Hunter Biden plea deal on tax and gun charges; likely to avoid jail
Hunter Biden has agreed to a plea deal involving tax crimes and gun possession. He will plead guilty to the tax crimes, considered as misdemeanors, and admit to the gun charge. The plea deal involves his being handed a probation sentence, as well as Biden’s agreeing to go through a “diversion program” for the gun charge. Successful completion of this diversion program, plus associated requirements, would lead to the gun charge being removed from his record.

The younger Biden’s attorney said the deal means the long-running criminal investigation involving the president’s son “is resolved.” But Delaware U.S. Attorney David Weiss, the lead prosecutor in the case, said the investigation “is ongoing,” suggesting that matters beyond the tax and gun issues are still under scrutiny.
The probe was opened in 2018, during the administration of President Donald Trump. Since 2020, Republican politicians have repeatedly accused Hunter Biden of broad wrongdoing in his overseas business deals, and predicted the Biden administration would be reluctant to pursue the case. The terms of the proposed deal — negotiated with Weiss, a holdover from Trump’s administration — were quickly dismissed Tuesday by congressional Republicans, who vowed to continue investigating the Biden family.
Papers filed in federal court in Wilmington on Tuesday indicate Biden has tentatively agreed to plead guilty to two misdemeanor tax charges of failure to pay in 2017 and 2018. A court document says that in both those years, Biden was a resident of Washington, D.C. and received taxable income of more than $1.5 million, for which he owed more than $100,000 in income tax that he did not pay on time. Prosecutors plan to recommend a sentence of probation for those counts, according to people familiar with the negotiations who spoke on condition of anonymity to describe elements of the case that are not yet public. Biden’s representatives have previously said that he eventually paid the IRS what he owed.
The second court filing is about the gun charge. In that case, the letter says, “The defendant has agreed to enter a Pretrial Diversion Agreement with respect to the firearm Information.” Handling the gun charge as a diversion case means Biden will not technically be pleading guilty to that crime. Diversion is an option typically applied to nonviolent offenders with substance abuse problems.

I’m just glad the gun charge will be removed from Hunter’s record. If you look me up in my state’s court info database, you’ll find a Concealed Weapons conviction from 1997. Funny, with the AWB in effect and the cop and judge both agreeing that no common citizen needs a pistol-gripped shotgun, I went to jail for a few weeks (I know, cry me a river, but after an appeal was upheld I had a year hanging over my head and couldn’t enlist for three years). I did get my highly concealable snub-nose .38 back after a while, since I was somehow found “Not Guilty” of concealing that relatively tame firearm.
If a customer enters my store and lies on a form or makes a straw purchase, the NICS/FBI and the ATF will be showing up in no time. If one of the gun counter guys screw up too much, or if I fail to acquire or dispose of a gun properly, we risk our jobs and freedom. Knowingly lying on an ATF Form 4473 would have made 99% of other Americans instant felons if and when they were caught.
My wife worked the sporting goods department in a Blue Big Box store. She sold firearms for about 6-7 years. Figuring she turned down a straw purchase or a failed 4473 about 2-3 times a month, on average. In all that time, with all of those violations of federal law, she was never once contacted by the ATF, FBI, state police of the local PD or Sheriff’s Dept.or any other alphabet agency.

Everything’s changed in the past few years, much of it since the start of 2023. Self-prohibits (answering a question wrong) used to be allowed to make another attempt with a manager’s approval. Since March our Corporate policy is “do so at your own risk”, so we Void the forms and log them in the Deny Log. For the past few years a NICS Deny requires the local chief LE agency to be contacted to file a report, followed by notification of state LE. So, every time we get a Deny a Deputy comes to the store.
We get (on average) two ATF Trace Requests per month. We have an hour to pull and scan the file and send it to the ATF. A locally-based SA called the store a few weeks back demanding that a 4473 be sent to his email. He didn’t like the answer he got, “No sir, we’ll have to contact Corporate Compliance before we send it to an individual email” (it was an ATF.gov account, but still). The SA replied, “No is not an acceptable answer,” but guess who waited until we got the thumbs up. I don’t know him and wanted approval to send PII to an individual Agent. We also had a DHS Agent come in trying to get a 4473. Nope, he ended up having his ATF Liaison contact us.
We’re a privately-owned Big Box Outdoors retailer and both store and Corporate management are cool with local, state, and federal LEOs, but we still have to protect the FFL and our employees.
