The U.S. Supreme Court strikes down university affirmative action, exempting the service academies

| June 30, 2023

Willy Wonka you oppose racism but support affirmative action double standard

The U.S. Supreme Court recently ruled that university affirmative action violated the 14th Amendment. This amendment addresses equal protection. Chief Justice Roberts wrote that getting rid of racial discrimination means getting rid of all of it. However, he exempted the service academies from this decision.

From the Military Times:

In August 2022, 35 former top military leaders — including four former chairmen of the Joint Chiefs of Staff, among them retired Marine Gen. General Joseph Dunford and retired Navy Adm. Michael Mullen, and eight former service academy superintendents — filed a friend-of-the-court brief arguing that affirmative action was necessary for national security.

The retired leaders emphasized that the officer corps already is significantly less racially diverse than the enlisted troops. Increasing that gap, they warned, could diminish the military’s legitimacy in the eyes of some Americans, hinder engagement with foreign countries and threaten internal morale.

Many veterans have dismissed claims that affirmative action is necessary for national security.

A group of more than 600 veterans – among them 21 Medal of Honor recipients and some former leaders of service academies – in May 2022 filed a friend-of-the-court brief asking the Supreme Court to ban the practice.

Far from boosting morale, this group maintained, affirmative action “can only foster a culture of arbitrary advancement, disunity, and frustration.”

The retirees in favor of affirmative action argued that, as a matter of military diversity, affirmative action isn’t important just at service academies. They maintained it was also important at civilian colleges and universities, where the majority of new officers receive their degrees, and where many receive commissions through ROTC programs.

Notice that the veterans in favor of affirmative action in the service academies were heavy on the rear echelon backgrounds. However, the veterans wanting to end affirmative action in the service academies were heavy with the front line backgrounds.

The Military Times has the rest of the article here.

“Supreme Court Rules Against Biden Student Loan Debt Handout”

https://www.foxbusiness.com/politics/supreme-court-rules-biden-student-loan-debt-handout

“The Supreme Court ruled Friday that the Biden administration cannot go forward with its student loan debt handout program.”

“In a 6-3 decision, the court held that federal law does not allow the Secretary of Education to cancel more than $430 billion in student loan debt. ”

“The Secretary’s plan canceled roughly $430 billion of federal student loan balances, completely erasing the debts of 20 million borrowers and lowering the median amount owed by the other 23 million from $29,400 to $13,600,” Chief Justice John Roberts wrote for the majority. “Six States sued, arguing that the HEROES Act does not authorize the loan cancellation plan. We agree.”

“President Biden strongly disagrees with the court’s decision and will make an announcement later today detailing new actions to protect student loan borrowers.”

“Supreme Court Rules In Favor Of Colorado Graphic Designer Who Refused To Create Same-Sex Wedding Websites

https://www.foxnews.com/politics/supreme-court-rules-favor-colorado-graphic-designer-refused-create-same-sex-wedding-websites

“The US Supreme Court held that a Colorado graphic designer who wants to make wedding websites does not have to create them for same-sex marriages, in a landmark decision that pit the interests of LGBTQ non-discrimination against First Amendment freedom.”

“In a 6-3 decision issued Friday, the high court ruled in favor of artist Lorie Smith, who sued the state over its anti-discrimination law that prohibited businesses providing sales or other accommodations to the public from denying service based on a customer’s sexual orientation.”

“Justice Neil Gorsuch authored the majority opinion, which said that, “In this case, Colorado seeks to force an individual to speak in ways that align with its views but defy her conscience about a matter of major significance.”

“But, as this Court has long held, the opportunity to think for ourselves and to express those thoughts freely is among our most cherished liberties and part of what keeps our Republic strong,” Gorsuch continued.”

“But tolerance, not coercion, is our Nation’s answer. The First Amendment envisions the United States as a rich and complex place where all persons are free to think and speak as they wish, not as the government demands. Because Colorado seeks to deny that promise, the judgment is reversed,” he concluded.”

“Friday’s decision reverses a lower court ruling that sided against Smith, who said the law infringed on her First Amendment rights by forcing her to promote messages that violate her deeply held faith.”

So much for the forced cake…

There aren’t any LGBTQRST cake makers who will accommodate others of their persuasion?

Get the f*ck outta here!

If the demoRAT liberals want to pay back the peeps whom still own the colleges money then why don’t they liberaly pay for the student debts out of their own pockets and make it a law that everyone that voted the new 1000 year 4th Reich into office do the same as well as them taking all the border crossers into their homes and that’s the fact Jack

Yeah, it’s great, but those fuckers, aka democrat commies, are already working to sidestep the decisions. They’re incorrigible.

I’ve been seeing a bunch of woe is me ads and news stories about the student loans and payments crushing our poor college graduates and all this other nonsense.

Nobody’s been paying their still loans since 2020.

They could have joined the US Military and not only had their schooling paid for, but earn the respect of millions of us Veterans.
Not only that, they will also go on an adventure that will be beyond anything in their wildest dreams.
They might even get lucky and become a US Army certified Ski Instructor !!!

Another shitty day for the Gibbering Geriatric, the Alphabet Community and Progtards in general. I may take the rest of the day off in celebration!

USMC Steve

Why exactly would affirmative action be necessary for national security? It is one thing and one thing only – reverse discrimination and established set asides and special consideration for mostly people who would not deserve it, nor could they have made it on their own achievements or merit.

It reinforces the idea that a good many officers particularly senior ones are closeted liberals who mindlessly support liberal nonsense. In this case discrimination.

jeff LPH 3 63-66

Liberal demoRats think that minority peeps can’t go in in the world and their goal for years has been to keep them on the “Plantation” and give them Moola Shmoola so they will vote for them.

