Judge rejects 2nd Amendment argument from illegal immigrant living in Ohio charged over possession of 170 guns

A federal judge denied a request to dismiss a gun charge against an illegal immigrant in Ohio who had been in the US for more than 15 years, rejecting the man’s argument that he has a right to bear arms.

Carlos Serrano-Restrepo was charged earlier this year and was subsequently indicted for possession of a firearm by an alien unlawfully in the US, according to WSYX.

The Bureau of Alcohol, Tobacco, Firearms and Explosives began investigating and watching Serrano-Restrepo after he purchased at least 22 firearms, and claimed to be a US citizen on the firearms forms.

Agents conducted a search of his home and seized roughly 170 firearms, tens of thousands of rounds of ammunition and smoke/marine markers.

Serrano-Restrepo said some of the guns were purchased for self-defense.

Photos that agents took at his home revealed he kept firearms in gun safes.

Some handguns were also mounted in holsters on the wall of a closet.

The suspect’s lawyer submitted a motion to dismiss the charge on the argument that he has the right to bear arms under the Second Amendment.

The judge denied his motion to dismiss the charge on Thursday, writing in his opinion that “disarming unlawful immigrants like Mr. Serrano-Restrepo who have not sworn allegiance to the United States comports with the Nation’s history and tradition of firearm regulations.”

Mr. Serrano-Restrepo’s as-applied challenge lacks merit,” the judge continued.

“The swearing of an oath of allegiance occurs through the naturalization process, not through his asylum application or his years of living in the United States.”

His trial is scheduled for Jan. 21, 2025.

Serrano-Restrepo moved from Arizona to Orient, Ohio, in 2022.

He told the court he last unlawfully entered the US in 2008.

He also owns a business that remediates fire and flooding damage.

Glamorous female cop’s outrageous gala antics get her suspended from work

A glamorous Texas cop has been suspended after she was accused of a drunken disturbance at a gala.

Officer Kristie Bush has been taken off duty for 30 days following the incident at a real estate awards party in San Antonio, where she had been moonlighting as a DJ.

Officers were called to the University of the Incarnate Word’s Rosenberg Sky Room on March 16.

Body worn camera footage obtained by KSAT shows the police talking to Bush during the event, one cop describes how she said: ”Let’s f***ing party!’

Another woman accuses the cop, who wore a revealing dark dress, of being sat next to her son and being ‘super drunk and loud’.

Bush can be seen explaining to the officer that she was contracted to play between 10-12pm and describes the situation as ‘f**king annoying’.

She insists she has done nothing wrong and starts pleading with the officers to allow her to go and use her vape.

‘This is not worth my career,’ Bush says. A’ll I want to do is go hit my vape. It’s not worth anything. I just want to go downstairs, go to my truck, hit my vape. Can I please go hit my vape?’ asked Bush.

She is told she cannot leave to vape, Bush replies, ‘Why? I didn’t cause a disturbance. It’s not a felony.’

She then becomes exasperated after officers explain they have been called to reports of a disturbance.

An officer asks if she was ‘on the street’ whether she would allow someone in her situation to go off and vape.

Bush says she would and asserts: ‘I didn’t do anything wrong. I literally did nothing wrong.’

But the host of the event told KSAT that Bush had become intoxicated while performing to the 350 guests.

The outlet reported that multiple UIW officers noted that Bush was slurring her speech and had bloodshot eyes.

She reportedly told responding officers that she had two drinks, before saying it was ‘one wine’ which she did not finish.

After being removed from the premises, Bush asked a San Antonio Police Department cadet, ‘What the f**k are you looking at?’, according to records.

A separate camera angle also shows event staff arguing with another off-duty cop, officer Jonathan Kavanagh, who says he was just trying to explain what happened.

He was escorted out of the building following a confrontation with the host which saw him ordering Kavanagh to take his hand out of his face.

Kavanagh was not disciplined and was later allowed back into the venue under a police escort to break down Bush’s equipment.

Bush, who performs as DJ Kristie Rose, was initially given a 45 day suspension however this was reduced after she met with San Antonio Police Department Chief William McManus.

She was not hit with any criminal charges, but was suspended for violating rules on use of intoxicants, being discourteous to the public/fellow employee, conduct prejudicial to good order and being unfit to report for duty, records show.

Jeremy Dewitte Sentenced to Nearly Seven Years for Sex Offender Violation

An Osceola County jury found Jeremy Dewitte, 44, guilty of Sex Offender Failure to Register (Motor Vehicle Information), which is a sexual offender violation after he neglected to register a vehicle with law enforcement.

