The Michigan Department of Health and Human Services issued a Health Protection Order on May 8, against Karl Manke’s Barber & Beauty Shop in Owosso, and made the move for the temporary restraining order in court after he did not close.

Manke reopened May 4 in defiance of one of Gov. Gretchen Whitmer’s dozens of executive orders that have, among other things, closed barber shops and salons.

“I’d gone six weeks without a paycheck with no money coming in. I’ve been in this business 59 years…I’m 77. I’ve always worked,” he commented.

“These executive orders are not a suggestion. They’re not optional, they’re not helpful hints.” said Governor Whitmer.

The Michigan Attorney General has a different idea.

State seeks new court hearing after judge rules in favor of Owosso barber shop

OWOSSO, MI – The Michigan Attorney General’s Office wants a new court hearing on a public health order seeking to shut down an Owosso barber.

The state wants the hearing after Shiawassee County Circuit Court Judge Matthew J. Stewart turned down a request Monday, May 11, from the Michigan Department of Health and Human Services for a temporary restraining order that would have required Karl Manke to cease all operations at his shop.

Ryan Jarvi, press secretary for Michigan Attorney General Dana Nessel, said Tuesday that the state is seeking the court hearing as soon as possible.

David A. Kallman, Manke’s attorney, said he’s been in communication with the Michigan Attorney General’s Office and the court.

A Zoom meeting is planned for Wednesday between the lawyers and Judge Stewart to determine if an emergency preliminary injunction hearing will take place or a status conference is set for a future date to hear arguments from both sides.

“Our point of view would be, what’s the point of that?” said Kallman. “The judge has turned down your first emergency injunction.”

So whadda you gonna do, check her DNA and find out she is is a blood relative of Lois Learner? Evil does cross the genders after all.

      Executive orders are only orders to the executive branch– as the general public (not being employees of the executive branch) can’t be fired or suspended for not following them, so what?

    Flattening the curve wasn’t about saving lives, it was about not overwhelming the hospitals with a spike by spreading the cases out over time.

    For the governor to say that this is about saving lives seems to show a misunderstanding of her own policies.

    Couple of minor points.

    First, the idea that the judge “ruled in favor of” Manke is a little misleading. His attorney had argued that the premise of the proposed cease and desist order was illegal and wanted the whole thing dismissed outright.

    The judge refused to do that and so Manke through his attorney Kallman then argued that they had a right to prepare briefs and make a more complete argument against the cease and desist order.

    The judge bought that argument as he should have.

    In other words, Manke lost and won in court.

    Manke has two citations against him that are due to be heard June 22, which should be interesting.

    Finally, it’s a minor point, but Manke did not “lose his license” as the license was not permanently revoked. The license was temporarily suspended. There’s a difference.

    The sad thing about that is that in order to suspend or revoke a license under Michigan law, there must be a complaint to the Michigan Department of Licensing and Regulatory Affairs. (LARA)

    There was no complaint made.

    Secondly, as people are starting to note, in order to suspend a license, there must be violation(s) of the licensing regulations. Defying an order from the governor is not a licensing regulation and there is nothing in the law that allows the governor of Michigan to unilaterally add regulations that affect the license. The suspension is a back room, closed door deal in which the State and LARA violated their own rules. In addition, a suspended license must have the ability to be appealed and LARA is denying that appeal at this time. (License revocation requires a hearing before the license can be taken away.)

    Whitmer and other governors generally have some ability to respond to epidemics, but in this case, Whitmer has gone so far over the line that it is hard to believe. She and the state of Michigan are acting like petulant children rather than Constitutionally bound (both state and Federal) protector of rights.

    While Whitmer is being sued by the GOP, (which most people think will go no where) she is also being sued by doctors and surgeons in the state. That suit has traction and will be very interesting to watch.

      The outcomes of those suits depends on where the case is heard, and by whom. If Manke’s stays in Shiawasee County, he might do all right. If Gretch and Nessel get it moved to Ingham County and gets the Doctor’s suit into Ingham County Circuit Court, I doubt Gretch will get reined in.

    Anyone left that still thinks this is all about the control of a bug v control of the people? Besides LC and seagull that is? Didn’t think so.

    To get my FIRST Haircut since last year, my girl barber had to squeeze me in between “appointments only”. take my temp, record my name, time of day, a phone number, and insure I had a mask on. Violation of any of the above would mean, shutting down her shop, loss of license,and a healthy fine. To save her time and aggravation, instead of trimming the historical sideburns with goatee look, I told her to just shave the damn thing off with her clippers. It ain’t like the damn thing won’t grow back right shortly. As mentioned in the ROT, she has been shut down for 2 months now with ZERO income. And no, the power company, the landlord, and the city water bill (monthly minimum no matter what you use) still came due. At the schedule she is forced to have right now, she will not even break even on expenses, much less pay the past due overhead, or pay herself hardly anything.

    • Got my haircut last Wednesday and it was either get it cut or buy a violin like my Mom used to tell me. Since moving to Florida after I retired, I go to the Barber shop every other week for a trim. Right now he is only using the clippers and scissors and down the line will go back to using the hot shave cream machine and straight razor on the back of my head and around the ears.

      I mostly have my daughter give me a hair cut with our own clippers. Thats what I did recently. No waiting in line and making an appointment and all of that. The two barbers I used to go to are long dead. When I go to Florida I have a nice lady at the Marion county flea market give me a haircut. I sure hope John James wins his Senatorial race out there in Michigan. They need at least one real leader in their government .

      The blog for which I contribute wondered whether Owosso would be the modern day Lexington and Concord. The day after the judge decided to issue a cease and desist order, the Michigan Militia showed up.

      The other day when the police showed up to serve the suspension of Manke’s license, they blocked the entrance to the shop itself.

      King George did not back down. “Queen Whitmer” is exhibiting the same stubbornness and power hungry look in her eyes.

      Like you, I hope this doesn’t get violent. Perhaps the best thing is that the whole incidents get overtaken by events elsewhere making Whitmer as irrelevant as she should be.
