GOP donor sues hunters for $9,400,000 for violating a few cubic feet of his airspace

| April 24, 2023

Elm Mountain Ranch owner Fred Eshelman, the primary beneficiary of the Eshelman Institute for Innovation at the University of North Carolina’s School of Pharmacy, is now suing the men for $9.4 million in federal court, claiming they stepped from one parcel of public land to another and across the airspace of his private property.

Just so we understand – this is a landowner who owns land adjacent to U.S. BLM property at a “four corners” spot. Think intersecting fences where the diagonals are both public land, or from the other direction both privately owned (by the same rich fella in this case.)

Central Missouri residents Bradly Cape (Steeleville), Philip Yeomans (Cuba), John Slowensky (New Florence) and Zach Smith used a stepladder at a Wyoming four-corner crossing — one leg planted on each side of a public Bureau of Land Management parcel — to get over a fence and avoid the corner sections of private land owned by Eshelman.

Now, the hunters felt that  if they stepped from BLM land to BLM land, they were clear, right?  They were acquitted at the criminal trial for trespassing:

“(Eshelman) believed the whole mountain was his and that no one but (he)was allowed to be there … like a king,” The hunters’ attorney, Ryan Semerad said during the closing arguments of last year’s criminal trial. “When he hears there are some regular people on the other side of the mountain (he said) ‘go track them down, arrest those men!'”

But Eshelman said the hunters trespassed by being on his property’s airspace, ultimately diminishing the ranch’s property value.

“A body is bigger than that point,” Carbon County prosecutor Mayfield Davis said during last year’s criminal trial. “All of their bodies were over private land … When you break that plane [above a property boundary line] you are entering their property.”

Springfield New-Leader

So by stepping over a coupla feet on either side of a fence post they DIMINISHED the value of the land by more than most people earn in their lives.  Kinda makes an egalitarian like me think Eshelman (and his apparently bought-and-paid-for DA) should lose, and pay a nominal fine to boot. Say $9,000,000 or so?

If Eshelman’s name rings a bell, you may remember his $2,500,000  contribution to True the Vote, one of the big “stolen election” groups after the 2020 election – and then when they failed to produce credible results, tried to sue to get his money back. Obviously a Trump supporter who believes in the power of a lawsuit, eh?   CNN

So I own land in a National Forest. It is a checkerboard mix of private and public property. Some people have succeeded in buying up land surrounding some of the public property therefore making it inaccessible. This gives them the defacto control of the public land. I am certain that is what this guy did.

I think the hunters should file a counter class action suit for the value of the land that is shut off.

Most western states won’t allow landowners to shut out public land, pretty sure the Beaureau of Landmismanagement and the Forest Circus are not going to allow it.

All kinds of shady stuff happens with public land that isn’t supposed to.

Had a landowner pull that in the area I grew up in. Fenced off access roads, threatened people with a shotgun, all kids of fun stuff. She was a real piece of work. For a good time, google “Marquita Maytag”. Yes, was a real person and that’s her real name.

She was known to block off forest service access roads that passed through her property. Law says you can’t do that. Now, check out her actions as ambassador to Nepal…

RGR 4-78

Read a short piece about her chasing down a couple on a snowmobile and holding them at gunpoint.

Didn’t pursue the “shrew of Katmandu”.

Veritas Omnia Vincit

Someone pulled that shit in a small town somewhere up here in the Northeast….shortly there afterwards someone’s barn and expensive vehicles all mysteriously burned to the ground…bad things happen to assholes every once in a while and I always thought it was Karma…in this case it was a guy named Bob, but I prefer to think Karma sent him…

Location and name are vague to protect the guilty…

Starting a roomer about the landowners “giant WEED growing operation” still works in the NEK.

Sounds like Mr. Eshelman could benefit from an innovative pharmacy’s chill pills. Robber Baron much?

I think that he should have to pay a fine and build a bridge (for the animals…at least bear size) to cross over, and have to maintain it!
If hunters happen to cross it, that is ok as well!

They should countersue for the same amount.

President Elect Toxic Deplorable Racist SAH Neande

Countersue sounds great. Love it.
But on what charges?

Extreme Douchebaggery?

Frivolous lawsuit comes to mind.
Attempting intimidation by lawyer?

Friend of mine was repeated sued (frivolously) by a neighbor.
Finally he counter-sued. Neighbor’s lawyer tried to use that against them in court asking how much money they wanted from him. Friend said “Nothing. We just want him to leave us alone.”

They won.
Me, I’da gone for lawyers’ fees at least.

Much like California private beachfront owners
who try to block off and hog their own little piece of public surf and ocean….

This toad should be required to install a 6 foot wide easement,
effectively taking away 2 tiny corner triangles of his land.

