This, despite all outward appearances, is not a cop. It’s Jeremy Dewitte.

Chronic police poser Jeremy Dewitte’s (who we last touched base with last week) appearance on Dr Phil is now ready to be streamed, in small chunks. ChipNASA sends in the links. Unfortunately, it’s in 12 parts instead of one or two, but our tech budget around here consists of a packet of saltines and a nose hair trimmer with a dead battery. We work with what we have.

Finally, the lie detector results! Dr. Phil tried to talk the man out of it, but he insisted. The only surprise in the result is that he doesn’t even believe his own lies.

It’s really unethical for his lawer to not only allow him to go on national television to parade his crimes but to sit next to him while doing so. My ninjas have told me that the raw video from the show has been subpoenaed. You could play the intro test Dr. Phil conducted as part of your opening arguments.

As a side note, it’s not unethical for a lawyer to allow someone to screw himself in public. The lawyer’s duty is to advise his client, but the lawyer can’t PREVENT his client from doing anything.

Assuming this lawyer isn’t a complete dumbass, he likely covered his ass by recommending that his client not go on the show, and did it in writing. That way if DeWitte DOES try to file a complaint against him with the state bar, he can pull out that letter as his “get out of jail free” card and say “I warned the idiot, but he didn’t listen to me.”

So my question for the group is this: When you see the video of DeWitte in front of his “funeral escort” company, I see a large building and a LOT of vehicles. Like 20 – 30 vehicles, motorcycles, etc.

That stuff isn’t cheap. Each one of those vehicles, equipped as they are, are likely over $50k. Even the motorcycles are likely $20k or more (I’ve owned a BMW bike. “Cheap” they AREN’T.)

So where is all the money coming from to support this company?

Yes, I get it, it’s Florida where people go to die, but holy crap, is there that much “funeral escort” business that it can support a big organization like this?

And who pays for this, does the funeral home pay for it and charge it to the family of the deceased as part of the “funeral package?”

It can be part of the funeral costs or families can contract Metro State out themselves.

As for the vehicles, it appears he is getting them at police auctions.

But Metro State has provided other “escort” and “security” services and that is part of the case against DeWitte and the company. He was even hired to appear with the WWE in a storyline where a wrestler was injured and needed to be removed from the arena via an ambulance.

The real question that has to be answered is why are Osceola and Orange counties spending this much time and resources on DeWitte and his company?

There is enough evidence from Dewitte himself to simply go to the State licensing board and have his business license pulled.

Dewitte is obviously a sick person that needs professional help.

The whole Dr. Phil show was a disaster for Dewitte (because of the polygraph) and arguably for Dr. Phil. No difficult questions were asked and basically nothing to do with the case(s) was discussed.

“James,” who is known as “Blue Bacon” online has said that he signed agreements that limited what he could talk about on the show.

Dewitte went on there to apparently try and counter the videos being released under Florida’s Sunshine Law (FS 119) by sites like Blue Bacon and Real World Police.

Dewitte himself has started to release videos attacking anyone who says anything about him while trying to portray himself as reincarnated Jesus Christ who is being wrongly persecuted and prosecuted.

The Dr. Phil show was more about narratives rather than the truth or bringing information to light.

Then again, that is what “reality” television is these days – all fluff and no meat.

There is no such bar regulation. In a lawyer-client relationship, the client is the boss, not the lawyer. The lawyer can’t “make” his client do anything, nor can he prevent his client from doing anything.

The only thing the lawyer can do is advise the client of the possible bad outcomes of what the client wants to do, but it’s ultimately the client’s choice, not the lawyers.

If the lawyer truly believes that the client is going to do something terribly stupid, the lawyer can, of course, refuse to go along with it and can even terminate the lawyer-client relationship.

EXCEPT – that once a lawyer has “entered an appearance” on behalf of a client, that lawyer is usually prohibited from withdrawing without the permission of the court.

COULD the lawyer have refused to go onto the show with his client? Certainly he could have, he’s under no obligation to go along with his client’s idiotic and vain shenanigans.

ut then again, if he knows his client is going on national TV, it could be argued that he does have a duty to try his best to mitigate the damage such an appearance would cause.

I suspect the convo between lawyer and client went something like this:

Lawyer: Jeremy, I would strongly advise you to NOT go on this show because anything you say there can and will be used against you in any future proceedings. My strong advice is to STFU until this case is over.

DeWitte: Well, I’m going, will you go with me?

Lawyer: Sure, as long as you cover the expenses and understand that I’m “on the clock” [cuz lawyer’s got to eat too, right?]

Since I’m a law geek I decided to look up the statute in question. No doubt there are various traffic citations, failure to appear, etc, but I was mostly interested in the “criminal impersonation” statutes in FL. Looks like the relevant statutes are 843.08 (false personation) and “Unlawful use of badges or other indicia of authority”, 843.085 843.08 is a felony while 843.085 is a 1st degree misdemeanor. Unfortunately, 843.08 is very narrowly written. You can look it up but as near as I can tell in order to be convicted of 843.08 a person has to actually impersonate an officer from a SPECIFIC agency. Furthermore, in order for a conviction under 843.08, the person has to not only impersonate an officer of a specific agency, they ALSO have to act as a member of that agency by commanding another person to aid or assist them in some manner. Since DeWitte is only representing himself as a part of “Metro State” and not a specific agency, that provides “wiggle room” for him to say he’s not guilty of violating 843.08 (even though by “clearing traffic” or demanding that people yield to his lights, he is obviously violating the 2nd part of the statute, a conviction requires BOTH that he impersonated a member of a specific agency AND that he acted as a member of such agency. I’m guessing this gap in the law is why DeWitte has been able to get away with his dangerous and stupid behavior for this long, because he’s skirting around the edge of the law. If the Florida legislature wants to have teeth in this law, they need to expand the definition of “criminal personation” to include someone who dresses and acts in such a way as to lead a ‘reasonable person’ to conclude that the person so acting is a certified law enforcement officer. That would prevent people like DeWitte from saying “hey, I didn’t SAY I was a cop, I just dressed in a cop-like uniform and acted like a cop and if someone thought I was a cop, that’s on them, not… Read more »

Jeremy HAS, in the past identified himself as a member of an agency. You don’t have to dress in an identifiable uniform. He has badged people and stated he was an officer/deputy of an agency and demanded they do something he tells them to do. All the victim has to articulate is that they BELIEVED, AT THE TIME OF THE INCIDENT, that they were being commanded to do an act by a duly appointed officer of the law.

I just read the Jeremy Dewitte website chronicling all this clown’s asshattery. It is quite a tale. The stolen valor really is just the cherry on top of the shit sundae. Florida is seeking an enhancement of sentence for JD being a habitual offender. He has been getting away with pretending to be a cop for over 20 years, along with multiple other offenses. He has already served over three years in the state pen, and this time he could get over ten years, even with some sort of plea deal. But Dr. Phil was correct when he said the pending charges against him, with enhancements, add up to over 85 years in the slammer.
