Claremore officers kill man brandishing nail gun

The Oklahoma State Bureau of Investigation is investigating an officer-involved shooting in Claremore.According to the OSBI, deputies with the Rogers County Sheriff’s Office were dispatched to reports of a disturbance at a local business on Wednesday. Deputies were advised that a man had been causing the disturbance with a nail gun.
William Fairweather, 39, locked himself in the office of the business and refused to leave. Deputies and a marshal with the Cherokee Nation Marshal Service tried speaking with the man, but he was uncooperative.
Fairweather reportedly threatened law enforcement with the nail gun when he was shot and killed. The body was taken to the Medical Examiner’s Office to determine the manner of death.

The “shot and killed” part may provide valuable clues to the ME. While “gun” is indeed in the name, a nail gun is a carpentry tool and not what one should bring to an actual gun fight. Right, Mr. Fairweather?
Police shoot and kill man in Kansas City, Kansas
A man is dead after an encounter with Kansas City, KS police.
Officers say they were in the area of Wood Ave. and N. 27th St. at around midnight Wednesday morning to investigate a stolen car. While there, they noticed what they say was a “suspicious” car parked nearby.The officers discovered an armed man inside who had drug paraphernalia with him. Police say they approached the man to speak with him and he started shooting at them. Officers say they fired back.

Don’t scoff at a nail gun. It shoots a nail with a fair amount of force.
If it hasn’t been done already, it would be interesting to do an experiment with a nail gun vs ballistic gelatin (covered with denim) at various distances for penetration depths.
That said, add a nail gun to that ever growing encyclopedia of things you don’t bring to a gun fight.

A long time ago when my beard was not gray, I did a stint as a carpenter’s helper.
I got myself through a couple of boards one time (while standing on the joists – and didn’t fall!). Hit a metacarpal bone but no serious injury.
Another one of the helpers had nailed his femur to his tibia behind his kneecap, just trying to disconnect the air hose.
Aim one of those things at me, and I will return fire most rickki-tik!

You nailed it Tox. Years ago. a contractor used a nail gun which went through the wall and hit a person in the head on the other side. When I was on Ladder 2. we had a guy on a garage roof using a nail gun and nailed his hand to the roof, Paremedic got his hand freed and we used a stokes basket and ground ladder to lower him horizontaly to the ground.
I wonder if you could launch a soda can through an M79 tube……..maybe one of the newer mini soda cans?
Probably not but you can launch a used CO2 cardtridge with a
3/4 inch steel pipe and threaded end cap.
Fill the used cartridge with powder and insert a legnth of fuse.
Cut a slot in the threaded end of the pipe for the fuse and insert
the cartridge then screw on the the end cap.
Fashion a stock.

When I was in the ARNG, we used to go down to Fort Dix on weekends for quals and I used the M-79 and the combo 40MM/AR rifle. I forgot the name of what it was called and was attached to the AR and used 2 types of sights for different ranges.

The rifle was the M203. When we received them in the Viet of the Nam, they were designated XM203.

When using deadly force in self defense, you are trying to determine not whether the person has a weapon or not, or if they have a LETHAL weapon or not.
The question is; does the person possess the ability to inflict grave bodily injury or death?
“Grave Bodily Injury” in legal parlance is easiest described as “any crippling injury”. This would include shooting your eye out with a nail gun.
Is it possible for a nail gun to produce a lethal wound? Yes, it is. If fired into the proper, soft tissue area, it can penetrate and kill. Or, it may produce infection that can prove to be lethal. In any case, a nail gun is not something to be laughed at, or treated lightly when it comes to weapons.
