalty may be imposed and the conviction is final.”

Dacey contacted his State Senator and the media, and the VA admitted that they “dropped the ball”. the headstone has been removed they say and they’re making arrangements to move Guillermo to more suitable accommodations.

“We rely on people to be forthcoming with information like this and to be truthful to us,” Connolly added. “Ultimately, however, this is a mistake that we are working quickly to rectify.”

Connolly concluded: “Further, we are reviewing and updating existing procedures to ensure that this type of situation does not occur in the future.”

The VA doesn’t check for convictions. It’s their job to check. They messed up.

One would think the VA is capable of finding out things like this on its own. Maybe a VA employee felt a pang of sympathy for the deceased killer.

Dunno, street. Is it feasible for the VA do do a criminal history check on every burial?

Doing it to verify service is feasible; verifying that only requires checking one place (NPRC). Is the same true about all state murder convictions, or would that take 50 different checks?

I believe it would take 51 checks; the District of Columbia would be that 51st one.

So yeah; they just take people at their word. It’s very understandable when we consider that the greatest majority of Veterans didn’t meet their end in Old Sparky.

As for this killer…yeah, I’d say a landfill sounds about right.

More than that if you include inhabited US territories (e.g., Northern Marianas, Puerto Rico, American Samoa, Guam, US Virgin Islands) as well as Federal crimes.

Checking one place seems reasonable, so I cut the VA no slack on verifying claimed military service. But requiring 50+ checks might not be feasible – particularly when someone’s waiting for the OK to bury a relative.

A quick Google of his name turned up his conviction of three murders and his failed appeal from 1975. If I can do it they should be able to as well.

There are commercial services that pull all that data together in one place. I’m sure the VA could get a deal on subscriptions to such services – then they could have a single place to search, have it ping NPRC, national criminal databases, wherever else they’d want, and get an answer in seconds.

As someone who makes their living conducting background checks as part of suitability investigations it can be incredibly difficult to identify and receive a complete criminal history from even just one state.

The VA could just ask the question on their form. I asked my friend who just lost his father a few months ago if he remembers anything on the form and he said they didn’t fill out anything. They just handed over an honorable discharge form. That was it.

This killers name was not John Smith. A 5 second google search would have revealed murder convictions. Even though he died in a hospital he was in state custody, wasn’t he? The funeral home didn’t ask why he was in prison at 74 years old?

It’s not the funeral home that should be checking. The VA should be putting things in place so that this doesn’t happen. This guy was a convict but what in the hell did his family do? Hope my family doesn’t wind up paying for all my mess ups!

update: While that bungle happened at Arlington this did not! I will say that the Aillon family says it’s inhumane to move the body (3 time butcher) out of that cemetery! Others don’t feel the same way!

The federal VA form to obtain a marker contains this line: CERTIFICATION: By signing below I certify the headstone or marker will be installed in the cemetery listed in block 21 at no expense to the Government and all information entered on this form is true and correct to the best of my knowledge. I also certify, to the best of my knowledge, that the decedent has never committed a serious crime, such as murder or other offense that could have resulted in imprisonment for life, has never been convicted of a serious crime, and has never been convicted of a sexual offense for which he or she was sentenced to a minimum of life imprisonment. PENALTY: The law provides severe penalties, which include fine or imprisonment, or both, for the willful submission of any statement or evidence of a material fact, knowing it to be false or for the fraudulent acceptance of any benefit to which you are not entitled.” The guy from CT VA told me the family doesn’t fill it out for their cemetery, the VA does. This line needs to be added to all state forms for burial.

UPDATE: As of today this convicted triple murderer is still in CT Vet’s Cemetery in Middletown CT.
