Minnesota Democratic state senator convicted of burglary

Nicole Mitchel, a Minnesota Democratic state senator, was convicted of first-degree burglary and possession of burglary tools. We talked about her here, she was a lieutenant colonel in the Air National Guard. She was arrested in April 2024 after police found her dressed up as burglar, wearing black clothing and latex gloves. But wait! There’s more! She also had a crowbar, and a flashlight covered in a black sock.

The jury convicted Mitchell on charges of first-degree burglary and possession of burglary tools. She declined to comment to reporters after the verdict, but her attorney stated she plans to appeal the conviction.

Mitchell has faced growing pressure to resign since her arrest, including from members of her own party. However, Minnesota Senate Majority Leader Erin Murphy previously said Mitchell should first have her day in court.

“Senator Mitchell has been afforded due process, a trial by a jury of her peers, and that jury has delivered a verdict. I am relieved to see the end of Senator Mitchell’s trial. The case’s resolution brings clarity to the situation,” Murphy said in a statement following the verdict. “Senator Mitchell has told colleagues that she intended to resign if found guilty of this crime, and I expect her to follow through on that pledge. Our caucus remains focused on the issues that matter to Minnesotan families and communities.”

Mitchell has not yet been sentenced but faces a minimum of six months in jail. If she refuses to resign, Governor Tim Walz has the authority to call a special legislative session for an expulsion vote, which would require a two-thirds majority in the state Senate to forcibly remove her from office.

Considering the whole sale larceny our representatives have been approving over the last few years up here in the Star of The North she’s guilty of a very minor offense.

She really was an idiot if she took that to trial. I wonder if they offered her a deal for criminal trespass that she turned down?

It’s too bad NPR or AJ America won’t hire her back due to err, cash flow issues, so I guess its off to the breadline.

I was wondering the same thing. There are lots of better ways to deal with a mother-in-law with “dementia” and the safe guarding of your fathers memories and treasures.

You would think that as a Lieutenant Colonel and a state legislators she would be aware of the line of succession when it comes to estates. Unless her father specified these items in a will to pass on to her, the items default to the surviving spouse. Hack Stone has seen enough Judge Judy episodes to know that.

You still can’t break into someone’s house. Even if it’s to recover stolen or lost property. A former employee of mine sold a stereo to a neighbor tenant. Months go by and he wasn’t getting paid. Walk by the buyers door and saw it was ajar. Knocked and door opened. No one home, so he snatched the stereo and took it back to his place. Called the guy up and said pay me or Your not getting the stereo back. The delinquent buyer called the cops, the cops recovered the stereo (evidence). It was a felony theft over $1200. And he was previously charged with drugs, domestic abuse. The domestic abuse was to cover for his wife ramming her car into his. 3 felony’s. At trial the DA was asking for 40 years, he got 5 years and served 2 with probation.
Bottom line is don’t steal anything. Get an attorney. He got divorced too, he got caught with drugs and screwing a neighbor in the garage. Ex-wife opened the garage door and found him nailing the neighbor gal. Good worker but stupid with life choices. He worked for me as carpenter for 11 years, never late.

She was breaking in to her step moms house to steal some of her late father’s belongings.

I get it as I had to go through the same crap with a step dad. The legal system says that the property is his, even though she was my mother before she was his wife, he was having an affair on her when she became sick and he was just going to lose it anyway. Nothing really valuable. Pictures, etc.

That mitigates my earlier remarks about “stupid”.

I can understand a squabble between a daughter and the evil step-mother situation – although “less than wise” might still be applicable. But given how some 2nd/3rd wives have treated the inheritance due to the children, fully understandable.

Dad should have made clear in his will (with copies to the kids) who got what.

More likely an amateur’ s choice of burglar tools. Most folks have little idea of how fragile a house is.

We changed all the (short)screws that come standard on door entry to much longer screws (3″) on all entry door striker plates. Makes kicking the door in not so quick n easy. Motion detectors, lights and cameras in/around the garage. We also have very good, and watchful neighbors.

I will confirm most homes can be opened with ease. Stick in pry-bar at locket and Push over and walk in, a lot of cheap carpenters don’t add the security screws at the lock set. Or lift patio door up on track and it will fall out. No security screws. Most homes could be broken in to in less than 10 seconds. A battering ram takes longer, but it does more damage.

When Brink’s had the NYC Parking meters and lost it because a number of employees were stealing moola schmoola coins from the meters. every company that had the contract had their emplouees steeling. the minority company after us had employees stealing and the judge told the company that they didn’t pay their employees enought of a salary so he dismissed the case. The NYC employees were the first to get caught stealing then Wells fargo employees got caught stealing then when we got the contract, and guys got caught stealing and the last I remember were the un paid minoruty company employees. I went off on a tangent. When the PD came down to search the lockers, they opened up mine and recovered a pair of pliers and wanted to arrest me but the Brink’s management told the officer that pliers were used to pull out the metal can that looked like a soda can. The handle of the pliers went into the open meter and wrapped around the can and you could pry out the can plus in freezing and regular normal temperatures the meter sometimes stuck in the keyhole so you could pull the key out with the pliers. City employees carried a coopers tool to do the above and I never bought one. You can google the Brink’s parking meter scandel and has the arrested employees names. A couple did jail time and weekend jail time. We still had the coin pickup at the garage that went to the bank. I was in the garage making the coin pickup and I asked the boss if he was ever going to use Brink’s again and he says, Jeff, you would be one or 2 others that we would hire. We used poker chips with route numbers putting the 3 man crews onto different routes out of a cigar box and the guy doing the poker chip out of the box was able to put the same group of stealers on the same routs.
