GOP donor sues hunters for $9,400,000 for violating a few cubic feet of his airspace

Elm Mountain Ranch owner Fred Eshelman, the primary beneficiary of the Eshelman Institute for Innovation at the University of North Carolina’s School of Pharmacy, is now suing the men for $9.4 million in federal court, claiming they stepped from one parcel of public land to another and across the airspace of his private property.

Just so we understand – this is a landowner who owns land adjacent to U.S. BLM property at a “four corners” spot. Think intersecting fences where the diagonals are both public land, or from the other direction both privately owned (by the same rich fella in this case.)

Central Missouri residents Bradly Cape (Steeleville), Philip Yeomans (Cuba), John Slowensky (New Florence) and Zach Smith used a stepladder at a Wyoming four-corner crossing — one leg planted on each side of a public Bureau of Land Management parcel — to get over a fence and avoid the corner sections of private land owned by Eshelman.

Now, the hunters felt that  if they stepped from BLM land to BLM land, they were clear, right?  They were acquitted at the criminal trial for trespassing:

“(Eshelman) believed the whole mountain was his and that no one but (he)was allowed to be there … like a king,” The hunters’ attorney, Ryan Semerad said during the closing arguments of last year’s criminal trial. “When he hears there are some regular people on the other side of the mountain (he said) ‘go track them down, arrest those men!'”

But Eshelman said the hunters trespassed by being on his property’s airspace, ultimately diminishing the ranch’s property value.

“A body is bigger than that point,” Carbon County prosecutor Mayfield Davis said during last year’s criminal trial. “All of their bodies were over private land … When you break that plane [above a property boundary line] you are entering their property.”

So by stepping over a coupla feet on either side of a fence post they DIMINISHED the value of the land by more than most people earn in their lives.  Kinda makes an egalitarian like me think Eshelman (and his apparently bought-and-paid-for DA) should lose, and pay a nominal fine to boot. Say $9,000,000 or so?

If Eshelman’s name rings a bell, you may remember his $2,500,000  contribution to True the Vote, one of the big “stolen election” groups after the 2020 election – and then when they failed to produce credible results, tried to sue to get his money back. Obviously a Trump supporter who believes in the power of a lawsuit, eh?   CNN

So I own land in a National Forest. It is a checkerboard mix of private and public property. Some people have succeeded in buying up land surrounding some of the public property therefore making it inaccessible. This gives them the defacto control of the public land. I am certain that is what this guy did.

I think the hunters should file a counter class action suit for the value of the land that is shut off.

Most western states won’t allow landowners to shut out public land, pretty sure the Beaureau of Landmismanagement and the Forest Circus are not going to allow it.

I think that he should have to pay a fine and build a bridge (for the animals…at least bear size) to cross over, and have to maintain it!

Friend of mine was repeated sued (frivolously) by a neighbor.
Finally he counter-sued. Neighbor’s lawyer tried to use that against them in court asking how much money they wanted from him. Friend said “Nothing. We just want him to leave us alone.”

They won.
Me, I’da gone for lawyers’ fees at least.

13,000 MW of PV solar is about 6x the size of the world’s largest solar farm in India.
To get that kind of generation in NY state latitude would require about 140,000 acres, or just a hair under 220 square miles.
That’s roughly 10x the size of all of Manhattan Island.
Assuming it’s a sunny day. And of course, no battery system to store energy for night, etc., on that kind of scale exists anywhere. Not even close.
