I really love the “Other ribbons upon proper request”. Ribbons? I have awards…and a continuation sheet. And yeah – the tiny font to cram all the super-duper crap on one page is a nice touch.

I noticed the sent to VA check block was checked. I hope someone investigates this with the VA to make sure this bozo is not receiving any undeserved benefits. One thing I have learned is that the VA does not train their C&P examiners how to read a DD-214 or recognize a forged one. In reality, that should be pre-screened. However, when filing a claim the veteran – real or imagined – can upload all their own documents online. And of course the validity of those documents may never be called into question.

That’s a lot of wounds.

My son couldn’t serve in the military. Born a 1 lb 3 3/4 oz 15 inches five months along, nurses didn’t cover both eyes with the mask while under the Billy light. Blind in his right eye, small bladder he finally came home one year nineteen days later. Took two days in a temperature controlled motor home bought to bring home. Straight to the local preemie hospital with a lung infection for another six weeks..after college taking criminal law classes he decided to join the Army to use after VA benefits to law school. He wanted to be a Ranger but eye site and bigger bladder a must. He still kicks himself for not taking a clerk position.
After grants and loans he finished law school. He only takes cases for any military personnel who is denied visitation rights to their children.
I was floored that a Sgt who was out country and his wife got pregnant by another military fella and although DNA proved he wasn’t the father, the Army still garnished his wages. The first child wasn’t his either. As long as the ex doesn’t marry, she’s also entitled to spousal support for the ten years they were married. It put a strain on his next wife/children and she has to work. WHY DOES THE MILITARY DO THAT? Anyone have a answer?

The Army doesn’t garnish anyone’s wages. Family law issue, including paternity, child support, and spousal support, are within the jurisdiction of state courts. DFAS will honor legitimate orders of state courts, but won’t garnish anyone’s wages on its own initiative. If anyone is being done wrong in this regard, his/her remedy is in state court. If your son is an attorney he could have told you this.

It’s possible that your reference to “spousal support” might refer to the ex being awarded a portion of the servicemember’s military pension in the divorce. If so, that’s considered a division of marital property, not spousal support (aka alimony). This was authorized by Congress in the Uniformed Services Former Spouses’ Protection Act (USFSPA)which was passed in 1981.

A clarification – USFSPA does not say that a portion of the military pension HAS to be awarded to the other spouse, it only states that if the couple has been married 10 years or more, and 10 years of the marriage fell within the military spouse’s career, the court can order that be sent directly from DFAS. The division of the servicemember’s military pension is strictly up to the court.

If a man assumes the responsibility of being the child’s father he is considered to legally be the father, and is held liable for support.

It’s pretty much a universal rule that a child which is born during a marriage is presumed to be a product of that marriage. So if a guy marries a girl who’s pregnant by another man, and she then gives birth, the new husband is presumed to be that baby’s father and will be legally responsible for the kid unless something is does to contest paternity. Procedures, time limits, etc., for contesting paternity vary from state to state. Could a man be held responsible for a stepchild that the wife already had at the time of marriage. I’m not a family lawyer, but such a result seems mighty odd unless the man has done something to affirmatively take responsibility for the stepchild, such as adopting him/her after the marriage.

As an commanding officer I rarely had to chew anyone out as our unit was comprised of senior NCO’ lowest rank was an E-5.

To be eligible one must attain the rank of E-5 or higher which meant having significant time in service and a commitment to merit receiving the necessary training to carry out operations.
