MAN RELEASED WITHOUT CHARGE AFTER FATAL STABBING IN MT. VERNON DEEMED SELF-DEFENSE

JEFFERSON COUNTY — A 58-year-old man has been released without charge from the Jefferson County Jail, after being arrested in connection with a Wednesday stabbing death that has been deemed self-defense.

According to Jefferson County State’s Attorney Sean Featherstun, after reviewing the evidence relating to the stabbing death of 53-year-old Mt. Vernon resident Kevin Foulks, he declined to file formal criminal charges against George Rush.

“Mr. Rush and only the other cooperative witness in this case gave accounts which, if true, legally justify Mr. Rush’s actions based upon established legal principles of self-defense,” explained Featherstun, “Both witnesses told detectives Mr. Foulks was an acquaintance known to them who was aggressively pursuing Mr. Rush with a board he intended to use as a weapon. The physical evidence at the scene corroborates their account.”

Featherstun added that Foulks was able to speak with police but stated he was stabbed by an unknown person. No other material information was provided.

“All other potential witnesses refused to talk to police, and there is simply no evidence to put forward which would rebut the self-defense claim. I urge members of the public to cooperate with law enforcement, as the pursuit of justice in criminal depends upon the same,” he said.

Legally blind man defending his home shoots suspected burglar

LUBBOCK, Texas (KCBD) – One person was shot after what the victim believed was an attempted break-in Wednesday night in Central Lubbock.

Police were called to the 3200 block of 35th Street around 11 p.m. The homeowner, 63-year-old Jimmy James, said he heard someone trying to kick in his door. The homeowner shot through the door and injured one person.

James said he’s lived in Lubbock his whole life and since moving to the duplex in September 2019, last night’s invasion wasn’t the first time someone has tired to gain entry to his home.

“I’ve had two so far,” said James. “One of them (happened) the second day after I got here. Somebody tried to get in. A couple of days later somBy: ebody came in and tried to get in with a key. Then when they found out someone was here they said they had the wrong apartment.”

James is in hospice care and is legally blind. He said someone started kicking down his door last night.

“And then, all of the sudden, BLAM and I said, ‘what the hell?’ And I ran and grabbed my gun and then just WHAM they hit it again. And the door flew open and I started shooting,” said James.

James told police that if he did not grab his gun there is no telling what the intruder could have done. The report says James did not see who kicked in his door, but due to his medical disability, he was in fear of his life.

Court of Appeals affirms immunity for Colo. Springs ‘make my day’ killing

A man who killed a homeless intruder in his apartment building is entitled to immunity under the law that allows for deadly force in the face of perceived threats, the Colorado Court of Appeals ruled on Thursday.

Colorado’s “make my day” statute permits the occupant of a dwelling to use deadly force against someone who unlawfully enters if they are committing — or intend to commit — a crime. The resident is immune from civil or criminal liability if he or she “reasonably believes that such other person might use any physical force, no matter how slight.”

Patrick Rau and his girlfriend lived in a multi-unit building in Colorado Springs. In January 2017, Rau’s girlfriend noticed that the basement door was open and told him that a homeless man may be inside. Rau took his gun and a light to the basement, where he found a sleeping Donald Russell.

After Rau nudged him awake, Russell became belligerent — throwing objects around the room. Rau said he would “count to five” and then shoot if Russell did not leave. Rau followed through and fatally shot him.

Prosecutors charged Rau with second degree murder, but he sought immunity under the “make my day” provision. A district court agreed, but prosecutors appealed, arguing that the basement was not a “dwelling” covered under the law.

Although in my opinion studly Mr. Rue had no business going into the basement in the first place.

“Did not see…” Well duh! The man’s legally blind, daHell did they expect. Good on him for defending himself.

Colorado…sigh…! I think the legal system there has smoked too much of their latest crop. Was debating including a corner of Colorado in my Way Out West Walk/drive about. One of our miscreanted d’weeds had extended an invitation to start me on my way to a state of intoxication. It would have been a dirty job, but somebody has to do it.

Does the Ruger float better than a Kahr? It should, being made of plastic and fiberized glass. Best way to conceal carry something big enough to do the job is adjust the way you dress. Oversized untucked shirts always works for me, but then again, I can get away with it. If one must wear a suit, get a lightweight poplin type with a good shoulder rig. For many a year my work would require me having a coat and tie available as needed, even in the Southeast heat and humidity. Improvise, adapt, and overcome.

I decided act.” He grabbed an extra flag from his home and drove 20 minutes by motorcycle to Post 282 to replace what rioters attacked following a recent peaceful demonstration for Black Lives Matter. “I felt like somebody needed to show that it’s OK to be proud of that flag, proud to be an American,” Cory said. “I just wanted to show that I was proud.” Cory has seen the American flag stepped on and burned before, but watching it raised up the 60-foot pole in flames “hit me in a different spot,” he said. So the ride over to Post 282 was filled with self-talk of “you have to do this … you’ve got to get this flag up. It was a passionate thing I had to do.” Upon his arrival Cory discovered that the pole rope had also burned so he called his brother Derek, a U.S. Marine veteran, and asked him to bring a new one. With a new flag and rope in hand, Cory and Derek tried to get a ladder truck from the fire department but to no avail. Without hesitation, Cory tied the rope to his belt loop and climbed the pole.
