The Woodbury county attorney has ruled that a Sioux City man who fatally shot another man who had forcefully entered his home on April 9th shot the man in self defense.

The ruling states the occupant of the home, 29-year-old Travis Gutierrez, justifiably used deadly force when he shot 19-year-old Jose Montanez.

Police say Montanez broke windows to gain entry to the home, and began damaging the inside of the house.

Gutierrez confronted Montanez and asked him to leave.
Montanez refused to leave and assaulted Gutierrez, who managed to get his gun and then shoot Montanez.

Man shot by homeowner after attempted break-in appears in court

by: Courtney Allen
ALBUQUERQUE, N.M. (KRQE) – A man who police said tried breaking into a home in the Albuquerque Heights before getting shot by the homeowner appeared in court Sunday morning.

Isaac Andujo is charged with felony residential burglary following the incident Friday. Police said neighbors heard screaming and three gunshots ringing from the home off of Indian School and Tramway around 5:30 a.m. and then called the police.

According to the criminal complaint, Andujo broke through a window in the back of the house using a spray can. Police said while he continued to try to get into the home, the homeowner shot Andujo in the hip and continued pointing the gun at him until Albuquerque police got on scene.

Sunday, Andujo’s attorney argued that the prosecution failed to prove intent to commit a felony saying that Andujo was simply trying to get into the home to get a glass of water. The judge did not buy it.

Okay Delta Whiskies and Whiskettes, the tally today is an acceptable one mort, two in the body and fender shop, and none in the wind. Can’t really blame them for not running in the July heat.

In our inner cities, where firearms are outlawed, only outlaws are armed. When our “philosopher kings” sit back and do nothing, this is the tyranny and terror of “gun control.” —CHARLTON HESTON

“shot another man who had forcefully entered his home”

“man who police said tried breaking into a home in the Albuquerque Heights before getting shot”

“one of the residents shot the intruder”

That’s how you play “home invasion” and lose.
The house usually has the winning hand.
As it should be.

A full house usually beats a Joker or two.

I was just breaking the window to get a glass of water. Best excuse of the day!!!

Somebody ought to get that lawyers name and post it as I don’t think I’d want him to defend me in court. I did go check and yes there is still an outside water faucet outside my house and if you let it run a bit the hose taste goes away, maybe it is time to put a shelf with a glass on it for those picky water drinking types.

Man, that lawer just totally phoned it in. Score one for the prosecution on that one…
“Breaking in to a private residence to get a glass of water”?

“Andujo was simply trying to get into the home to get a glass of water.”

So Andujo was too dumb to turn on the outdoor faucet where the lawn sprinkler is usually attached?

Okay, sure.

Note for future reference:

The industry name for an outdoor faucet is Sill Cock.

Oh, wait, could Sill Cock be one of those words that is going to be banned in Berzerkley?/s

Oops, correction.

Sillcock, no space.

I need Mea nother Culpa coffee (H/T to Hondo)

If “cock” is banned in Berserkeley, however will anyone distinguish between hens and roosters? Geese and ganders? Peahens and peacocks? Mares, stallions and geldings?

Maybe the entire Berserkeley city council should be neutered and spayed. That might solve the problem.

Just an idea.

I’ll take a Gander on all this gender PC stuff Ex and if the word Gander is banned, the Gander ATC (air traffic control) station’s Goose is cooked.

Can you say “Hello REFORGER”?

And what about the dreaded seacock, that GD plug you BETTER remember to put back in your boat before launching!

So, don’t go off half cocked?

That isn’t a 509; it’s an FNX-45 Tactical.

The 509 doesn’t have a hammer.

Yes, it is an FNX-45 Tactical, and it Rocks!

I was too cheap to spend the extra $500 for a Tactical, so got the Standard.
And, I’m not unhappy with it.
