SCOTUS on Thursday ruled that Manhattan’s chief prosecutor can obtain troves of President Trump’s business records and tax returns, which Dems are touting as a momentous defeat for the president in his efforts to shield his personal financial information from state investigators.

This is quite true. But…
While the court actually found yes, his tax records may indeed be subpoenaed by a prosecuting attorney like anyone else’s, they also declined to rule if Congress can access those records, and kicked that case back to the lower courts. Score 7-2 in both.

By: Tyler Olson, Ronn BlitzerThe Supreme Court on Thursday ruled that President Trump is not immune to a subpoena from Democratic Manhattan District Attorney Cyrus Vance Jr. over his financial and tax records and declined in a separate case to issue a definitive ruling on whether congressional committees can have access to Trump’s financial records, throwing both issues back to lower courts.

The rulings are on brand for the court under the leadership of Chief Justice John Roberts, avoiding a fraught political issue in the middle of an election year, and ruling narrowly on major disputes, especially those involving conflicts between the other branches.

Vance had subpoenaed Trump’s records as part of a criminal investigation into potential wrongdoing by the president and his organization. Multiple House committees had subpoenaed Trump’s records ostensibly as part of an effort at oversight and to inform potential legislation. Both rulings were 7-2.

“President is neither absolutely immune from state criminal subpoenas seeking his private papers nor entitled to a heightened standard of need,” Roberts wrote in the court’s majority opinion in the New York case. The court limited its ruling and the arguments before it to whether Trump has “absolute immunity” and state prosecutors are required to show a “heightened need” in order to obtain documents as part of investigations into a president.

The immunity issue likely won’t have much, if any, affect on the upcoming election, but my cause Trump ass-pain farther down the road. Denying Dems immediate access to those records has to burn now, though.

It’s very unlikely either Congress or the Manhattan DA will see them before the election. But it’s likely, though not certain, the DA will get them at some point in the future.

Well, maybe, maybe not. Once the lower court rules, it will end up at SCOTUS again. With different issues to be appealed by whichever side doesn’t like the lower court ruling.
So, this could be in the courts until the whole point is moot.

… You’re kidding, right? This is one of those jokes that’s hard to get over the internet? Because I’m pretty sure that a) they’re not ‘classified’, they’re merely private.. and b) so are the current President’s. Which makes that whole ‘ONLY’ thing seem rather silly.

Personally, while I do like recent tax records of candidates, I’m not too worried about college transcripts of people in their 60’s. I’m pretty sure that what someone did in school 40+ years ago isn’t terribly relevant.

Nope. It’s not a political thing to me, but maybe it’s personal. I’m a college dropout. My college records don’t speak to my current education and knowledge any more so than my failures at Tee-ball many decades ago speak to my physical fitness now.

If someone is a serial plagiarizer, surely they’re going to have done so more recently than half a century ago, too.

No one has a legal right to anyone’s transcripts, period. You can’t get mine, unless I ask the records office to send them to you, and you would have to have a damned good reason to demand them before I’d make that request.

The federal Family Educational Rights and Privacy Act prohibits educational institutions from disclosing education records without students’ consent.

Get over yourself, will you, Steve? You’re being ridiculous. If Obama sloughed his way through Harvard, who gives a crap? He passed the bar in Illinois, and it doesn’t matter what his test results were for that, either. All he had to do was pass the bar exam.

You’re just going to have to deal with that like a grown-up, Tootsie.

Furthermore, if you knew anything about law at all, anyone born to an American parent or parents is an American citizen no matter where s/he was born. That is a federal law, so deal with it, will you? For reference, search for Simas Kudirka. His mother was born in Brooklyn but migrated to Lithuania where he was born, and since SHE was an American citizen BY BIRTH, Kudirka was an American citizen, also.

Not entirely true, Ex. The details have changed many times, but the broad brush stokes remained: children born to US citizens abroad were always eligible automatically to be US citizens. (And sometimes also the country in which they were born. Lots of variations on that one depending upon when and where, but that is another issue.)

There have always been forms to file to actually be recognized as a citizen, It is much easier when both parents are US citizens. When one of the parents is not a US citizen there are additional forms which must be filed for US citizenship to be claimed for the child. Those are the forms which apparently were never submitted to the US government by the US citizen mother when her bouncing baby boy was born wherever he was born. Or whatever happened and led to the confusion.

The argument has never been if he was legitimately eligible to serve as prez wherever he was born. The question was if the mother submitted the proper paperwork.

Well, there’s also the fact that a birth certificate was made public (copy up above) that says he was born in Hawaii. So the real question is: where was he actually born?

With Kudirka, the fact that his mother was born in Brooklyn and later emigrated to Lithuania caused a real problem (see my 1PM post when it comes up) because of lack of paperwork in the US.

Didn’t look at this one, but did at the time it first came up years ago. Since I can’t remember all the specific details, it really wouldn’t do much good.

That copy of “his birth certificate” was an easily discernable alteration of his sister’s birth certificate. “Why?” became the question some of us were asking. The fact that his own was not presented proved nothing really beyond it confusing the issue further.

His original birth certificate may have been lost. It might not have been processed correctly. Who knows.
