Brent Henry, phony wounded Marine sentenced
We talked a bit about Brent Henry a couple of times in the last year or so. He scammed “Wags for Warriors of Virginia” out of some money pretending to be a wounded Marine of the latest wars. Of course, he had never deployed and he’d been dishonorably discharged. Pat sends us a link from the Virginian-Pilot which reports he was sentenced to eight months in jail yesterday in Virginia Beach;
Brent Joseph Henry also was ordered to pay $2,878 in restitution, which is part of what he received in services and donations from Wags for Warriors of Virginia, based in the Beach. Henry pleaded guilty in September to obtaining money by false pretenses, according to online court records.

The charity arranged to train a dog that Henry owned to be a service animal, spending $2,420 on it, according to a stipulation of facts entered in the case. It also paid $458 for veterinary services, the stipulation said.
Henry told a member of the charity that he deployed to Iraq seven or eight times, was injured in a military helicopter crash and suffered from post-traumatic stress disorder. He repeatedly asked for help with medical bills and received $818 for that, the document said.
Of course, when the organization asked for a DD214, Henry wouldn’t show them. So they requested a FOIA on him. I’m sure we’ll be reading about Henry again.

But it’s not restitution for ALL of the money and services he scammed.
I am increasingly perturbed by people who steal, destroy, scam, etc others and then get off by either not paying back anything at all, or only paying back a portion of what the took.
From the article, he got at least $3696 in money, goods and services of which he has to pay back $2878. That leaves the charity in the hole for $818 or over 22% of what he scammed.
I know I am preaching to the choir, but that’s $818 that could have gone to helping a real, honest to goodness, deserving vet. Instead, it goes down the rabbit hole.
The other thing that angers me is that he probably have to pay some court costs and definitely have to pay some fees while on probation. So the courts get their money, and the charities and vets have to take on the loss.
In my perfect world, he’d have to pay back every cent. I wouldn’t have a problem with adding interest to that as well.
I am not saying I want a “debtor’s prison” or anything like that. I want the charity and the people he scammed to be be made whole again. I don’t think that is too much to ask for.
It ticks me off.
A big NOPE. No restitution. I know you know this Chip, but there’ll be no restitution for the next legit bloke – who actually DOES need help – receiving sceptical looks, doubtful tones and long delays while due diligence gets conducted to make sure he’s not just another fake.
The harm these arseholes cause isn’t measured in money.
I don’t mean to say you don’t know this already, I’m just ranting. Rant complete.
Pity that he only got an eight month membership in Bubba & Thor’s harem, I wonder how quickly he’ll go right back to conning and scamming as soon as he gets out of his local Greybar Hilton?
I would guess within a day of release he’ll be spinning a story of his PSTD from being held as a POW in Greybaristan for 8 months.

Yeah, but 8 months, meaning it’s not even a felony, which it should have been.
Pretty sure that the max sentence for the crime determines felony or misdemeanor, SEA – not the sentence actually imposed.
Don’t know VA’s fraud statutes, but I’d be quite surprised if 4-figure fraud wasn’t a felony.
The article quotes the DA as saying he was convicted of “obtaining money by false pretenses.”
Let’s go to the statutes, shall we?
§ 18.2-178Obtaining money or signature, etc., by false pretense.
A. If any person obtain, by any false pretense or token, from any person, with intent to defraud, money, a gift certificate or other property that may be the subject of larceny, he shall be deemed guilty of larceny thereof; or if he obtain, by any false pretense or token, with such intent, the signature of any person to a writing, the false making whereof would be forgery, he shall be guilty of a Class 4 felony.

By advertising for the group that he conned, he must surely think they will be grateful for all the free advertising he earned them. Hopefully the leadership of the organization will be terminated immediately for not figuring out the obvious and necessary first….Under ANY circumstances, Always Get A Copy Of The D D 214 PRIOR to giving out ANY money! Not even cab fare to get him home. Just how stupid are some of these well-meaning folks????

For those who say he will start claiming PTSD, you’re too late.
In March, Henry told 13News Now he suffered from PTSD and was suicidal because of his involvement in Operation Enduring Freedom, the allies first attack on the Taliban following the September 11, 2001 terrorist attacks. But he never served in the war-torn nation post 9/11.
Also, he scammed another charity in Virginia:
Retired Navy lieutenant Jason Redman is the founder and CEO of Wounded Wear. His SEAL Assault Team came under heavy fire outside of Fallujah, Iraq in 2007. He was wounded severely.
Redman’s group worked with Henry, providing him with a Wounded Wear Kit and covering the cost of tickets to ‘A Toast to the Heroes’ for Henry and his girlfriend, as well as a hotel room when they attended the event.
And finally, Henry was convicted in July of 2015 for a firearm violation:
Earlier in July, Henry was found guilty of reckless use of a firearm. A judge sentenced him to serve 20 days in jail and continue his mental health treatment, according to Virginia Beach Commonwealth’s Attorney spokeswoman Macie Pridgen.
He will probably do 3 months max and evade paying back a penny.
