It seems that Shane Ladner’s lawyer was unable to to get records of his hospital stay in Panama, or those secret records being stored at Fort Benning of his daring deeds somewhere south of Texas. But we said that already. The Cherokee County Sheriff’s Office says that they’ve arrested Ladner;

The investigation revealed that Ladner was NOT a Purple Heart recipient as he has claimed for several years. He is charged with 4 counts of Theft by Deception, 1 count of False Swearing and 1 count of False Statement to a Police Officer. The Theft by Deception charges are from Ladner receiving a free Purple Heart License plate in 2009, 2010, 2011 and in 2012. When he originally applied for the license plate in 2009 he was required to swear that he was a Purple Heart recipient, hence the False Swearing charge. The False Statement charge is from lying to detectives during an interview.

The United States Army has no record of the 2004 DD214 that Ladner presented to obtain his Purple Heart Georgia License plate.

Now, if Ladner’s lawyer needs me to take a week or so at his expense to go to Panama and check around the hospital for him looking for his records, well, you know I’ll make that sacrifice. I mean as long as they want to pretend there are records down there, I’ll pretend I’m looking for them.

Joe Williams: that might be true in general. But many judges really don’t like dirty cops.

Frankly, I hope Ladner gets a judge that’s a vet – and a PH recipient. That would be Karma indeed.

Hondo, IMO, this will go to pre-trial diversion after he gives a guilty plea. He’ll be ordered to pay restitution and get a few years probation.

The guilty plea will be the kick in the nuts. No more guns for him. No more police…anywhere. Kind of like a BCD. It follows you around for life.

You and others could well be right about him escaping without doing time. I still think it’s a fair bet the judge decides to make an example and gives him at least a short, token amount of time behind bars. I won’t be shocked unless he either (1) gets off with essentially nothing, or (2) the judge throws the book at him and gives him serious time.

We are confident in our ability to defend Shane against these charges and plan to do so. All along, our investigation has shown that, in fact, Shane did receive a Purple Heart for injuries received in service to his country. When all of the information finally comes to light, plenty of people will owe Shane an apology.”

Do you realize by your doing this his poor wife’s case is diminishing because the rail road is also seeing this news. If by “investigation” you mean looking at a DD-214 that’s got so many holes in it you could drive a Mack truck through, then yeah, I suppose so. But as we’ve seen far too many times, that shit can be faked. He’s changed his story more often than he’s changed his underwear.

I know your client is entitled to a “vigorous defense”, Mr. Cook, but at the same time you as his legal counsel needs to take him aside and tell him that he needs to take his lumps. Throwing bullshit on top of his lies isn’t helping the man or his wife.

And how about the “traffic stop on the side of the road” business? I guess the fast lane would have been better. Or don’t the police in Texas let a wanted person pick the place of arrest like police do everywhere else in the country?

2/17 Air Cav: sadly, such conduct by other members of your profession is all too common. It’s a big reason why much of the rest of society has lost respect for the legal profession.

Every client indeed deserves a vigorous defense. But there are certain lines that common sense says you just don’t cross.

Transparent, obvious, and public bald-faced lying like this IMO crosses one of those lines. Ditto playing for public sympathy by bringing in an injured spouse.

@61, 62 – We all believe it’s fairly evident Ladner doesn’t have a PH, but I speculate the reason Mr. Cook is sticking to the story and supporting his client is because he is getting paid, and probably rather well. Folks are probably betting Union Pacific has deep pockets and will pay out, but I haven’t been able to find anything that shows the train operator was at fault as a result of the investigation in Midlothian.

Problem is, Master Sergeant, you’re not allowed to lie for your client. Notice he’s playing semantics when he says “we believe” and “our investigation has shown” knowing full well if he came out and said, “He’s got one” he’d be on the hook if in fact it came out (as it has already) that he’s lying.

Then again, you pay me $250-300 an hour and I guess I’d play word games too until the retainer ran out. That’s what I see happening. 20-30 billable hours, and “What? You’re broke? Aw, gee, sorry man. Can’t represent ya no ‘mo.”

@67. You got it, Sparky. There’s another trick that’s used in court which telegraphs that a defendant is lying AND his attorney knows it. It’s a free-style narrative in which the attorney asks no questions that would elicit untruthful testimony from the client. Essentially, the atty says, “Mr. So and So, would you please tell the court what you know about this matter”–or some such open wording.

@65 even it they are not at fault they and their attorneys will take a look at the case and decide what’s cheaper, trusting your payout to a sympathetic group of people too stupid to avoid jury duty or settling for a known amount…..

Lots of innocent companies payout instead of going to trial and figure that as a cost of doing business.

I’m thinking the attorney is tied in on the “settlement money”/lawsuit that Ladner is a part of. I also think the attorney is shaking his head at the loss of $s by Ladner’s lies.

Follow-Up to Cmt 69. That’s why very few defendants take the stand. Of course, no one is supposed to admit that. The system puts the onus on the state to prove the case beyond a reasonable doubt. Thus, a defense atty can (and damn well should) go tooth and nail against the state’s evidence, which includes witness testimony. Who wants a defense atty who says, “I firmly believe my client to be guilty as sin and, thus, we will not cross examine the witnesses against him or beef about procedural errors in his arrest and prosecution?”

74. Here in Texas, we do have a majority of lawyers that are fair, honest and truthful and will fight for their clients with ethics.

Shane’s lawyer…isn’t one of them. And that disgusts me.

I’m betting the UPR is more than watching this case, their own investigators(UPRP) more than likely are all over him like a rat on a cheeto. Historic fact: When the FBI was launched in 1907, J Edgar Hoover used the Union Pacific Railroads police service as the model for FBI. Ladner is double phucked, so to speak.

I suppose it’s too much to hope that Ladner’s attorney is working on a contingency fee basis (or maybe contingency fee plus fixed retainer). For his wife’s sake, I hope that’s the case. But I’m guessing Ladner probably didn’t negotiate that.

I’m betting the farm that the “lawer” in this case is only dealing with and defending Ladner’s DMV fraud ( which is what he is being charged with) in order to get to the juicy plum that is the suit against the railroad/organizers of the parade.
No matter what an ass-wipe her hubby is and the fraud he committed to get on that float, no jury is going to be unsympathetic to a person who lost a leg because a parade float got merked by a train.

@76…you got that right…..if his wife is listening to anyone she needs to exit stage left and find a new and much more ethical attorney! Her case will be damaged and she does have a case …..without him. There are some good Texas attorneys but not these guys!

What baffles me is the organizers of this parade seem to be in constant contact with the Ladner’s. Entertaining them, etc. so did the Ladner’s sue the organizers of the parade? If so, what’s that about. In what world do defendants entertain plaintiffs?

I’m not sure if the Parade organizers are going to get hit also (I think there was a question of proper permits, etc). I would guess that they just feel God-awful about what happened to Mrs Ladner and the others who were injured.
In my cynical mind i’m betting that the ambulance Chasers are weighing if its worth going after both the railroad and the organizers.
If the Parade had a municipality with deep pockets ( taxpayer money) behind it they may go gunning for them.
If it was a small charity, with not much money it would be more of a bad publicity move on the “lawer’s” part.
