COUNTY ATTORNEY RULES HOME INVASION FATAL SHOOTING WAS JUSTIFIED

The Woodbury county attorney has ruled that a Sioux City man who fatally shot another man who had forcefully entered his home on April 9th shot the man in self defense.

The ruling states the occupant of the home, 29-year-old Travis Gutierrez, justifiably used deadly force when he shot 19-year-old Jose Montanez.

Police say Montanez broke windows to gain entry to the home, and began damaging the inside of the house.

Gutierrez confronted Montanez and asked him to leave.
Montanez refused to leave and assaulted Gutierrez, who managed to get his gun and then shoot Montanez.

Man shot by homeowner after attempted break-in appears in court

ALBUQUERQUE, N.M. (KRQE) – A man who police said tried breaking into a home in the Albuquerque Heights before getting shot by the homeowner appeared in court Sunday morning.

Isaac Andujo is charged with felony residential burglary following the incident Friday. Police said neighbors heard screaming and three gunshots ringing from the home off of Indian School and Tramway around 5:30 a.m. and then called the police.

According to the criminal complaint, Andujo broke through a window in the back of the house using a spray can. Police said while he continued to try to get into the home, the homeowner shot Andujo in the hip and continued pointing the gun at him until Albuquerque police got on scene.

Sunday, Andujo’s attorney argued that the prosecution failed to prove intent to commit a felony saying that Andujo was simply trying to get into the home to get a glass of water. The judge did not buy it.

Intruder shot during home invasion on Nick Davis Road

LIMESTONE COUNTY, Ala. – Police say a man was shot during a home invasion.

Officials say they were called to the 27000-block of Nick Davis Road around midnight Monday. According to officials, the residents were woken by an unknown man rummaging through their house.

Officials say that during a scuffle, one of the residents shot the intruder.

The man was taken to the hospital but their condition is unknown, according to police.

Somebody ought to get that lawyers name and post it as I don’t think I’d want him to defend me in court. I did go check and yes there is still an outside water faucet outside my house and if you let it run a bit the hose taste goes away, maybe it is time to put a shelf with a glass on it for those picky water drinking types.
