Navy corpsman Devon Rideout ambushed

Stars & Stripes recounts the story of 24-year-old Navy corpsman Devon Rideout who was ambushed and shot to death last Friday in Oceanside, California by a former Marine, Eduardo Arriola, who was her neighbor.

Arriola went AWOL to Mexico during his time in the Marine Corps and was discharged as a result. The aircraft technician had never been deployed.

[Deputy District Attorney Keith] Watanabe said Tuesday that Arriola had deserted the military in 2016, fleeing to Mexico. In 2017, he returned to the United States, turned himself in and was arrested by the military, the prosecutor said.

He also said Arriola’s diagnosis of schizophrenia was made after his return from Mexico.

It was not immediately clear how he was able to purchase a gun legally in California in May. Watanabe said the gun dealer did not have access to military records.

He said it appeared that Arriola lied on the application, which asks if the buyer has been diagnosed with a mental illness. “We don’t believe he would have been allowed to purchase a firearm had those questions been answered truthfully,” the prosecutor said.

Oh, goodness, a crackpot was able to lie on his ATF Form 4473? Who knew that could happen? In California?

On the afternoon of the shooting, Rideout had just arrived home from work at the hospital at Camp Pendleton. Still wearing her uniform, she started to take her puppy for a walk when she was ambushed steps from her front door, Watanabe said.

The assailant emptied a .38-caliber Smith and Wesson five-shot revolver, shooting Rideout three times in the chest and twice in the head. As she struggled through her last breaths, the gunman prevented bystanders from helping her, the prosecutor said.

Arriola claimed that Rideout was trespassing.

This story is so fucked up on so many levels, and now we have lost another young person far too early.

What good are databases that don’t share database information? If you were discharged for being a bat shit crazy schizo perhaps someone could find a minute or two out of their busy day to get that information entered into a database that would actually help gun dealers deny lunatics from getting a firearm.

While I understand the concern over HIPAA violations and protecting patient rights to privacy for me Arriola’s right to privacy was shredded the minute that shit bag deserted, preventing that data from being shared seems criminal somehow….we’re not talking about having an STD or some foreign object lodged in your ass we’re talking about a paranoid schizophrenic a disease often marked by abnormal, dangerous acts of violence towards people minding their own business. If the background checks are to mean anything this sort of diagnosis needs to be a flag for rejecting a firearms purchase.

Schizos don’t get better, they can manage with meds but they never get better and sadly as with manic depressives once they start feeling normal they often decide to stop medicating themselves and slide back into their mania without being aware that’s what is happening.

If I was the FFL dealer in this case, I would file a lawsuit against the feds for failing their legal responsibility to red-flag the 4473 when it was submitted, resulting in this young woman’s death. Yeah, the crazy asshole might well have found some other means of killing her, but still.

One of the problems with the NICS system and related laws is that some states don’t even provide the NICS with the info on their wackos that qualify for the system. On top of that we have some of the military branches failing to notify the system of convicted of felonies or the equivalent thereof. Then the cherry on top of this shit sundae is the failure of LEO’s to investigate and prosecute people who lie on the 4473.

It’s probably because the service, instead of court martialing him like they should have and imprisoned him for the felony of desertion, just separated him and let him walk. I have seen so many people go AWOL and desert just to never be prosecuted.

Yep. I have a cousin who married a guy, and they both enlisted. When dad was stationed at Bragg, we had them over for dinner. Soon after, he deserted. She cried her way to a discharge. I don’t think he ever got court martialed for desertion. This was 23, 24 yrs ago

Knew this guy serving on a ship off the coast of Vietnam of the Nam (‘68 if I remember correctly). Ship was on the “firing line” when he reenlisted. Got his $10k tax free & lump sum after the deployment was over.

In San Diego went and bought himself a SuperBee fully loaded. Put down just enough money to be able to get the loan easily approved. Deserted a week later.

Roll forward 25 or so years. Finally apprehended and sent to closest Naval installation (Mayport, FL). Not there a month and gets a CM resulting in a DD.

Roll forward another decade or so, this guy is a cop. Years later I hear about it, look this guy up and now he’s a ranking police detective. I call the PD and try to rat this clown out – “How can your department have a dishonorably discharged douche on your force?”

The guy was there for a few decades. Retired from the job. His son was a drug dealer (my shocked face. 😯)!

Without having his records handy, I’ll go out on a limb and say he received a general or other than honorable discharge likely with characterization of “failure to complete initial time in service” or “Unsuitability”. None of which rise to the level of a felony or mental health discharge.

Hell courts martial are hard and medical means the military would be in the hook for his care…so the military tends to bounce people with generic/but not bad discharges instead.

If the diagnosis was made BEFORE he was discharged, it doesn’t count on the 4473. Section 11f answers that question.

And was his discharge OTH? That counts also, you know. There is no blanket blame for this.

If his discharge was OTH and he lied about that, and the schizo diagnosis was AFTER he was discharged and he lied about it, then fine, he lied and should be penalized, especially since he had the names of other people on the list on his vehicle’s radiator.

OTH doesn’t preclude you from owning a firearm. Bad Conduct and Dishonorable do, but OTH does not.

See line g of the 4473 “Discharged under dishonorable conditions means separation from the Armed Forces resulting from a dishonorable discharge or dismissal adjudged by a General Court-Martial. That term does not include any other discharge or separation from the Armed Forces”.

The wording is specific and limited to a dishonorable discharge or (for officers) dismissal from this Service.

IIRC, based on previous threads, even a BCD may not necessarily be a bar, provided the civilian jail equivalent is less than a year and not domestic violence related.

DD should be automatic in all cases.

It’s possible that he was administratively assigned to Bravo Company of the USMC’s Wounded Warrior Battalion – West located aboard Naval Medical Center San Diego if they threw him (involuntarily) into the Looney Bin there after he was returned to Marine Corps control in 2017. It’s also possible that he could have stayed there until he was discharged from the Marine Corps.

FYI, there is also a Wounded Warrior Battalion – West company (Alpha Company) located aboard Camp Pendleton, but the article says San Diego.

In different on-line news reports it states he was diagnosed after returning from Mexico. But didn’t receive his discharge until last year. Key facts are being left out. Someones covering their a$$. This death could have been prevented. The system failed, and this young lady died. 2 others were on his hit list.