Prior Service

So I’m confused. When I was at the war college, disaster (I mean Secretary) Fanning came into the auditorium and said “if you send me a command select list that isn’t diverse enough, I’m sending it back.” Was he right, or not?

Dave Hardin

Fanning was not appointed because of his career achievements, he was appointed because he takes it up the ass. The list of better qualified individuals is very, very long.

Demanding that others who take it up the ass get advanced over those who like to stick it other places or take matters into their own hands is the very definition of prejudice.

Unless you are auditioning for a job in Porn, where you stick what has little meaning to me.

But, that’s just my opinion.

rgr769

Also, people like Fanning seem to forget that they took an oath to support and defend the Constitution, which contains an Equal Protection Clause. That clause means the laws are to apply equally to our citizens, irrespective of their race, color, or creed. Laws and/or rules that require unequal applications are unconstitutional, and thereby void.

Prior Service

rgr. Pretty sure I started out on thei list but fell off. Obviously I’ll n
ever know for sure, but that dick said what he said.

If the Woke Left were really concerned about the lack of quality education has on certain ethnic groups, they would be demanding accountability from the Public Schools and Teachers Unions that are committing Educational Genocide upon the students of inner city schools. There entire graduating classes in Maryland where not one student can meet the MINIMUM standards for proficiency in Math and English, and yet they are handed a diploma, thereby extending the cycle of poverty upon another generation. If you fix the problem at the source, that being K-12 schools, they would not have to set aside college class seats for those academically challenged.

MustangCPT

Funny, the ring knockers are exempt. I don’t know, I didn’t see any of this alleged discrimination across 2 branches over a 30-year timeframe and I’m pretty damn sure that I didn’t get picked up for OCS because I’m a minority. And I sure as shit didn’t get through OCS because of my pigmentation. The 2 TAC Officers who were hardest on me were minorities so there was definitely no affirmative action there, nor should there be.

As ol’ R.Lee Ermey depicted:

Smitty

These common-sense decisions can be traced to President Trump and his three appointments to the court. Think what Hillary would have appointed and the results. Maybe this was divine intervention.

rgr769

Her first Supreme Court appointment would have been to put Garland on the Court.

timactual

Every time I read or hear about him these days, which seems to happen way too often for a gov’t. bureaucrat, I shudder when I remember that.

Forest Bondurant

Yeah, I tead through the first SCOTUS decision about admissions (not all 239 pages though), and I wasn’t surprised to read Jackson’s dissenting opinion and statements about the case were devoid of any legal reasoning…just leftist dogshit that was rebutted. Sotomayor didn’t fare very well either.

rgr769

Color me shocked. Gollee, Sgt. Carter! It looks like the ranks of REMF officers are full of Progs. Whereas, the ranks of the combat arms officers are full of believers in the oath they took. Who knew?

MustangCPT

So, where do us Engineers fall? I mean, we can be REMF adjacent or Combat Arms adjacent…depends on the situation. However, there’s one thing you can take to the bank, we’re ALWAYS alcohol adjacent! 🤣

Only thing I ever saw overtly left-progressive in Signal was a picture in one my BN CDR’s offices, her and Hillary. Other than that, things were mostly quietly conservative or apolitical. But… you never know what lurks hidden under the surface.

You build-it-boyz are the exception to the generality. Plus, your ability to blow up shit is frequently the final critical element to a mission to destroy a bridge or a microwave tower. That is why they teach demolitions with special charges in SF school.

You are correct, sir. Our claymore mechanical ambushes were detonated by electric blasting caps, using claymore wire, a PRC-25 battery and a tripwire trigger made from two stripper clips and a C-rat spoon.

timactual

Never heard of a “mechanical ambush” until few years after I was discharged. Given what I have seen regarding the ability of our own troops to blow themselves up that was probably a good thing. Plus I doubt whether any of our claymores had any C4 left in them, anyway. (I may have mentioned before that the unit I was in was not an all-star unit—and I must confess I fit in well.)

Our instructor in MP school told us we would be bored if we went to some place like Sandia Base or a Nike site, where we would just do guard duty. But, if we went where there we airborne, infantry, or engineers, we would have our hands full. He was right!

Well, breaking up drunken brawls does take quite a bit of work.

Funny thing that.

It’s funny to me, that it’s all about “equality” until equality comes full circle and you have to compete on level ground.

SFC D

No no no, “equality” is not the desired endstate. Equality is the trojan horse. “Equity” is the desired result. You know, From each according to his ability, to each according to his needs“.

Gee whiz, what a surprise.

KoB

Discrimination is discrimination. SCOTUS made the right call. ’bout time! Shoulda included the “Service Academies” too.

I don’t give a damn if one is Black, White, Red, Yellow, Green, or Purple. For DECADES, everyone has had the same legal ability to get off their ass, stub out their camel, pick up a shovel and go to work. Time they started to do that instead of waiting for everything to be handed to them.

I don’t owe nobody for anything…and nobody owes me. Life is what you make of it…get over yourself…nobody gets out alive.

Wait, what….?
They excepted the service academies?
Are they stupid?

How can acknowledge that:
1) racism is bad
2) affirmative action is racism

But leave it in service academies?

How the hell diversity is better than meritocracy in the military? Are they trying to help the chicoms and the rustians?

timactual

“However, the veterans wanting to end affirmative action in the service academies were heavy with the front line backgrounds.”

Understandable, when the results of your leader’s incompetence usually results in nothing worse than a paper cut.
