Monday morning feel good stories
In New York City, Zachary Sam and Phillip Pierre met for a Craig’s List exchange over a pair of $200 sneakers. Sam decided that he didn’t like the terms of the arrangement, so the 17-year-old pulled out his gun and stole the shoes from Pierre. Sam took off down the street with his ill-gotten booty and Pierre fought back with the only weapon he had – his SUV. He ran the thief down separating him from his arm. Both Sam and Pierre are in custody.
In College Station, Texas, a number of residents caught 18-year-old Devin Ragsdale looting their automobiles. They convinced young Ragsdale to stick around for the police. I can’t wait to see that mugshot.

Phillip Pierre was able to successfully disarm young Zachary Sam.
At least old Zach did not have to pay an arm, and a leg.
No, seriously though, it is to bad they arrested the victim in this case. He should have been alloewed to get out of his car and beat Zach to death with his own arm.
I dislike it as well, but the argument could be made that Zach was running and not threatening Phillip any longer.

And the argument can be made that Zachary now may not commit another robbery, armed or otherwise.
But he’s now more qualified to commit unarmed robbery. 😉

The irony is that now Zachary is unable to tie his sneakers.

Pierre could successfully get acquitted if he was merely trying to follow the robber and the robber, seeing him follow, decides to go for his gun again.
Then running him down would be self defense.
Interestingly, if the robber had been killed by the robbery victim, the NY defense of extreme emotional disturbance would have been available. It appears, however, that under NY law, that defense is not available because the robber lost an arm, not his life. On the flip-side, in NY, if the initial aggressor withdraws (i.e., runs) and the victim pursues and aggresses using deadly force, the bad guy can use deadly force to defend himself from the victim who is now the bad guy and, if the original bad guy kills the original victim (now the new bad guy) the new victim (old bad guy) can argue self defense and walk on the killing but not the original crime. Crazy stuff.

Just kidding,unfortunately, you are probably correct. And there must be a line of vultures, I mean attorneys, circling the hospital where young Zachary is recovering, volunteering to represent him (for 30% of the award) in a lawsuit. And, unfortunately, he will probably win.
Yeah, he’ll file a civil suit and, what with losing his arm, he may end up on probation out of judge or jury sympathy in the crim trial. Then, he’ll collect SSD while he’s awaiting the civil trial. Of course, the robbery victim can sue too but the sympathy vote still goes to the one-armed, armed robber.

errr.. maybe not. I’m thinking that all the highways that border Texas should be outbound only. It should not be so easy to get into Heaven.
