Biden to impose background checks

Well,  as of this writing mid-Tuesday, so far he is talking glittering generalities – but PINO Joe is trotting out the Democrat’s favorite weapon on the armed populace, the Executive Order and to impose red flag laws and universal background checks with a wave of his pen.

It aims to move the US “as close to universal background checks as possible without additional legislation”.

Mr Biden will direct the US attorney general to clarify the statutory definition of who is “engaged in the business” of dealing in firearms, to devise a plan that prevents firearms dealers whose licenses were revoked from continuing to sell, and to name and shame firearms dealers who are breaking the law.

So he is trying to make what is already illegal – illegal. Great catch, Mr. President. The kicker in this one is the defining who is engaged in the business of selling firearms – any bets on that one? Selling more than one gun in a month, maybe? Since he can’t swing universl background checks the legislative way, is to do an end-run around Congress and just redefine what a dealer is (in Newspeak, I guess.)

Kris Brown, president of the gun control non-profit Brady, wrote on Twitter: “While we still need urgent legislative action from Congress, [the president’s] announcement today gets us closer to universal background checks than any other President that has come before.”

The president’s directive includes a call for raising public awareness over safe firearm storage and over “red flag” laws, also known as extreme risk protection orders. Signed in 19 states and the District of Columbia, these laws allow individuals to petition a court to temporarily confiscate guns from people with potentially violent or harmful behaviour.

Last month, the Justice Department sent out more than $200m to help states administer their red flag laws.

Reaction to the executive order was largely positive on Tuesday. The Everytown gun control coalition wrote it “would improve community safety, hold the gun industry and rogue gun dealers in our communities accountable, and save lives”, while the Moms Demand Action grassroots group added that it will “double down on the progress made” in last year’s bill.

“Hold the gun industry accountable -” – allowing a company to be sued for the criminal misuse of their product. Bet the liquor and car industries are a bit nervous about that – that’s called “precedent” and opens them up to every shyster wanting to find deep pockets after  DWI wreck.

And yeah, you know the gun-banners like this – who do you think is going to get that $200 million to play with?

Well, that should keep Gang Bangers & Drug Dealers from getting a gun…
I mean when you’re buying a stolen guns out of Pookey & Ray-Ray’s trunk, those 2 will insist on doing a background check, and a cooling off period. I hear Pookey is real stickler for red-flag laws too.
Just more window dressing that WON”T address the crisis of mental health and drug addiction because the real issue is they want the citizens unarmed and unable to resist government control.

Don’t forget that Biden ran heavily on the Cali drought and wild fires. He kept calling Trump an arsonist. The talk was that Cali would no longer be able to grow food and we all starve. After 700 inches of snow (yes that is correct, 58 feet of snow) and 100 inches of rain this year the drought is almost over.

Really? IIRC, the Medieval Warm Period was 3 degrees warmer then current temperatures, and it was a time of unprecedented population growth and expansion. (and there was NO industry to create pollution)

The refutation I’ve heard to that argument is about how Europe was deforested for building and cooking materials, which caused the warming period. On first blush there is merit to that thought. The second blush is embarrassment over that thought.

I’m no Constitutional Lawyer, nor do I play one on TV, but I have read (with comprehension) the Constitution of the United States of America, and the President has no authority to make laws.
Tyrants constantly seek to oppress, and they need repulsed by any and all means necessary – preferably peaceful but violent when all else fails.

Sue the gun manufacturer if someone uses it to commit a crime? This is going to set a dangerous precedent. What if someone steals a car and runs someone over, this allows the car manufacturer to be sued. What if someone uses a baseball bat or knife to kill? Well, now you can sue the manufacturer to get a quick payday.

I can’t see how this will be misused…

These things that you say will happen, have already happened.

Kia and Hyundai are being sued for their cars being stolen and the kids killing people with those cars. Publix was sued for legally selling a knife used in a murder. Bars get sued for selling drinks to drunks and car makers are among the most sued industry on the planet. Drug companies were/are sued for selling misused drugs all the time. Railroads get sued for people committing suicide by jumping in front of their trains.

The reason the firearms industry was protected was because the government needs guns for the military and law enforcement. The size of the entire firearms industry is tiny (close to the same size as the market cap of Publix) and lawsuits would quickly destroy it.

We don’t need more lawsuits what we need is a serious reform to product liability laws. But since lawyers write the laws that isn’t going to happen. Instead we will continue to eat our young until there isn’t anyone left to sue.

Lawers love product liability lawsuits cuz they are strict liability. You only need to prove the product is defective and the defect caused the harm. No need to prove negligence.
