Bergdahl’s lawyer says he’s in danger
According to ABC News, Eugene Fidell, Bowe Bergdahl’s lawyer says that the fellow who went over the hill to the arms of the enemy and spent five years with the Haqqani Network insugent group in Afghanistan, is in danger of retaliation from his fellow soldiers;
Bergdahl’s civilian defense lawyer Eugene Fidell said former military and intelligence officers appearing in conservative news media had vilified Bergdahl and stoked hatred over social media such as Facebook over Bergdahl’s perceived misconduct while in captivity. Fidell provided examples from the “Bergdahl is a Traitor” page.
“In short, it has been ‘open season’ on SGT Bergdahl,” wrote Fidell, a military law veteran and past-president of the National Institute of Military Justice, who is leading the soldier’s defense. “His immediate commander believes he is in physical danger, and therefore has required since last year that he be accompanied by NCOs [non-commissioned officers] whenever he leaves Fort Sam Houston.”
Well, there’s another solution – don’t let him leave the military base.
Actually, in my opinion, Bergdahl and his lawyer should be thanking those soldiers because they kept their mouths shut about the circumstances of his walkabout until he came home. If he had lost his value to the Haqqani, they would have wasted no time in the separation of his head from his shoulders. The only reason that he’s alive is because those soldiers that he fears didn’t do their media tours while he was a captive.

Ticks me off, too. They could easily revoke the E-5 promotion if he has not completed the required NCOES since he’s had plenty of time to do it. Just think – he’s getting paid to stay out of sight.
Whatever happens, it will all be based on the fact he shouldn’t have been in the Army in the first place based on his previous mental problems and now he has PTSD so he can’t be held responsible for anything.
Rather than doing the one honorable thing he could do to save us all this B.S., I predict a book in the near future based on his political and military expertise.
That and/or he’ll become a columnist or a “Military Analyst” for some liberal media entity.

He’s not up for promotion. His Promotion to Sgt was due to him being a POW. Service members in Captivity are promoted automatically when they have Time in Grade.

Meh, training accidents happen, but I’m sure they’re watching out for him far more than his lawyer says. Bergdahl is the type who would screech while playing the victim card to the media if he ended up with so much as a twisted ankle from a PT run! Many Army Vets have seen turds like Bergdahl receiving “Blanket Parties” for far less than what he’s done, real Soldiers detest blue falcons, let’s not forget that fellow Troops in his unit ended up KIA and WIA on missions searching for him.
Well ignoring the whole should soldiers discipline themselves discussion even the smallest action taken towards him at this point by his fellow soldiers will only make the Army look like the ones in the wrong. ie) the horrible organization he was trying to get away from; “the biggest joke in the world” I think he put it as.

I’ve yet to read or hear about Bergdahl ever expressing even a smidgen of remorse over those who were killed or wounded searching for him while he was on his happy hippie sojourn, FUCK HIM. And if they’re that concerned about his safety then IMHO he ought to be in pre-trial lockup or under 24 hour watch and restriction.

Now that I think of it, maybe the Post Commander is more concerned with PFC Bergdahl disappearing again than for his safety. Of course that couldn’t be the stated reason because all his “supporters” would be whining about how mistreated he is without a conviction, etc. How much longer do we have to wait and tie up Army resources on this twit?
I don’t believe the soldiers around Bergdahl are dangerous to him — I think they’re too disciplined for that. What they are being is inconvenient, because they’re keeping the real story about his desertion alive. There are people, much higher up than Bergdahl or his lawyer, who want to see that story die quietly, without mess or bother. The soldiers who continue to speak out are now being branded as dangerous to discredit them — it’s as simple as that.
Maybe not the Soldiers around him, but I bet the cooks in the chow hall have got this.

Regardless of how many times I parse the data I find I am completely unable to identify any situation under which I could really give a flying fuck about what happens to this pile of deserting turd…
A- I do not give a flying fart in space what happens to berdbath, period, as long as he is taken off my tax dollar.
B- Why did he enlist in the Army in the first place?

I for one am glad that the private feels fear for his ow safety and that the Army has assigned him an NCO escort. At least there will be a responsible person there to guard the coats of his assailants while they give him that which he so richly deserves.

Be careful…pretrial confinement triggers very powerful speedy trial rights under Article 10, UCMJ. Given the slowness of this prosecution I would not want to see them forfeit the case under those standards.

Almost certainly not. The restrictions would have to be severe enough to count as “arrest or confinement,” and a simple restriction to post (equivalent to pulling pass privileges) doesn’t meet that threshold.

In that case, I have a suggestion for the CO of Bergdahl’s unit regarding Bergdahl’s future health and safety. (smile)
The other hurdle, though, is to make sure you can establish that the intent really was “health and safety” as opposed to “punishment before trial.” Under Article 13, a judge can dish out beaucoup sentence credit for almost anything done with punitive intent.
This has been applied in ridiculous ways by trial courts…like seriously considering whether a suicide watch was “punishment,” or whether taking someone’s weapon away in a combat zone was “stigmatizing” and therefore punishment. And sometimes (not too often happily) judges do hand out credit they shouldn’t. So, my point is, just make sure the motive is right and you can prove it.

It’s questionable that Bergdahl rates that title – or the medal. Defectors rate neither the title nor the medal, even if they’re later held prisoner by the side to whom they defect. And published reports give indications that Bergdahl may well have been a defector as well as a deserter.
That sideshow trip out to that pot growing operation will turn up in the AR32 hearing. Bet money on it. When I heard he was out caught out there, first thought was who in the fuck signed off on a pass for him. Other thought is, this could drag out until after the elections just in case someone decided to intervene on his behalf. Pardons seem to be a real popular thing..
