Don’t watch this if you have anger issues….

| July 23, 2012

First, some background… This Kroger is probably 2 miles from my house. We actually don’t use it very much since there is a Marsh (which my wife refuses to shop at as she thinks they are “crooks“) and a Meijer somewhat closer, but it is still pretty darned close. So back on the day after Christmas of last year, this jackass went in to rob the place, took a young chick captive, and then got plugged by a dude working there who was carrying. I vowed then to shop there every chance I got….until he was basically forced to resign.

Fast forward to last week, when my former Army Medic buddy from my Church small group sent me this.

If they don’t settle I will reconsider shopping there. I won’t do it happily, but if they cave to this extortion, then no mas from me.

PS- Any lawyers reading this have PACER? COuld use a copy of the filing if someone does… Here is the link.

With you on that, TSO. Kroger needs to understand that it will cost them more than your business should they settle. Sometimes it is worth every dime it costs to do the right thing.

Girl who was held captive, should sue the low life’s mother for emotional distress that her son inflicted.

Old Trooper

This is the latest craze within the “community”; sue whomever it was that took down your darling little thug kid. Forget the fact that the thug was in the commission of several crimes at the time; nope, little Johnny was a good kid and was turning his life around. The evil gun just jumped into his hand and forced him to go rob that store and take that innocent girl hostage.

Jeff

@2…agree, civil suit for wrongful imprisonment. I posted a link to this from the Indy Star last week. I highly doubt any judge will seriously consider it though as it nearly fits the definition of a frivolous lawsuit since they’ll have a hard time showing Kroger was negligent in the enforcement of its policies AND she’ll have to prove that her son’s actions did not lead to his very timely demise…an uphill battle if there ever was one. Yeah I was pretty pissed at Kroger for pretty much forcing him to resign

Jeff

TSO how goes the mission we spoke of?

AmyJ

This is horseshit! I’m with you TSO. I shop at Kroger regularly and will have to reconsider as well depending on their actions.

Apparently this crap (now deceased) 26 year old Jeremy Atkinson pulled was old hat.

This from WISH TV channel 8:

“Police said Atkinson escaped from a halfway house in October. He was there due to previous robbery and gun offenses.”

Veritas Omnia Vincit

It’s really too bad that the court can’t send someone to the mom’s house and the lawyer’s office and beat the living sh1t out of them for having b4lls big enough to generate this horsesh1t….

No one except mom is going to miss this little turd, good riddance to a cancer on society her son was a steaming pile of pig sh1t….also the good folks at Kroger should get a nice 4ss punch for not promoting this kid in the manager’s spot.

Jeff

The city of Austin Tx settled a lawsuit and paid over 800K to relatives of one thug and a 1 million to two more families, for situation just like this however it was the police that shot and killed their darling little kid. So the fact that they filed is not suprising and it could very well be settled with the family getting lots of money.

ISGuy

I live about one mile south of there Bro, work for the city. Thanks for sharing this

Can we sue his mother for raising a POS who was a menace to the community?

Jabatam

Ok since there is another “Jeff” here, I’m switching to my original and unique handle so we don’t get confused with each other

Not to be confused with the other Brian

I think they should throw that Mother in jail for trying to extort Kroger by filing this bs claim.

CI Roller Dude

Law suits like this are actually very common…although it’s usually a law enforcement agency that gets it. Back in the 90’s when 2 assholes put on body armmor and had fully auto rifles and tried to rob a bank in L.A. they shot over 9 cops, fired hundreds of rounds of ammo and all the cops had was pistols to try and stop them.
When the assholes finally got shot or shot themselves, the families sued LAPD.
We need to change the civil laws in this country…it waste MILLIONS of tax payers dollars and in this case- it will just drive up the cost of food.

DefendUSA

That is absolutely ludicrous. To the guy who defended himself and others against the thug- don’t give in to the PC. You should be thinking “Thank God, I could do something,” instead of it being “regrettable” because the thug’s parent’s cannot accept the delinquent child they raised.

Devtun

Cops made an emergency run to a gun shop for AR-15s – .223 ammo cut through their body armor and that ruined their day. The legendary North Hollywood shootout.

WkAvngr211

All I can say is WTF? The attorney that took this is as big a POS as the thug who got waxed. Both of them survive by stealing from people who work for their money. If I were Kroger, I would counter sue the mother for negligent parenting! When will this BS end?

Nigel Brooks

Check your mail – pdf of complaint on the way.

Greyhawk

Counter sue for nothing more than the cost of the bullet.

TSO

Wow, that really is the stupidest lawsuit of all time. All 4 pages of it.

I love the phraseology though, an altercation arose. Yeah, no shit, pretty much based on teh fact that dude came in to rob the place.

What a ridiculous lawsuit.

Yat Yas 1833

I totally agree with you fellas who say “sue the mom for raising a POS son”! Unfortunately we have a “legal” system, not a “justice” system. Justice WAS served, POS son will not be trying to rob anymore grocery stores, isn’t that justice?

Ex-PH2

I think this comes out of the ’90s, or maybe the ’80s, when someone burglarizing your house could sue you for bodily injury if he got hurt in the process, whether he fell and hurt himself or you shot him.
I’m not so sure this dimwit woman’s lawsuit will be judges as having any merit, but please give us a follow-up on it. And anyway, the dude who shot the holdup guy can countersue the ‘mom’ (and I use that term loosely) and countersue Kroger for wrongful dismissal. And frankly, I’d rather have him working for me than other people I know.

WOTN

Keep us up to date TSO. If Kroger caves, I’ll refrain from shopping there ever again. As it stands, I’ll still consider it, based on the forced resignation.

In TN, private businesses can opt to make their property “gun-free,” but that’s like asking for criminals to choose them over the others.

UpNorth

If “mom” gets a dime, the young lady who was taken hostage should sue her for every dime she gets.
Sadly, I think Kroger will look at a settlement as the cost of doing business, and the highers will congratulate themselves that they got rid of the guy who dared to defend his store and customers and employees.

Hack Stone

#27/Up North, about ten years back, there was a POS car thief/purse snatcher that the cops were chasing in Philadelphia. He beat up some old lady, about 75 or 80 and stole her purse and car. Well, a few days later the cops were pursuing him, he took off placing innocent people in danger, to include driving on a sidewalk while a crowd of people were exiting a funeral. Eventually, they get his ass pulled over and gave him a taste of street justice. A news helicoptor filmed it. POS gets a lawyer and files a lawsuit for something like $50,000,000. The old lady he beat up robbed filed a lawsuit against him for $50,000,001. Never heard how that one turned out.

CombatCAsh

He tried to rob them while he was alive, now his family will try to rob him with his death, screw these people. I hope the judge laughs this out of the courtroom.
