Pentagon Funds Okayed for the Border Wall

The Border Wall Business is slowly coming to a conclusion of sorts.

The Supreme Court has said that Pres. Trump can use defense funding to complete it.

I will not say “That settles that,” because as we all know, the howling, weeping, wailing, and gnashing of teeth on the left side of the fence will continue, period. I am waiting for the more loud and ignorant remarks to be thrown into media outlets, including that egregious number about ‘It’s just like the Berlin Wall’, a quote for Rep Occasionally-Conscious-and-Truly-Ignorant of the real world and its history.

To yield one point of concession to the Others, if you cut the above apart and put it together while huffing paint, then yes, unrestrained illegal immigration makes sense.

Dennis (FDNY)& Author of report from Engine 82 sold the Magazine and it is now called Firehouse Expo which in 2016 pulled out of the harbor and now have their convention, seminars and exhibition hall in Nashville Tenn. So break out the popcorn and soda pop and watch the chapter play (serial) go on and on.

The ruling (order actually) does not say that Trump can build the wall.

The order lifts the injunction of a lower Federal Court which was upheld by the Ninth Circuit. The injunction prevented the work / design / issuance of contracts going forward while the case as to whether the President (any President) could use funds from one budgeted area in an “declared emergency” for another purpose was being heard.

The case to decide that question is still pending and going forward into the Ninth Circuit.

The Supreme Court order states that the stay from will automatically be terminated pending the outcome of the appeal in the Ninth Circuit, the granting of cert in the Supreme Court, and the Court’s final decision on the case.

In other words, this is not a declaration or final decision that the wall can be built, but rather an order saying the work on the wall can proceed while the case to decide whether the wall can be built is actually decided.

Forgot to mention that the injunction against the wall was initially issued, in part, because of environmental groups claims that it would do “irreparable harm” to the environment.

The case is a two pronged “attack” on the wall. The first is funding and the second is the environment.

You are correct.
However, the work may proceed.
Once the wall or portions of it are actually built, it is going to be difficult if not impossible to tear it down.
Especially if the Repubs win the house in the meantime and can actually fund the wall construction

Breyer’s partial dissent mentions the problem with taking down the wall if the government loses the case:

“If we grant the stay, the Government may begin construction of a border barrier that would cause irreparable harm to the environment and to respondents, according to both respondents and the District Court. The Government’s only response to this claim of irreparable harm is that, if respondents ultimately prevail, the border barrier may be taken down (with what funding, the Government does not say). But this is little comfort because it is not just the barrier, but the construction itself (and presumably its later destruction) that contributes to respondents’ injury.”

The government (the administration) is representing that if they lose the case on the wall based on “irreparable harm to the environment,” they will take it down and indeed would probably be forced to take it down.

Legal definition “irreparable harm:”

“Irreparable harm is a legal concept whch argues that the type of harm threatened cannot be corrected through monetary compensation or conditions cannot be put back the way they were. Examples of such irreparable harm may arise in cutting down shade trees, polluting a stream, not giving a child needed medication, not supporting an excavation which may cause collapse of a building, tearing down a structure, among other actions or omissions.

Irreparable harm is often required to be shown to claim that a judge should order an injunction, writ, temporary restraining order or other equitable judicial action. The party seeking such relief will argue that the judicial action is required to prevent an imminent injury for which there is no other way to prevent the threatened harm.

The standard for showing irreparable has been explained by the D.C. Circuit as follows:

“First, the injury must be both certain and great; it must be actual and not theoretical. Injunctive relief ‘will not be granted against something merely feared as liable to occur at some indefinite time.’ It is also well settled that economic loss does not, in and of itself, constitute irreparable harm. . . . Implicit in each of these principles is the further requirement that the movant substantiate the claim that irreparable injury is ‘likely’ to occur. The movant must provide proof that the harm has occurred in the past and is likely to occur again, or proof indicating that the harm is certain to occur in the near future.””

In this case, the argument is that the wall would interrupt migratory patterns and breeding areas of a number of species. It is not an argument on “climate change.”