Set these guys up on the government corners and let them put on a show jumping back and forth.

Teeterboard Act from Amaluna | Best of Cirque du Soleil – Bing video

Make it a 10 foot wide easement….
So the vehicles can get through, too.

Old tanker

Talk about a narcissistic personality with delusions of grandeur… Gonna be hard to prove diminished property value in court there. He obviously has a greedy freaking law firm ready to take his money for frivolous suits.

Anna Puma

For such a novel suit, the judge should find a novel way to punish the land owner and lawyer.

You’re right; it’s not as easy as it looks.

I hereby move that we deploy the Planetoid against one Fred Eshelman. Fuck this guy sideways with a pineapple.

Reminds me of the lawyer who ruined a drycleaner over a pair of pants. Too lazy to google-fu for a linky, but I know youse guys remember that one right?

Yep, the “Great American Pants Suit”. Pearson v. Chung, also known as the “$54 million pants” case. That dude definitely had a Bernasty attitude as well. And probably hated by more people than our favorite lawn dart.

Some problems have obvious solutions…?

On a completely different topic, a person I know is working on a novel. Here is an excerpt:

Some good ol’ boys in the midst of a property dispute with a cantankerous landowning bitch hire a guy with a vowel at the end of his last name to sneak a 22 caliber short in that someone’s ear in the dead of night in Minecraft.

I say it’s a bit of a run-on but some works d’art are too good to be fenced in by punctuation.

Oh, the “punctuation” is just fine.

“FOX News Media, Tucker Carlson Part Ways”

“FOX News Media and Tucker Carlson have agreed to part ways, the network announced on Monday.”

“We thank him for his service to the network as a host and prior to that as a contributor,” a FOX News Media spokesperson said in a statement.”

“An interim program, “Fox News Tonight,” will air at 8 p.m. ET until a permanent replacement for Carlson is named. “Fox News Tonight” will be hosted by a rotation of various Fox News personalities.”

“The last edition of “Tucker Carlson Tonight” aired on Friday, April 21. The show began airing in 2016.”

The SECOND ONE in One Day!!

“I am stunned’: Don Lemon fired by CNN, network disputes details.”

“Don Lemon says he’s been fired from his post at CNN’s “CNN This Morning,” which he co-anchored with Kaitlan Collins and Poppy Harlow for about six months.”

“The former anchor, who was on air Monday morning, shared the news in a statement on Twitter.”

“I was informed this morning by my agent that I have been terminated by CNN. I am stunned,” he wrote.”

“CNN CEO Chris Licht said in a statement that the network wishes him well and will cheer him on as he pursues future endeavors, echoing what he wrote in an email to CNN staffers obtained by USA TODAY.”

“After 17 years at CNN I would have thought that someone in management would have the decency to tell me directly,” Lemon added in his tweet. “At no time was I ever given any indication that I would not be able to continue to do the work I have loved at the network. It is clear there are some larger issues at play. With that said, I want to thank my colleagues and the many teams I have worked with for an incredible run. They are the most talented journalists in the business, and I wish them all the best.”

Who Knew.

Tucker Carlson and Don Lemon both let go on the same day.

Who Is Next?

Please, please, PLEASE be Joy-less Reid!

or Lawrence “…and Sailors” O’Donnell?!?

Good One!! 😉😎

“The Purge” begins. Who will be next?

President Elect Toxic Deplorable Racist SAH Neande

This Dude…😉😎🤭😏

The high I feel from both those idiots being fired is only going to make the low I feel tomorrow when Biden announces he’s running for re-election that much worse.

RGR 4-78

It would be incredibly funny if CNN hired Tucker to replace the Lemon.

Tucker used to work for CNN AND MSNBC!

RGR 4-78: It WOULD be funny if CNN rehired Tucker…It looks as if they are struggling to reshape their image!

Think about it, CNN hires Tucker, then Elon Musk buys CNN and fires everyone except Tucker, and hires everyone from now-woke Fox.

RGR 4-78

That is a liberal head exploder if I ever heard one. 🤔

Maybe they’ll bring Robin Meade back she;s better looking than he is.

And yet a THIRD departure announced today:

Susan Rice to step down as Biden’s domestic policy chief (

Possibly the most consequential move of the three.

Yep. We saw that as well.

Can’t wait to get rid of The Big Guy…

She led all the big bite me failures. Immigration, gun control, student loan freebie program etc.

Some sites are reporting Carlson was let go because of his role in causing the huge settlement FOX just agreed to.

Wasn’t he the one who ripped someone a new asshole over the allegations? Sidney something?

We saw the same thing..

Gonna be interesting. We still think Fox made a huge mistake on the decision.

Whoever hires him could own the 8-9 pm slot.

