Jurors acquit shooter

COEUR d’ALENE — A 27-year-old Athol man who claimed he acted in self-defense when he shot another man multiple times at a Coeur d’Alene apartment complex was aquitted Wednesday by a jury.Jurors in the two-day trial in Coeur d’Alene’s First District Court deliberated 90 minutes before returning a not guilty verdict for Keven C. Custer, who was on trial for aggravated battery with a deadly weapon.
“The jury found Keven Custer not guilty because they determined that Keven had a reasonable fear of death or great bodily harm,” said Custer’s attorney, Joseph Sullivan, on Wednesday.
Custer was accused of shooting 46-year-old Chris Gunderson Oct. 4 with a 9 mm he carried in a hip holster while lying on the ground after being struck by Gunderson. The blow knocked out one of Custer’s teeth, and cracked two others.

Salem man acquitted in 2016 fatal shooting of a homeless man near Wallace Marine Park

A Salem man was found not guilty Thursday of manslaughter, weapons and criminally negligent homicide charges for shooting a homeless man near Wallace Marine Park in 2016.Attorneys for Christopher Gerberding, 34, argued he’d been defending himself the night he shot Manuel Zavala, 30, of Salem, claiming he’d been confronted, punched and escorted out of the park by a group of homeless people.
Prosecutors said Gerberding negligently killed Zavala and was too drunk at the time to assess how much of a threat he was.
Following a three-day bench trial, Polk County Judge Monte Campbell reviewed evidence, interviews and the defense’s and prosecutor’s arguments before delivering his verdict — acquitted on all charges.

Fort Knox sergeant charged in road rage case will not be indicted by a grand jury

ELIZABETHTOWN, KY (WAVE) – The Fort Knox sergeant who was charged in a road rage incident will not be indicted by a grand jury.Both sides of the case concerning Kai Waters, 33, were presented in a Hardin County courtroom Thursday.
Waters was charged in February after she said she stabbed another woman in the leg. The interaction was all caught on surveillance video from the gas station where the altercation took place.
“I’d have been surprised if she was indicted once the grand jury saw the video,” Waters’ attorney, Jeremy Aldridge, told WAVE 3 News on Thursday. “Once the grand jury (saw) everything, I felt pretty confident that they would come back with a no-true bill.”

Good news today, Delta Whiskies and Whiskettes, SGT Kai Waters, will not be indicted by a grand jury for her part in the road rage incident she became involved in. Today’s totals, while belated due to the legal process, are one down and not getting back up, and two receiving medical attention for their troubles.

Got us a wee nip in the air, low 40s. Will be off the net for awhile FIRST thing this morning. Gone take some of the boys and do some repair on the Red Barn. Then some BBQ with all the trimming, and maybe a cold beer or 6. c u later, tater.
Always astonishes me how people who happily accept the grievous bodily harm of gunshot wounds get their knickers twisted over a knife, as if a knife is dirty or unfair.
1/2/0 well end of week still a little light on the DRT but the loose column is getting better, 7/12/1, lots more range time is needed. 1. I’d kinda wonder about my girl friend if she is “friends” with such type folks, I’d be tempted to learn how to wash my own clothes. Oh well one off the streets for a while. 2. Drinking and wandering into homeless camp, kinda ranks up there with walking up on a still in the woods. Just what part of stupid don’t don’t they understand. Could have as easily been a cop in disguise infiltrating the camp. Oh well end result is one less one on parole and violent when using drugs and alcohol. 3. Sargent still hanging out in possible charges from Army. Good that she was cleared by court, bunch of the others relatives are breathing a sigh of relief as not having to haul casket yet, take a bunch, another off the street and able to figure out how to cope with society. 5th don’t seem like much money this week with all the 1/2/0’s, nope not going to even come close to the place there as have enough repairs to do here and also getting very adverse to physical labor. A tip tho, clear liquid in a mason jar versus beer makes for a shorter and less expensive BBQ as far as food consumption goes.

Sgt. 1st Class Kai Waters, 33, was charged in February with stabbing an unnamed 58-year-old woman who followed her to an Elizabethtown gas station and began punching her while Waters was still in her car. “It’s not really over for me,” Waters told the Post. “I’ve still got to work on fixing my records and my security clearance.” The chemical, biological, nuclear and radiological specialist has 15 years in the Army and recently reported to Human Resources Command to work in career management for her military occupational specialty, a spokeswoman told Army Times last week. Criminal charges can automatically suspend the security clearance required to handle sensitive information, as it did for Waters. Ahead of Thursday’s hearing, stemming from an incident in which the soldier used a knife to defend herself against the woman, Waters posted to Facebook April 6 her side of the story and the gas station security footage to back it up. “As you can see in the video I am kicking at her and screaming at her to leave me alone and go away,” she wrote. “She continues to lunge at me and attack me.” Hardin County Commonwealth’s Attorney Shane Young told the Post that no charges had been filed against the other woman. Hmmm, all well and good, but wondering if that means she gets to keep the 15K from the GoFundMe defense fund, and whether having civilian litigation pending puts her in a non-deployable status?
That civilian lawyer will still need to be paid. There may be something left over from the GoFundMe, probably enough to enjoy a good dinner and a tank of gas.
