SEAL and Ranger claim wounds suffered in search for Bergdahl

The Navy Times reports on an article from Task & Purpose wherein a Navy SEAL and an Army Ranger claim that they were wounded in the search for Bowe Bergdahl in the days immediately following his disappearance;

Prosecutors are hoping to use their testimonies to convince a jury that Bergdahl both deserted his post and, more importantly, committed misbehavior that endangered his comrades.

In July 2009, Army National Guard Sgt. 1st Class Mark Allen was shot in the head while searching for Bergdahl in the Paktika province. The next day, Navy Senior Chief Petty Officer Jimmy Hatch was shot in the leg on a different search mission. Both men claim they were forced to retire because of the injuries, reports Task and Purpose.

The judge in the Bergdahl case has ruled that these claims won’t be used during the conviction phase since Bergdahl hasn’t been charged with causing injuries to the folks looking for him.

“All of the injuries occurred on missions that would not have happened were it not for the manufactured and unnecessary crisis,” wrote lead prosecutor Army Maj. Justin C. Oshana…

Yeah, well, when the entire national strategy is disrupted by one butthurt snowflake deserter, there needs to be some accountability for that poor behavior.

I don’t follow the case very closely but I know some of the delay was litigation over classified information. (My guess, which is only a guess, is that this has to do with U.S. intel on what Bergdahl was up to during his captivity.) That stuff can slow a case down massively.

I’m sure they “could” but then they’d have an issue with how sensitive the information is in regards to the missions they were running to do searches. Especially in a civilian court. I’m guessing there’d be JAGs in that court room saying, “you can’t talk about that” 100 times a day and after each question due to OPSEC and classifications.

And his defense attorneys would want as much information about the missions as possible released, because they know that would “help” since any mission would have some info that can’t be released, which they’d argue is prejudicial to their client, blah blah blah.

Not saying he’d win, but his attorneys would have a field day with that kind of thing.

I’d also add that I’m surprised that DoD hasn’t sued Manning for every dime they can get because of the insane amount of money he’s cost us due to strategy adjustments and policy changes, TTP adjustments, communication costs, new security requirements, and so on. Depending on who you read on that issue, he’s cost us anywhere between 1 and 50 billion just because of his massive release.
