Court: DC’s “good reason” restriction ain’t good enough

U.S. District Judge Richard Leon ruled that the District of Columbia’s “may issue” restriction that a citizen needs a “good reason” to apply for a permit to carry a concealed weapon in the district didn’t meet the Supreme Court’s intentions in Heller v. US, according to the Washington Times;

“In Heller, the Supreme Court’s unequivocally [sic] asserted that ‘the enshrinement of constitutional rights necessarily takes certain policy choices off the table,’ ” Judge Leon wrote. “The District’s understandable, but overly zealous, desire to restrict the right to carry in public a firearm for self-defense to the smallest number of law-abiding, responsible citizens is exactly the type of policy choice the Justices had in mind.”

Leon’s ruling is a preliminary injunction that prevents the District’s police chief from denying permits to folks who can’t prove a good enough reason to request a permit. Other states, like Maryland, face the same types of treatment in the courts. In Maryland, the state police require proof that an applicant is in imminent danger before they can apply for a permit.

It may be the end of the world! I never thought I would see the 9th Circuit issue such a decision.

“Just as we have a duty to treat with suspicion governmental encroachments on the right of citizens to engage in political speech or to practice their religion, we must exert equal diligence in ensuring that the right of the people to keep and to bear arms is not undermined by hostile regulatory measures.”

Here in Texas most recently it was blood running in the streets due to open carry. Almost 6 months later not only no blood in the streets, have not seen ONE person open carrying…

So on Jan1 of this year, my state (Tejas) enacted open carry.

In our local facebook neighborhood group, someone finally reported an open carry sighting! It was a dude on a bicycle at the local lake bike trail, legally practicing his right to keep and bear arms as protected by the 2nd Amendment. Oh the horror and outrage, although no one was shot either accidentally or intentionally. When it was pointed out that on this same trail recently, a middle aged white male jogger had been killed and decapitated with a machete by someone who was probably (temporarily) insane, the response was: “that was an isolated event that almost never happens.” As you know, I love irony.

Chances are if DC Chief Lanier decides to play along (as if THAT would ever happen), she’d make sure its more difficult than it is now to apply for and be approved for a conceal-carry license.

If she has it her way, it’d take 5 years to get a license in that city.

No kidding. The only reason my transfer went through as quickly as it did was because there was a court case going on where Maryland had dragged their feet for a year on three people buying guns. One of whom was an active duty Soldier.
