Obama frees convicted drug trafficker, he went back to trafficking drugs

Another of those “non-violent, first time offenders” I’m sure.

A Texas man released from prison after his sentence was commuted by former President Barack Obama has again been indicted on federal drug trafficking charges, according to Department of Justice officials.

Hilario Nieto, 41, of San Antonio, is among eight people indicted on charges of conspiracy to possess and distribute methamphetamine and heroin in the San Antonio area, federal officials announced Thursday.

John Convery, who is representing Nieto, said it is early in the case and there is no additional information he can provide but presumes his client innocent.

Nieto was sentenced in 2004 to more than 20 years in federal prison on drug charges, according to the federal officials. He was scheduled for release in 2021.

Obama commuted Nieto’s sentence in 2016, the Justice Department said, and he was released in 2018.

“It is truly appalling that a man whose sentence the President previously commuted chose to flout that generous gift after being released from federal prison by resuming gang-related drug dealing in the San Antonio community,” U.S. Attorney Gregg Sofer said in a statement.

All of the defendants are in federal custody. Those charged face 10 years to life in federal prison for the methamphetamine charges and up to 20 years in federal prison for the heroin-related charges.

Update on a past stupid criminal

I talked about this guy a while back. He’s now been sentenced.

A former Knox County Sheriff’s Office fleet manager who pleaded guilty to a felony charge of official misconduct in October will spent two years under unsupervised probation.

Ronnie Lee Kidd was previously sentenced to the probation for his part in a botched insurance fraud scheme involving a local inmate, a restaurant owner and an $80,000 Bentley Continental Convertible. His attorney had asked for Kidd to be placed in a rehabilitation program instead of the probation, but the attorney withdrew the petition on Friday.

Kidd had previously agreed to resign from the Knox County Sheriff’s Office.

“Operate within the bounds of the law, be a good citizen and this will be behind you in two years,” Knox County Criminal Court Judge Scott Green told Kidd on Friday.

According to Knox County prosecutors, Kidd asked Joshua Haynes, an inmate working under him at fleet services, to steal the Bentley from local restaurateur Christopher Captain’s driveway.

Captain, who owns Sam & Andy’s Deli, pleaded guilty to filing a false police report in October.

Haynes, a skilled mechanic in a fleet services work release program, was supposed to make the car disappear. Instead, he held onto it for a couple of weeks before driving it down Rutledge Pike, where he was arrested.

Haynes told authorities about the scheme, prompting the Tennessee Bureau of Investigation to take a closer look.

TBI said it was investigating “several” people tied to the Fleet Services unit in October. Knox County Sheriff Tom Spangler launched an internal investigation as well.

After Haynes told his story, other former inmates told Knox News they had worked on private property while on work release with the fleet services program.

On Tuesday, Spangler said the Tennessee Comptroller of the Treasury, which investigates financial crimes and waste in government agencies, is examining whether sheriff’s office employees used county dollars to make purchases for personal gain.

The sheriff’s office also is investigating whether inmates were used to work on private property in violation of state law.

Noise complaint leads to drug arrests and seizure of multiple guns

Savannah [Georgia] Police seized multiple guns and drugs from an apartment Monday after officers responded to a noise complaint.

Police say officers responded to an apartment complex on the 1400 block of Benton Boulevard Monday morning for a complaint of loud noise coming from a unit. After speaking to individuals inside the unit, officers observed narcotics inside the residence.

The investigation led to three arrests.

Carl Freeman, 24; Casey Browning, 21; and Wade Harvey, 22, face a charge of Conspiracy to commit Violation of the Georgia Controlled Substances Act.

Freeman and Browning also face other charges including multiple drug offenses.

Police seized the following from the unit:

• 521 Xanax pills
• 2252.8 grams of marijuana
• 163 grams of THC vials
• 16 pounds of THC edibles
• 29.5 LSD squares
• 111 steroid pills
• 2 containers of steroid liquid
• 6 guns, one stolen
• Cash

Armed man discharges gun while adjusting pants, Atlanta police investigate

Atlanta police are investigating after reports of gunfire inside Lenox Square mall Saturday.

Atlanta police officers were called to the mall located at 3393 Peachtree Road around 6 p.m. after someone reported hearing a gunshot, police confirmed.

Investigators learned the gunfire happened inside of the Neiman Marcus store.

Further into the investigation police learned a male was walking through the store and adjusting his pants when the gun inside of his waistband discharged.

Police do not believe anyone was struck by the gunshot.

The man left the store, police say.

No word on the man’s identity.

Rahim Sarifani owns Aura Perfume located outside of Neiman Marcus and captured video after the gunshot went off.

“They were scared. You never know where the gunshots are going so the best thing is to duck down and make sure you’re safe,” Sarifani said.

Incidents involving guns have been an ongoing issue at the mall recently.

City of Atlanta officials and business leaders announced plans to roll out enhanced security after the mall recently experienced its fourth shooting this year.

A man was sent to the hospital after being shot in the rear during a shooting inside of Lenox’s Apple store.

Earlier in October, three people were arrested after shots were fired inside Neiman Marcus.

In March, a person was killed during a shooting over a parking place. The previous month, a man was shot during what police called a botched drug deal in the parking lot outside Bloomingdales.

In January, a police officer was involved in a shooting during a robbery in progress in the parking lot. And in December of 2019, police said a Macy’s employee was robbed and shot in the Lenox Square parking garage.

In a statement Atlanta Police urged gun owners to be responsible and released this statement:

“We urge gun owners to be responsible and we would recommend they leave their firearms at home while they are out shopping in public areas. Instances like this are unacceptable and we expect more from those who choose to carry firearms. Gun ownership is a responsibility no one should take lightly.”

Jail For Man In Ass-ault Weapon Case

A Louisiana man who was found to have a loaded pistol in his buttocks during a jail strip search pleaded guilty today to weapons and contraband charges, court records show.

In a plea deal, Justin Savoie, 24, copped to a pair of felony counts and a misdemeanor charge in connection with his arrest late last year at a residence in Golden Meadow, a Bayou town 40 miles south of New Orleans.

Savoie received a five-year suspended prison sentence on the felony convictions during a District Court sentencing. He was also placed on three years probation and ordered to serve 90 days in the Lafourche Parish jail.

Seen at right, Lavoie was taken into custody following his sentencing. If he violates terms of his probation, he risks having to serve all or part of five years in state prison.

Police confronted Savoie and a female acquaintance after spotting suspicious activity at the woman’s residence. During a pat down of Savoie, cops recovered a concealed handgun, marijuana, and drug paraphernalia. They also subsequently seized several other guns from Savoie’s truck, as well as homemade silencers.

Savoie was arrested and brought to a Lafourche Parish Sheriff’s Office sub-station to be processed on a variety of criminal counts. It was during the intake process that Savoie was subjected to a strip search that revealed he was in possession of another firearm.

According to a Golden Meadow Police Department report, a corrections deputy “recovered” a .25 caliber Titan pistol “from Mr. Savoie which he had it hidden in his rectum and was refusing to unclench his buttocks and spread his legs.” Aided by a second law enforcement officer, the jailer succeeded in securing “the introduced weapon which was loaded.”

The seized handgun has a 2.5-inch barrel and measures 4.375 inches long. After Savoie’s collar, the Golden Meadow police chief told TSG, “Whoever thought a .25 caliber pistol could be an ass-ault weapon?”

As part of his probation, Savoie, who was free on $10,600 bond in advance of today’s sentencing, is barred from owning or possessing firearms and has been ordered to refrain from “frequenting bars and lounges” and “the excessive use of alcohol and the illegal use of drugs.
