Caron Nazario, Soldier featured in a traffic stop video, takes officers to court

Regular Valor Guardians readers are familiar with the police traffic stop involving Army Second Lieutenant Caron Nazario, who was pulled over in an event recorded three ways. Body camera footage from the officers, as well as recordings from Caron Nazario, show an intense scene involving a verbal interaction between Nazario and the cops that wanted him to depart his vehicle. Videos of the incident drew national attention, and received mention on this site here, here, and here.

According to the linked ABC News article posted January 8, 2023, Caron Nazario initiated a federal lawsuit which begins today at Richmond, Virginia. He is suing the officers in federal court for a total of $1 million. His lawsuit argues that the police officers assaulted him, falsely imprisoned him, and searched his car illegally. The officers are denying the lawsuit’s allegations and their defense team argues that the officers were within justifiable bounds.

“Can you please relax?” Nazario said to the officers while sitting in his car, bodycam footage showed. “Get out of the car now!” Gutierrez said and proceeded to pepper spray Nazario in the face just after the lieutenant explained that he was actively serving in the U.S. armed forces.

Nazario is suing both officers in federal court for a total of $1 million, claiming they violated his constitutional rights, assaulted him, falsely imprisoned him and had his car illegally searched. The trial will begin on Monday in Richmond, Virginia.

In response to the federal lawsuit, the police officers deny the allegations against them in a court filing.

In the police report, one of the officers wrote that Nazario eluded police because he didn’t stop right away. Nazario stated that he wanted to pull over in a well-lit area.

“I’m honestly afraid to get out,” Nazario said during the traffic stop. “Yeah, you should be,” Gutierrez replied.

Police said they pulled him over for not having a visible rear license plate, but in the footage, a temporary license plate can be seen in the rear window of Nazario’s then-new SUV. Nazario was not charged in the incident.

The Windsor Police Department announced in 2021 that they fired Gutierrez, who pepper sprayed Nazario, for not following department policy during the incident. Some are calling it an example of excessive use of force by the police toward people of color.

“It is my estimation that the force that the police officer used against Mr. Nazario was excessive,” Marquez Claxton, director of public relations and political affairs of the Black Law Enforcement Alliance, said. “And it was not commensurate with the level of what, even if he perceived it to be, some sort of resistance or defiance. His level of force did not match that.”

In addition to Nazario’s federal lawsuit, the state attorney general filed a lawsuit against the town of Windsor, alleging in part, that its police department’s operations led to discrimination against African Americans.

An attorney for the town tried to get the lawsuit dismissed. According to the police chief, the department practices non-discriminatory policing.

The judge’s ruling stated that Nazario’s federal lawsuit would move forward.

“What we’re going to see at trial is the defense is going to put forth the training, the fact that he did not exit the vehicle,” Channa Lloyd, criminal attorney and managing partner of the Cochran Firm, said of Nazario’s lawsuit. “They’re going to be looking to reinforce this idea that these officers were simply following their department’s procedures and policies.

Welp, I called it. Nice payoff from the taxpayer for this career dumbass. I foresee a bright future for this denizen of Heroness. Think there’s an opening for a GO out in Commiefornia. With his history of leadfootness he’ll get to work on time so there is that.

I won’t try to Monday Morning Quarterback a coupla LEOs that pulled somebody over at 0darkthirty. I wasn’t there. Now, does the video show they coulda handled it differently? Maybe so. Traffic stops can be the 2nd most dangerous things an LEO has to to. The FIRST (ht2 Chip) would be a domestic call.

A few things stick out though:

  • There was no reason for a “felony traffic stop”
  • That ain’t how it is done anyway
  • I counted eight safety violations by the men in blue
  • Gutierrez is clearly not a patient people person
  • If LT Dumbass had simply done what he was told or at least not tried to prevent them from removing him from the vehicle by holding the door shut with his arm the rest likely wouldn’t have followed. By law the police were in the right to order him out and then pull him out of the vehicle.

Granted, VA can get pretty picky with traffic violations, but shit like this would have us enlisted pukes chatting with the CoC explaining why we should be allowed to keep security clearance, stay in sensitive positions, etc.

Unless things have changed a lot since I was an S2, simple traffic violations don’t get filed with derogatory information for a clearance. DUI, Leaving the Scene of an Accident, FTA for court, anything above a violation or that the subject was arrested for go in, but the rest not so much. Leadership might hassle you if you get them on post because they look bad and make you appear to be less safe, but I’ve never seen anyone get punished for speeding tickets gotten off post.

We suspect the parents/parent used a smartphone or IPad or PC or Video Games as a means of “babysitting” the 6 year old while the 6 year old was home…and the 6 year old “learned” about how “cool” it is to shoot others…

Read elsewhere (NYPost?) kids dad was in jail so he was staying with uncle who had gun in shoebox under bed. Teacher saw gun in his hands and was taking it away when kid pulled trigger.
