Iowa’s Stolen Valor Act filed

| August 28, 2010

Two Iowa legislators filed their own Stolen Valor Act when the 9th Circuit appeals court struck down the federal law earlier this month;

“It’s ridiculous to believe that lying for personal gain is protected by the Constitution. It’s fraud, and fraud is illegal,” said Schultz. “This ruling is an insult to the service and honor of our soldiers.”

Schultz filed a bill in the House, and Hamerlinck in the Senate, that would restore those protections and make it a crime in Iowa to falsely claim military honors.

“Iowans know it’s right to stand up for our soldiers who bravely serve our country, no matter the opposition. We will not allow their service to be trivialized,” said Schultz.

The 9th Circuit Court of Appeals is the most reversed court in the country. The ruling makes no sense from a legal stand point and I expect it to be overturned. The idea that lying could be protected speech is absurd on its face.

How does the 9th circuit reconcile this with laws against impersonating a police officer?

2549,
because PO’s can arrest you and medal recipients cannot. if we are going to request the govt punish fakers we at least have to make analogies analogous.

kickstart

What is the difference with one saying they earned a medal or wearing the medal when didn’t do either or saying your a combat veteran when you were a support troop ? I see this theft of valor on the genuine combat veterans a real big problem today.