Dewitte has been convicted of 12 crimes of dishonesty including multiple convictions of impersonating a police officer. He is also a convicted sexual offender and is required by law to register any new vehicle he acquires or any changes in vehicles he owns or has access to the Florida Department of Law Enforcement (FDLE) by reporting in-person to the local sheriff’s office within 48 hours of the change in vehicle.

On Nov. 29, 2022, Osceola County Sheriff’s Office deputies arrived at Dewitte’s residence in the 2400 block of Accord Terrace in Kissimmee to serve an arrest warrant for a probation violation and take him into custody. They observed a black Dodge Charger in his driveway, which his probation officer confirmed was Dewitte’s vehicle. Upon investigation, deputies discovered Dewitte had purchased the vehicle on Oct. 10, 2022, but had not registered it with law enforcement as required. Deputies took Dewitte into custody for the original violation and initiated an investigation into his failure to register the vehicle.

During his trial, Dewitte’s defense team argued he did not know about the requirement to register the vehicle with FDLE but then noted the defendant initially registered the vehicle as a multi-colored car.

However, the law mandates that convicted sex offenders must register any vehicle modification, including color changes, with FDLE within 48 hours of the change. Dewitte failed to meet this requirement.

After a two-day trial, Jeremy Dewitte was found guilty of Sex Offender Failure to Register (Motor Vehicle Information). The statutory maximum penalty for this conviction is five years in prison. However, the judge sentenced Dewitte to nearly seven years in prison because of his previous convictions.

I, for one, will miss his antics for these seven years.

Ontario Town Without a Flagpole Fined for Not Flying Pride Flag, Officials Sentenced to Reeducation Course

The small rural Canadian township of Emo (population 1,333) is being ordered by the Ontario Human Rights Tribunal to pay damages after failing to proclaim Pride Month as instructed back in 2020.

CBC News reports Borderland Pride tasked Emo with the job of declaring June as Pride Month and ordered municipal authorities to fly an “LGBTQ2 rainbow flag for a week of your choosing” despite the fact they lack an official flagpole.

Borderland Pride also asked Emo to “email us a copy of your proclamation or resolution once adopted and signed.”

The Emo township refused. That rejection sparked a years-long arbitration process in which the tribunal ruled against the township, the National Post reports.

The tribunal ruled Borderland Pride will be awarded $15,000, with $10,000 coming from the township itself and the other $5,000 coming from Emo mayor Harold McQuaker.

McQuaker and Emo’s chief administrative officer were also ordered to complete an online course known as “Human Rights 101” and “provide proof of completion … to Borderland Pride within 30 days” as recompense for their disobedience.

The Post report notes the course being undertaken as punishment is offered by the Ontario Human Rights Commission.

Their latest educational edition opens with an animated video telling participants the Human Rights Code “is not meant to punish.”

Students on the reeducation course are also sternly told “it doesn’t matter if you didn’t intend or mean to discriminate … it’s the impact on the person that matters” because support for “2SLGBTQA plus people” is part of the services required of local government.

Ohio Politician Proposes Law Making it Illegal to Plant a Flag at Midfield at Ohio State

Ohio State really hates losing.

An Ohio republican wants to make it a felony to plant a flag on the Ohio State logo at midfield in Ohio Stadium.

Ohio State Rep. Josh Williams introduced the “O.H.I.O. Sportsmanship Act” on Tuesday according to the Port Clinton News Herald. The law is being proposed in the wake of a number of flag-planting incidents around the country following college football games.

The new law would make it a felony to plant a flag at midfield at Ohio Stadium, which is exactly what set off a brawl between Michigan and Ohio State players. House Bill 700 reads as follows:

“No person shall plant a flagpole with a flag attached to it in the center of the football field at Ohio State Stadium of the Ohio State University on the day of a college football competition, whether before, during, or after the competition.

Whoever violates this sections is guilty of a felony of the fifth degree.”

According to Ohio.gov a fifth degree felony comes with a prison sentence of six to 12 months. And according to this Ohio-based law firm’s website there could also be a fine of up to $2,500.

The Ohio House speaker told the Port Clinton News Herald that there is probably not enough time to pass the bill during the current session so it will have to be reintroduced next year. Stay tuned.

