Liberty U IT department getting sued
Sometimes you just gotta think “there’s something in that person’s head that just ain’t right.” Today we look at one such.
Normal folk do stupid stuff. Not by choice – usually normal folks get out of bed in the morning, try to make it through the day without stepping on essential anatomy bits, and go to bed satisfied that while maybe it wasn’t a stellar day, it wasn’t unbearably bad. How do they do that? In the famous word, they “don’t tug on Superman’s cape, they don’t spit into the wind. They don’t pull the mask off the old Lone Ranger” – you get the point. But they try not to be intentionally a dumb-ass.
Now we have this young information technology type… Ellenor Zinski. She applied for a job at Liberty University, one of the most conservative universities around. Founded by Jerry Falwell, Sr. who was succeeded by his son Jerry Falwell, Jr. (both of whom got caught dipping their pens in the wrong inkwells ifyaknowhatImean) – the school is nothing else if not 1) Conservative 2) Unforgiving of those who don’t uphold their standards (nominally Christian.) Even the FOUNDER had to go when he got caught, right?
The lawsuit on behalf of Ellenor Zinski was filed in July by the American Civil Liberties Union of Virginia and the Richmond law firm of Butler Curwood. It alleges that she was fired last year from her job on Liberty’s Information Technology help desk solely because of her gender identity, in violation of the U.S. Civil Rights Act of 1964.
Now, normally this case would be a slam dunk in the modern Woke world, whether you agree with interpreting the ’64 Act like that. But…
Earlier this month, the conservative legal organization Liberty Counsel filed a brief on behalf of the university asking the federal district court to dismiss the lawsuit. The brief contends that the Civil Rights Act explicitly permits religious educational institutions to make employment decisions consistent with their religious doctrine — in this case a doctrinal statement asserting that “denial of birth sex by self-identification with a different gender” is sinful.
The brief filed by Liberty Counsel alleges that Zinski attempted to “set up” the university, applying for the IT job four months after beginning to take female hormones yet agreeing — when offered the job in February 2023 — to adhere to the school’s statement rejecting transgender transition.
Only after a 90-day probation ended did Zinski notify the university of the gender transition process and then request that the school “depart from its doctrine and mission,” Liberty Counsel said in an effort to get the lawsuit dismissed.
But she is still a staunch Christian, he/she says. A biological guy, right? Applied as a woman, agreed to adhere to their policies, and concealed his/her ‘status’ only until AFTER the new-employee probationary period (during which, no doubt, he/she would have been immediately terminated) ended. Yeah, no deceptive intent HERE, right?
Wyatt Rolla, the ACLU of Virginia’s senior transgender rights attorney, rejected the claim of a set-up.
“It’s strange to disparage Ellenor over what turned out to be real concern with employment discrimination,” they said. “Her intention was to be a highly successful employee for Liberty who continued to meet all of her obligations.”
Zinski, 30, says she was raised as a conservative Christian, attended a Christian high school, and took the job at Liberty hoping the university — which she had admired — would accept her even after learning of her transition. NBC News
“Who continued to meet all her obligations” – like the schools public rejection of transgender transition? You start as a guy, they say you need to stay a guy. He/she agreed to it. That doesn’t sound like meeting their obligations.
Oh, and Zinski wants $300,000 and says he/she is distressed that people don’t want her at the school. Bet you could have guessed that money is involved, huh?

I don’t think he was forced. I seem to recall the courts sided with the baker, but they extracted a boat load of money in legal fees I’m sure he didn’t have. Not sure if the gay “couple” were made to repay his legal fees.

I should’ve said “attempted to force” the baker. He’s won several times but they keep trying. Court says he cannot be compelled to make a custom order, he has the right to turn down the work. As it should be. Yet, they persist.
When they won’t take no for an answer. Hell, the word is right there in the middle of the alphabet.

Sounds like a story a guy in Combat Camera told me back when “Don’t ask, don’t tell” was the law of the land. Remember that? Give them an inch and all that?
This Combat Camera guy told me while he was in AIT, there was a clearly bull dyke lesbian in his class. Nobody said anything. When she finished AIT and got to her first unit, she promptly informed the chain of command of her homosexuality, and was discharged for violating DADT. Then immediately walked into a high paying job with her MOS training. I’m sure that was never her plan at all.

Very simply, “she,” he, it perpetrated a fraud on her employer when she accepted the job. She represented that it would abide by and support the school’s opposition to transgederism, yet she planned to disclose her transition after her period of probation expired. Her conduct meets all the elements of fraud. The school should counter sue for rescission of her/its employment contract. The fraud obviates the employer’s agreement to employ her.
In a rational and sane court, this will be dismissed with prejudice. It will be interesting to see which court this lands in.