Just think what he could do for a month on Jan 6 video.

I am glad I own no Fox News stock…..

It is down a small amount today but it’s been pretty steady for the year.

“NYC Exposes Its Own Folly On Climate Change”

“City Comptroller Brad Lander no doubt thought he was helping the climate war (and scoring points with warriors) when he boasted of his “dashboard” on climate progress last week, in advance of Saturday’s celebration of Earth Day.”

“Instead, he wound up exposing the utter folly of New York’s pricey efforts to lower Earth’s temperature.”

“Start with Lander’s revelation that the city’s reliance on fossil fuels for power has grown since 2019 — from 75% to 89%.”

“That’s largely thanks to the closure of the Indian Point nuclear plant, which accounted for 25% of the city’s juice.”

“The city plans to make up for that by expanding solar, with 72 megawatts installed last year, putting Gotham on pace to meet its 2030 goal.”

“Yet that goal,1,000 MW, is just half of the 2,000 MW Indian Point could put out.”

“And just a fraction of the 13,000 MW the city needs.”

“Lander’s term for the goal, “modest,” is the understatement of the century. (And Indian Point didn’t need cloudless skies to generate power.)”

“There’s more: The city is “committed” to limiting its greenhouse-gas emissions to 12 metric tons a year, an 80% cut by 2050, the dashboard notes.”

“Yet over the decade since 2011, it brought them down by less than 4%, to 53.9 metric tons in 2021.”

“Man Sucker Punches Woman During NYC Earth Day Event Feet Away From Mayor Eric Adams: Video”

“The video shot by the New York Post shows the unnamed woman kicking and dumping trash bags along Roberto Clemente Plaza on Willis Avenue during Saturday’s “Car-Free Earth Day” celebration in the South Bronx. She is seen eating a slice of pizza as she does so with several bystanders looking on in disbelief.”

“An unidentified man in his 60s, wearing a cap and sunglasses, approaches her, seemingly telling her to stop. She is seen standing with her hand on her hip and eating her pizza as the man continues to speak to her, his exact words unclear due to nearby music.”

“As he walks away, the woman begins to pull her pizza apart and throws pieces at him. She then grabs another trash bag and begins to spill its contents before turning around and yelling, “F— off my block! What the f— is up?”

“The man then turns around and punches her in the face, knocking her to the ground. A number of onlookers audibly react to the incident, yelling, “Oh!” and some even jump in to separate the two, including members of the mayor’s security detail and event organizers.”

“The woman gets up and signals to him as she walks away. She then yells in his direction before launching herself at him. One person pulls her back by her jacket as another individual jumps in between her and the man.”

President Elect Toxic Deplorable Racist SAH Neande

Big mistake.
She should have never “poked the bear”. That “bear” (old man) poked back – hard!
And bystanders should not have gotten between the two of them, just let them go at each other.

13,000 MW of PV solar is about 6x the size of the world’s largest solar farm in India.
To get that kind of generation in NY state latitude would require about 140,000 acres, or just a hair under 220 square miles.
That’s roughly 10x the size of all of Manhattan Island.
Assuming it’s a sunny day. And of course, no battery system to store energy for night, etc., on that kind of scale exists anywhere. Not even close.

It’s About Time!

Chicago Must Rehire, Pay Back Wages To Workers Punished Over COVID-19 Vaccination Mandate: Judge”

“An Illinois judge ruled that the city of Chicago must rehire and pay back lost wages of unionized city employees who were fired or disciplined for violating COVID-19 vaccination requirements.”

“The decision applies to unionized city of Chicago employees working as carpenters, bricklayers, plumbers, electricians, machinists, and other job categories.”

“Affected employees must also be paid back lost wages and benefits with 7% annual interest, according to the ruling.”

“In 2021, Mayor Lori Lightfoot announced all city employees must be fully vaccinated. She warned there would be “consequences” for any city employee who wasn’t fully vaccinated by that October.”

“Employees who fail to report their vaccination status by October 15, 2021, will be placed in a non-disciplinary, no pay status,” a press release stated at the time.”

I wonder if Illinois tax payers will be stuck paying these workers that Beetlejuice laid off. You know, cause Chicago is broke.

A FAA fact, all the airspace above your property is public and controlled by the FAA.

Skivvy Stacker

So, basically, if I fly an airplane over that little patch of grass, I diminish the value of it?

Good thing I don’t know how to fly an airplane. I’d aim it for his fuckin’ house, and parachute out.

Yeah, well the guy that was the expert on that sort of thing has been maintaining a steady heading, a constant air AND ground speed of 0, and a constant altitude of -6’ AGL for a little over 5 years now. Steady as she goes, Dan! Steady as she goes!
