Akbar’s death sentence upheld
On March 23, 2003, during the attack on Baghdad, Hasan K. Akbar, a sergeant with the 101st AIrborne DIvision’s 326th Engineer Battalion, threw several fragmentation and incendiary grenades into the tents of his officers, followed by gunfire of his M4 rifle. Killing Army Captain Christopher S. Seifert and Idaho Air National Guard Major Gregory L. Stone were killed in the attack. In his diary, Akbar had promised to “kill as many of them as possible” in February.
At his trial in April, 2005, Akbar’s defense lawyers failed to prove to the panel of military jurors that he was innocent by reason of insanity and they convicted him in about 2 1/2 hours of “fragging” the two officers and sentenced him to death. In 2012, the Army Court of Criminal Appeals upheld the sentence and last week, U.S. Court of Appeals for the Armed Forces rejected Akbar’s claims that his defense in the original trial had been incompetent, according to the Sacramento Bee;
“We conclude that if there ever was a case where a military court-martial panel would impose the death penalty, this was it,” Judge Kevin A. Ohlson wrote.
The court’s 3-2 decision leaves Akbar one of six military men to be facing execution at the U.S. Disciplinary Barracks in Leavenworth, Kan. Though he had launched a wide-ranging challenge to his conviction and sentence, a big part of the case decided Wednesday dealt with his claim of ineffective counsel.

Ohlson, a former Army paratrooper and federal prosecutor appointed to the court by President Barack Obama, observed that Akbar was “represented by two experienced military attorneys who devoted more than two years to preparing and presenting the defense in this case.”
The two dissenting judges countered that Akbar’s trial defense attorneys fell short, with specific mistakes that included providing Akbar’s 313-page diary to the court-martial panel.
The decision clears the way for Akbar’s execution. The Army hasn’t executed a prisoner since 1961 when John A. Bennet was executed by hanging for the rape and attempted murder of an 11-year-old Austrian girl while he was stationed there in 1954.
Akbar has five neighbors on the Defense Department’s death row; Ronald A. Gray, a spree-killer from Fort Bragg, NC, who was sentenced in 1988, Dwight J. Loving who killed two taxi cab drivers at Fort Hood, Texas, who was sentenced in 1989, Andrew P. Witt, a former airman who committed a double murder at Robins Air Force Base, Georgia and sentenced in 2005, Timothy B. Hennis, sentenced for a triple murder while he was stationed at Fort Bragg, and Nidal Malik Hasan awaiting the needle for thirteen murders at Fort Hood.

What this man did is a thoroughly dishonorable thing. He killed fellow soldiers because he was loyal to the enemy, not the US. In common terms, he was a traitor.
Hanging is perfectly appropriate for a traitor.
I would also be perfectly fine with drawing and quartering – or any of a number of other equally unpleasant methods of execution. Unfortunately, the SCOTUS would not permit those due to the 8th Amendment.

How,other than providing a big answer to the why, was providing his diary a mistake? They probably thought it would bolster their insanity defense. I’m sure if during the discovery phase if they had withheld it, that would have been a big no-no.
I think it would only have been a no-no if they intended to use it as part of their defense. Not sure how Federal law reads on something like this?
That being said, I would think it’s time… the fact that we have people sitting on death row since the ’80s is indeed cruel and unusual punishment – and should be rectified by means of immediate execution. Clear out all the trash.
Akbar had excellent defense counsel. The government’s trial counsel also were (and still are) some of the best as well. If I remember correctly, I think the defense wanted to front-load the mitigation argument by using the diary to show that Akbar was a confused, troubled young man. This was a tactical decision, and appellate courts typically hold that counsel is not ineffective when making tactical choices.
Of course, the defense argument went out the door when Akbar stabbed a guard during the mitigation portion of the proceedings, and anyone wanting to testify on his behalf changed their mind.
Well at least Hassan will have someone to change his diaper who’s a fellow muslim for a while longer.
It’s apparent the government is in no hurry to do what the courts have told them to do. I don’t see the execution of any of those sentences until 2017, at the earliest.
Realize though that right now, they are Prison Gay. So, King Barry is probably proud of them for the choices they are making currently.

Although, them being in prison the rest of their lives (especially the muslims who want to be martyrs) a far site worse than a mid-morning hangin’.

Obama will probably commute Hassan’s and Akbar’s sentences before they get close to the execution chamber.

If their sentences are commuted, then the TAH community needs to see who is closest to their release point, and greet them “appropriately” as they they exit the prison.

But no firing squad. A firing squad allows the condemned the opportunity for a dignified exit. A common criminal – and in this case, someone who is also in common language a traitor – does not deserve death with dignity.

One of the valid reasons to do away with the death penalty is that it costs taxpayers Millions of Dollars to go through the automatic appeals process. I was reading the ungodly ammount of time and money that California has spent to end up conducting executions there.

Mixed emotions from me on the death penalty. Nope, I am not a flaming liberal. But I do believe anyone sentenced to death by lethal injection views it as an easy way to check out. My preference would be to have them spend the remainder of their life locked up like a dog in a small cage, never again to be able to see daylight. Bathe once a month with a bucket of urinal-fed stream water. One meal a day made with a monkey turd on rye bread. On the anniversary of the murder they were convicted of, they get an enema made of mostly broken glass and freshly captured (and VERY pissed-off) hornets. Maybe I am a liberal after all.

Lethal injection is too humane a death. They first give an anaesthetic to put the prisoner to sleep. At that point the drugs that stop the heart are administered. I have had a chemical stress test and you swear that your heart is going to explode! I can only imagine the terror that one would feel as their heart bangs away toward v-fib. I say that the execution be carried out without the anaesthetic component. Let these oxygen wasters feel a little of the terror and suffering their victims felt in their last moments. A well done hanging is a swift and painless death. Even a botched hanging kills the guy, eventually if he strangles, instantly if his head is pulled off.
