Judge tosses sex-assault case against sergeant…

…blasts court-martial overseer as denying due process.

On the heels of cases of Undue Command Influence and Military Prosecutors playing fast and loose with the accused’s Civil Rights, Mason sends us a link to a case of due process violation. Tech. Sgt. Keith A. Snyder was accused of sexual assault, but the case was thrown out by the Judge, Col. W. Shane Cohen. The court-martial’s convening authority, Maj. Gen. Stephen N. Whiting, refused to order evidence from Snyder’s accusers requested by his defense attorneys. From the article by Rowan Scarborough:

A military judge has bucked a two-star general by throwing out a sexual assault case against a sergeant at Patrick Air Force Base, Florida.

Col. W. Shane Cohen, the judge, made a rare decision in the military criminal justice system by specifically citing the actions of Maj. Gen. Stephen N. Whiting, the court-martial’s convening authority, or overseer, as the reason he dismissed all charges against Tech. Sgt. Keith A. Snyder.

In a 13-page decision, Col. Cohen chastised Gen. Whiting for refusing to require the women who accused Sgt. Snyder of assault to turn over their social media communications and devices sought by defense attorneys. The prosecution issued subpoenas, but Gen. Whiting ordered lawyers not to enforce them.

“Once the GCMCA [Gen. Whiting] directed the trial counsel not to enforce their subpoenas, the government abdicated its obligations to the justice system,” Col. Cohen ruled in his Aug. 22 decision, a copy of which was obtained by The Washington Times.

    Very interesting, and timely too with all of the latest headlines. You really need to click on the linky to get more of this story, which I did.

    It wasn’t me and I wasn’t there in this case, so I don’t know what all of the facts are. That being said, as I have posted here in the past, I have been a victim of false accusations by women who were playing not only the victim card, but also a “let’s pool our fake cards and stack the deck” game. I do believe the women making accusations against Epstein and Billary; I did NOT believe the women/woman making accusations against Judge Kavanaugh.

    Here’s my take on this case. The TSGT lost his wife (a real cutie RIP) and after awhile got back into the dating thing to find a mate and possible mother to his children. These women saw him as a meal ticket, he finally figured out they were snake headed gold diggers and he beat feet. Hell hath NO fury like a woman scorned. They came after him, the Gnrl was doing the PC thing and the Colonel Judge slapped his wrist. As stated by one of the defense attorneys, this case would have never made it on the civilian side due to lack of real evidence.

      The investigation after the fact actually proved that all three Kavanaugh accusers were bullshit. Another man admitted to being the one in the incident with Ford (no media on that one), the one from Yale was another guy who was a known flasher in the dorms, and the third was looney tunes talking about gang rape parties she attended 9 times, because yeah that’s what women do, voluntarily go to gang rape parties (though CNN gave her top billing more than once).

      I agree. I personally believe if someone pulls something like that and the accused gets jailed then the perpatraitor should be forced to serve the same amount of time that the accused did before they were realised with no chance of parole and a little extra time thrown in as well as paying restitution (this goes for the perpatraitor and the prosecutor). I fear one of these days the wrong person is going to be accused and it will not end well for the accuser especially with the way colleges are handling it (in that case, it might not end well for anyone on campus either) and it will be THAT DAY when this practice actually stops because people will see the potential consequences of what happens when someone has their life ruined and thus feel like they have nothing left to lose and when everyone asks why, all you have to do is point out what was done to them when they were falsely accused of sexual assualt and had everything stripped from them when they did nothing wrong.

      If the not-so-good general was confident in the prosecution’s case, he’d have no reason to do what he did, meaning he deliberately attempted to secure a false conviction against a man whose guilt wasn’t supported by the evidence.

      Remember the discussion of the old Code Duello and possible modern updates? Seems to me that in this case, Snyder should have the option of issuing a challenge to General ScrewTheRules. Let God and Saint John Moses Browning decide the outcome, or kiss his stars goodbye for trying to screw an innocent man over and then not having the balls to face him.

        When he found out that the charges were lies he had already become invested in the case before that point at which time he was attempting another case of CYA.

        And I totally agree the lying wench that brought the charges should be remanded to Ft Leavenworth under FEDERAL charges for lying to the courts.

      Perhaps you’de change your mind if you knew demoted Ssgt Keith Snyder is a convicted felon with jail time, prior sexual misconduct on his record and disciplinary action for violating multiple Military Protect Orders in order to stalk and harass his victims…

    Kudos to the JAG colonel. Fortunately for TSgt Snyder he got a JAG who didn’t see his star on the horizon and opted to do the right thing. Some PC EEO snowflake probably told the MG they should not traumatize these dear ladies and he was dumb enough to follow their advice. Hopefully he will not move up the ranks and they should retire him at his permanent as opposed to current grade as a lesson to all Commanders.

        Yes he can, cuz he is likely not a public figure. But this cray cray scrunt is unlikely to have much in the way of assets. Plus, plaintiff lawers who file defamation cases rarely take them on a contingent fee basis, unless they are only looking for publicity.

    Sorry to hear this hero had to be put through hell twice. First his wife dies, and then as he is trying to pick up the pieces this group of vindictive individuals sends him back.
    Hopefully, the military takes some action against the one still serving, and the civilian courts can have their day with the other two (unless they can bring the one back on active duty to send her to prison). Shame on them.