We already have a pride flag. It’s the flag of the United States of America. Below that on my personal flagpole I fly my Marine Corps flag. If someone wants to fly a gay pride flag at your own home, have at it, but there is no way in bloody hell a GP flag should EVER be hung on a government flagpole. Its Canada I know, but I just hope that shit doesn’t start here.

I had a ’68 Olds in that shade of blue but it was a convertible and had white bucket seats. The 350 V8 was nothing special and being a convertible made the car heavier.

Great times in spring and fall. Used to buy a case of Bud $2.75 or Colt 45 $3.25, ice them down in a bucket and sell them for $1 per can in the parking lot of Burger King.

Kept me in gas money, spending money and free beer, at least when the weather was good.

Also had ’64 version.

Had a ’70 Supreme convertible, dark metallic blue with white interior. Rode like a dream but yeah, not terribly fast. Takes a lot of horsepower to move that much metal in a hurry. Close to 4000 pounds, 250hp – my Kia Forte could probably beat it.

One of the teachers bought a brand new 1970 442, hardtop. It was “the stuff”. He would do burnouts to entertain our foolish young minds. He was only about five years older than us but had taken one of those deals to teach in NYC for a specified period and your college tuition was paid for. He only ate in the school cafeteria and lived in a flop house with four other guys sharing the rent and banked most of his pay.

That car was his getting-out present to himself, he paid cash for it.

If I had it, I would try and look to see the the family crest that is on the Rohbaugh’s handle. LEO gets ossified at party!!! My former retired NYPD Brink’s co-worker who retired as soon as the NYC Knapp Commision went into investigating NYPD corruption which came right after the NYPD LEO Frank Serpico was was set up at a drug raid and was shot. So Eddie My co-worker tells me that the downfall for NYPD cops are the 3 Bees which are booze betting and broads.

I just returned from driving through the great(er) Southern states that turned out Red last month: LA, MS, AL, GA, SC, and NC. Spent a few days in now-Blue VA for my son’s wedding, and for once I didn’t bring the customary Winchester 1200 Riot. Little ol’ me found the car gun (S&W Shield EZ in .30 Super Carry), Beretta 80X Cheetah, and the Glock 17 that’s now my duty gun sufficient enough for the 200+ mile round trip. Hell, I’ve been impulse buying since 1996 or so, and I’m maybe at the 100-gun mark. Sixteen years in-country (illegally to boot) and 170 guns means he either made a hell of a profit remediating fire and flood damage, or he was involved in some shady stuff. It is funny how much cash some immigrants seem to have. A property deal fell through for my wife while we were in VA, so she helped the seller (a lifelong friend’s mother) sell it for $4k more than we would have paid. The buyer was an immigrant (I’ll assume here legally), and his wife walked out with perfectly rolled stacks of hundreds to count out $9k.

2A rights for illegals, though? That’s a stretch… We, the People include naturally born citizens and naturalized citizens who owe allegiance to our country through either birthright or an oath. Our gun laws are somewhat forgiving in that non-citizens can purchase guns so long as they have the proper documentation, but that’s more of a privilege than a constitutional right in their case.

All I have are around 10 handguns vacumed packed in a small safe and 2 .22 breakaway gallery guns in 1 case. I wonder how they are doing since I moved to Florida in Dec. of 2007. Was going to go for a curio & relic permit but I have no room for another safe here. I was never a Glock fan and how I remember the big ado over them when they hit the States. I never cared for Glocks either but finally caved in and bought my 17 Gen5 just before retiring, when I was still considering law enforcement. I’d venture to guess that Glock has a majority of LE agency contracts, followed by SIG and S&W and to a much lesser extent by HK and other companies. The Glock has grown on me: I shoot them rather well and they are basically the AR15 of the handgun world, supplanting the M1911 in terms of aftermarket accessories and “upgrades”.

I shoot my Beretta 92F extremely well and will probably buy a new 92 or M9 series pistol eventually. But the Glock costs less and I’m not as worried about beating a plastic pistol all to hell getting in and out of the truck. Fortunately, it seems we only have to qualify with the caliber (9mm, .40 S&W, .45 ACP, or .38 SPL), so I have options if I want to carry something different. If I can get another original S&W Model 19, I may qualify for both 9mm and .38 next year so I can carry that on occasion.

Outdoors I use kenai chest holster to fish/walk in the back country. White box 240gr., S&W 629 SS 4”. Considering all the different hunting , shooting and carrying situations I think a guy needs about 25 different hand guns and long guns. But a 170 guns says you’re dealing weapons for a cartel, especially an illegal immigrant.

So it appears Canada has turned communist.
