Ahmed Alaklouk; illegal immigrant with an AR-style rifle

22-year-old Ahmed Alaklouk, a Tunisian with Saudi Arabian citizenship is under arrest in Indiana. His student visa expired last September, but he’s still living in the US, in fact he owns a tire business. He also owned a half-dozen handguns and a “tricked out” Armalite-style rifle complete with scope and bump-stock.

According to the Indy Star the local cops started investigating him when hotel security saw him with his weapon collection near the local Women’s March in downtown Indianapolis. They discovered his expired visa at about the time he pulled his handguns on a couple of customers in his tire repair shop. So that got him arrested;

Alaklouk was charged in Marion Superior Court on Jan. 31 with two felony counts of criminal confinement, two felony counts of intimidation, one felony count of unlawful possession of a firearm and a battery misdemeanor.

The federal gun charge came Wednesday.

If convicted of the state charges, Alaklouk could face up to 16 years in state prison for each of two felony counts; up to six years each for two other counts; and up to 2 1/2 years for the fifth felony count.

If convicted of the federal gun crime, Alaklouk could face up to 10 years in federal prison.

Alaklouk claims that a customer gave him the rifle as a payment for work he did on the customer’s car. Non-US citizens aren’t allowed to possess firearms, but there you go.

Actually, in this case Yef had a valid point. It is not categorically true to say that “Non-US citizens aren’t allowed to own firearms”. SOME non-US citizens residing in the US can legally own firearms. Others cannot.

Those non-citizens in the US on an immigrant visa, or who have been granted permanent resident alien status, are permitted to own or possess firearms. Those here on nonimmigrant visas, or who are otherwise here illegally, are not.

I’m reasonably sure a student visa is a nonimmigrant visa (I’ve seen sources that directly refer to the F1 student visa as a “nonimmigrant” visa and other sources that indicate the M1 student visa is a “temporary” visa, implying but not stating outright that it is also a nonimmigrant visa). I’m definitely sure that persons who overstay their student visas are here illegally.

So while this guy was prohibited from owning firearms (he was here on a nonimmigrant visa and after its expiration was here illegally), Yef was correct in his assertion above.

actually its only Non immigrants ( non-green card holders that are forbidden from possessing firearms and ammunition. here it is if you look at subsect 5 Federal law (18 U.S.C. § 922[g][1-9]) prohibits certain individuals from possessing firearms, ammunition, or explosives. The penalty for violating this law is ten years imprisonment and/or a $250,000 fine. Further, 18 U.S.C. 3565(b)(2) (probation) and 3583(g)(2) (supervised release) makes it mandatory for the Court to revoke supervision for possession of a firearm. Specifically, 18 U.S.C. § 922(g)(1-9) prohibits the following from possessing, shipping/ transporting, or receiving any firearm or ammunition: (1) a person convicted of a crime punishable by imprisonment exceeding one year; (2) a person who is a fugitive from justice; (3) a person who is an unlawful user of or who is addicted to a controlled substance; (4) a person who has been adjudicated as a mental defective or who has been admitted to a mental institution; (5) an alien who is unlawfully in the United States or who has been admitted to the United States under a nonimmigrant visa; (6) a person who has been discharged from the Armed Forces under dishonorable conditions; (7) a person who, having been a citizen of the United States, renounces his citizenship; (8) a person subject to a court order that was issued after a hearing in which the person participated, which order restrains the person from harassing, stalking, or threatening an intimate partner or partner’s child, and which order includes a finding that the person is a credible threat to such partner or partner’s child, or by its terms prohibits the use, attempted use or threatened use of such force against such partner or partner’s child; (9) a person who has been convicted of a misdemeanor crime of domestic violence. Nope. An nonimmigrant alien admitted to the US under a nonimmigration visa, in this case a student visa, is prohibited except under a few circumstances such as hunting, law enforcement of a friendly nation etc

I would not get that worked up over it unless you have an atf agent with a stick up their ass hanging at your range. The exception “…admitted for lawful hunting or sporting purposes” would probably work for except if someone got all butthurt and pushed it although they are not admitted for, say, a target shooting competition

From a strict legality standpoint, I believe it would turn on the legal definition of “possess” in 18 U.S.C. § 922[g][1-9] (above).

I have allowed visiting non-citizens to shoot some of my firearms from time to time, myself, with me present.

I’m working on the same idea (which may be wrong) that while it is unlawful for me to “possess” (own) a fully-automatic firearm, since I do not have the right legal paperwork, I am allowed to shoot one which is legally owned by another individual, at their range or on their property.

My visitors did not “possess” (own) the firearm – even when they held it, but were shooting it on my property and on my range.

I am not a lawyer, nor do I play one on YouTube, but I suspect that by any common-sense understanding of the law you and I are not in a great deal of danger from any but a really rogue or anally-retentive LEO.

Folks from all over the world shoot it, presumably on tourist visas, and many of them importing arms to do so. Others borrow guns to compete.

Used to be that a DA would charge a suspect with every count that was winnable in court then plea bargained down.
The exception is typically multiple murder on questionable grounds/lacking evidence/witnesses where if one murder charge doesn’t stick the prosecution proceeds with the next victim.
Or, the first murder lands the suspect in prison for “natural life” without possibility of parole or death sentence.
What I see as an independent amateur Alchemist and expert on 12th Century Psychology publishing and a resident (legal) of The Democratik People’s Republik Of North Kalifornistaniraqkorea:
2 felony counts of “criminal confinement”
2 felony counts of “intimidation”
7+ felony counts of “unlawful possession of a firearm”
1 misdemeanor count of battery
1 or more counts of “brandishing” a firearm or weapon (unless that’s what the “intimidation” counts are)
1 count of unlawfully remaining in the US (whatever statute that is)
Maybe owning or operating a business without a license unless the law doesn’t cover illegal immigrants that own/operate a business after their visa/permit expires.
I don’t know Indiana law or if they are tough on crime.
And that would be great if the sentences ran consecutively.

It’s not hard to build one from home since conservatives want people to do it. The conservatives wrote all those manuals on how to buy your receiver for the AR15 build. I was hearing it on a conservative talk show by Bryan Suits. Ironically, a month after he was telling his audience about how to build an AR15 from home, a guy built one and went a shooting rampage at a school. Then all the sudden he got quiet about building AR15s from home.
