The Burns, Oregon standoff; you’re judged by your company

I’ve been fairly busy this morning taking calls and emails from the media on this standoff just south of Burns, Oregon. Of course, the media wants to talk about Ryan Payne, Blaine Cooper, Jon Ritzheimer. I’m more than happy to help the media get the story right, and, as many of you already know, I have a real hard-on for these Oathkeeper and militia types. They are rife with phonies and they generally present an image of veterans that is not at all flattering.

But, see here’s the thing – where was the media’s concern in regards to all of the Occupy Wall Street phonies that we busted? Like Jay Polk the “retired Special Forces Master Sergeant” that fooled the media and the occupiers into believing that he’d been killed on a secret mission to Syria. I spent weeks trying to get the local San Diego medias attention, not even a nibble.

I’ll tell you a secret – I think the Hammonds got a raw deal from the government. I don’t think they should be in prison. However, I am loathe to associate myself with those clowns who took over the Malheur National Wildlife Refuge building. If anything, they’re forcing the prosecutor and the judicial system to enforce the Hammonds’ imprisonment. If they were considering any leniency, that possibility has evaporated lest the prosecutors look like the militias are having an impact on their decision.

It doesn’t help that many residents of Burns don’t want them there, including the Hammonds. Especially when you have people like Ammon Bundy making proclamations about how they’re willing to die and to kill federal officers to remain on Federal land. When you have people like felon Blaine Cooper in the wings, you’re not doing yourselves any favors, either. I haven’t seen any of the guys from Josephine County Oathkeepers like Joe Rice there yet, but I’m sure they’re around there somewhere – too much media in the area for them to ignore it.

Honestly, I hope this turns out better for the Hammonds that it looks like it will right now. But as long as these phonies in their multi-cam intimidation suits and their low drag gear are hanging on to the issue, I don’t think it will help the Hammonds much at all.

Joe rice was on KMED this morning doing an interview, he is in Burns but like the Oregon 3% is staying away from the occupation, they can’t really take too much more negative publicity. Oddly enough both the Oregon oathkeepers and JoCo oathkeepers FB and websites have been erily quiet since last summer’s mine incident.

While the occupation routine seems like the wrong way to approach the situation, it doesn’t change the situation, that members of a federal agency have pursued a years-long vendetta against the Hammonds family. Their sentence came from a show-trial on utterly absurd charges, and it was retroactively (!) extended three years after the Hammonds served the original, still preposterous, sentence.

The whole situation reeks of abuse of power. It’s a hell of a lot more than a mere raw deal. I may not agree with the actions of these militia goofs, but I fully understand why they feel the need to do something. How is one supposed to respond when members of our government’s sprawling bureaucracy want to play god with their power over other citizens? What is the proper recourse when those citizens are the target of a vendetta and denied their constitutional right to redress, or even recognition, of grievances?

They started 3 illegal fires on federal land. They admit that two of the fires may have endangered campers in 2001 and fire fighters in 2006. The 2001 fire was started to cover up evidence of their poaching on federal lands.

The younger Hammond, with his father’s full knowledge and consent, also sandpapered his nephews chest to remove some initials the kid carved into himself with a paper clip.

The Feds accused the Hammonds of setting the fire to cover up an illegal poaching operation on the Wildlife Refuge. The Feds went after them under a law passed after OKC which was Terrorism. Of the rest, IDK.

The Hammonds if i get it right claim they were setting a backfire to try and save their cows and buildings after the Feds set a fire on the refuge. Their fire got out of control and burned about 140 acres on the refuge. Anyone think 6yrs or so in the slammer a little much for an out of control grassfire that burned 140 acres?

Sounds to me like the Feds want the Hammonds land to add to the refuge and the Hammmonds are not leaving so they are going to get hammered until they do.

Commenter “MrBill” linked to a great article summarizing the case in comments to Jonn’s earlier article about the standoff. You might want to read that, along with the legal documents I linked in comments there (the appeal decision and the sentencing hearing transcript).

The Hammonds are indeed be getting royally hammered, and it’s arguable whether or not their sentence is “too strict”. But 5 years (not 6) is the mandatory minimum under Federal law for the crime of which they were convicted: deliberate arson of Federal property, 18 USC 844(f)(1). They’re also getting credit for time previously served.

As I’ve said previously: in the western US, wildfire is – to paraphrase the current VP – a “big (freaking) deal”. Having lived in the western US for a number of years, I don’t have any problem with someone convicted of deliberately setting a wildfire doing felony time.
