Grand jury charges Nebraska bar owner in “protester’s” death
The bar owner who defended himself against an attack during “civil unrest” (i.e. riots) in Omaha back on May 30th has now been charged with manslaughter and other charges. Initially, the district attorney declined to pursue charges, but after public outcry took it to a grand jury, which has now levied charges.
A grand jury announced its decision Tuesday in the May 30 shooting of 22-year-old James Scurlock on Tuesday.
Douglas County Attorney Don Kleine initially declined to file charges against Jake Gardner in the shooting, saying he had reviewed witness statements and video and believed the bar owner acted in self-defense. But Kleine was criticized for his decision and asked the grand jury to review the case.
Special Prosecutor Frederick Franklin said Tuesday that the grand jury reviewed additional evidence that Kleine didn’t have, including texts from Gardner’s phone, messages on his Facebook profile and his interactions with bystanders before coming into contact with Spurlock. He declined to provide specifics of what the new evidence shows except to say it undermines the self-defense theory.
“There was significant evidence that was consistent with there being an intentional killing by Jake Gardner, and that evidence comes primarily from him,” Franklin said.
Gardner was also charged with attempted assault, making terroristic threats and using a gun to commit a felony.

Two videos depict scenes from the incident. As described by prosecutors, Gardner’s father asked protesters outside the Gatsby bar to leave and pushed one. An unidentified man can be seen pushing the elder Gardner back, and the son intervened. Wayne [attorney and state senator, representing the Scurlock family] claims Scurlock was not part of that group.

It’s abhorrent that the right (I’d say obligation but) of self defense is being destroyed by some syllogism ‘reasoning’; we’re just because ‘unjust’ state-committed murders, therefor our murders are just and if things don’t work out in our frame of justice, we’ll have the state do our murdering.
It’s almost like we’ve see this played out before.

Okay, I can’t figure this one out, and if I ever have to sit on a jury where this kind of thing is presented, I may ask what planet I’m on. Because this can’t possibly be the planet where I was born.
You can pack a Grand Jury with all sorts of Anti-gun folks, who feel that anyone who says they are willing to defend themselves and others (i.e. someone willing to join the military) are just murders waiting to happen.

“Always make sure you get a good lawyer.” Yepper, and that is even more critical now. The “lawer” for the dead terrorist is also a Senator, so you know he is going to cherry pick the Judge and the Jury. Any reasonable person would think that being assaulted by 3 individuals would be more than justifiable to defend yourself with deadly force, but Omaha, like many other cities, has become very “diversed and gentrified” of late and all the people that would agree with us have either moved out of town or will be excused as jurors.
Remember too, that Warren Buffet has a lot of pull there and he has totally embraced the whole SJW Mantra.
I’ll try to keep up with this one. I’m sure the defence is going to delay for a good bit, but the prosecutor will be under intense political pressure to get this kangaroo court in session.
It’s been said you can get a grand jury to indict a ham sandwich. Since the grand jury is presented only information from the prosecution, it’s a very one-sided affair.
