President Trump’s financial penalty, from Letitia James civil case, thrown out by NY appeals court
As you guys remembered, Letitia James brought up a civil case against Donald Trump. After getting a conviction in the hands of Arthur Engoron, Trump was fined $364 million. This number rose to $500 million due to interests. The New York Appellate Division upheld the findings by the lower court but disagreed with the penalty amount that Trump had to pay. They deemed the amount of the fine in violation of the Eighth Amendment. Letitia James plans to appeal this latest ruling.

The ruling leaves liability intact but eliminates the massive financial penalty of $364 million plus interest, which rises to around $500 million.
Trump took to Truth Social to declare a “total victory” and rail against James and the original trial judge, Arthur Engoron. James claimed a win too, noting the appeals court upheld the findings of fraud and restrictions on Trump’s business and she pledged to appeal the penalty decision.
“TOTAL VICTORY in the FAKE New York State Attorney General Letitia James Case!” Trump wrote.
“I greatly respect the fact that the Court had the Courage to throw out this unlawful and disgraceful Decision that was hurting Business all throughout New York State. Others were afraid to do business there. The amount, including Interest and Penalties, was over $550 Million Dollars. It was a Political Witch Hunt, in a business sense, the likes of which no one has ever seen before.”
He also blasted the case as election interference, saying it was tried during his 2024 presidential campaign, while praising Justice David Friedman, who issued a partial dissent.
Friedman wrote that James’ true aim was political and argued the entire case should be dismissed. He said her “ultimate goal was not market hygiene … but political hygiene, ending with the derailment of President Trump’s political career and the destruction of his real estate business.”

I would say Trump’s biggest crime is never paying a dime in rent to you since he has lived in your head rent free for the last eight years. Since there is so much empty space there that wouldn’t otherwise be occupied the fine is probably up to almost four dollars by now.

The Left knew all these Lawfare Cases would never hold up. Hell, they invented the charges or re-wrote the law to charge Trump to keep him out of the election or scare off voters. It had the opposite effect. No other New Yorker has been charged tells all you needed to know. Trump continues to win, and there be more victories to come.
Even the banks and lending institutions that were supposedly defrauded said “what fraud?”
The Trump Organization gave the banks UNAUDITED financials because its a privately owned business. The banks do their own due diligence and assess the risk to approve/not approve the loans. They approved the loans and were paid back in full, but a crooked AG with her own skeletons of mortgage fraud leads the prosecution is some real irony. Claiming residence here but living there. I’m glad she’s familiar with “No one is above the law”, so when it comes to her she won’t be shocked.
It’s called “negotiation”. I say my property is worth X, the lending institution says it’s worth Y, we agree on a figure somewhere around X+Y/2, and the deal is done. No fraud. Just business.

This is pretty typical for fines against corporations and the wealthy.
Lower courts give them stiff fines.
They appeal.
Their fraud or malfeasance is upheld by the upper courts but the fine is thrown out or lowered substantially.
Making fines for fraud a cost of doing fraudulent business activities and not actual deterrents.
It should be jail time for executives involved in corporate fraud instead of fines and civil judgments.

Actually, the lending institutions did their own due diligence and property appraisals just as the Trump docs advised them to do. And the primary lender had officials testify it was very satisfied with each well performing loan. But Engeron ignored that irrefutable evidence because he is a lefty loon. In 36 years of lawyering and regular court appearances, I never saw a court clerk sitting on the bench next to the judge, until I watched that fruitcake in session at Trump’s kangaroo “trial.”
