WWII paratrooper forced from home, must exhume his wife (UPDATED)

KAJ18 reports that Renn Bodeker, who just lost his wife to cancer last year, is being forced from the home where he and his wife lived most of their lives after he returned from the Second World War;

“Because of the medical bills…they really started toward the end…it wasn’t any great amount that we were in debt for, [but] we filed bankruptcy and it just blew up from there,” Bodeker said.

He lost his house in bankruptcy court, and recently found out that he has prostate cancer. The land on which the house stands also includes the resting place of his wife, where Bodeker had also hoped to be buried one day.

“I don’t want to be away from my wife,” an Bodeker said.

Thanks to the help of some friends, Bodeker has already taken all of his possessions out of the home, but now he must exhume his wife’s body within the next 30 days.

Someone sent us a link to the story the other day, but it was only showing up on Ron Paul blogs and Oathkeeper links, so I wasn’t all that ready to throw myself into that crowd, but Ben reminded us today about it and I found this link which provided an actual solution for people so moved. I remember a time when filing for bankruptcy actually helped. Recently, I’ve had to wonder what it does except make money for lawyers. I’ve heard absolute horror stories, and this is one of them. A similar situation happened to a neighbor of mine who was 80 years old. She lost everything, and ended up living with her deceased husband’s sister to make ends meet. That was AFTER she declared bankruptcy!

Then Senator Joe Biden (D-JPMorgan), re-wrote the bankruptcy law in the 90s so that folks who file for bankruptcy still have to pay.

It’s why so many people walked away from their homeloans and major debts: bankruptcy isn’t an option anymore.

PN, it depends on what Chapter is filed. Chapter 7 does away with your debts, except those a person wishes to keep, i.e. house, car. It’s not that simple, there’s a means test. Chapter 13 is a reorganization, not liquidation.
“Alimony, child support and taxes are not discharged under any bankruptcy filing, and student loans are seldom discharged”. So, it’s possible to keep a house, but the taxes due are still due. The article is simplistic, but it does explain things.

I don’t think this request for protective order changes anything. For the record, I am not a “living in a cabin in the woods government conspiracy crazy”. Mr. Bodeker should definitely not have left the silver & gold off his asset list. However, he should have had his continuance while hospitalized, and he should not be losing his home over this. There were other options that would have treated the creditors as fairly as they would have been had he declared the assets; the trustee got power hungry and went too far. It is unfortunate that conspiracy theorists have glommed on to this story and turned the bankruptcy court’s extreme punishment of Mr. Bodeker into some weird commentary about the government being out to get our gold and silver. I appreciated you posting this document, because it let me see her side of the story and also showed me some more of her personality…which is apparently not a very good one!
