Scotty sent this to us over the weekend and I was holding on to it for a drought, but our own Ex-PH2 was excited that Daniel A. Bernath was a PH2, too. Just by looking at the rank on his sleeve, you can tell he’s a phony since, instead of laying out the bucks for new rank, he had a stripe embroidered on the sleeve. He has service stripes for twenty years of service, but his FOIA tells a different story;
3 years and change in active service, and a couple of years in the Reserves. Now let’s do some math – you’ll need most of your fingers, he’s wearing seven awards in the picture and the FOIA says that he has five. Well, finally we got a Navy phony who is not a SEAL.

According to the “Anonymous Yelp Users Face Identity Disclosure” article attached to post #90, the people posting negative reviews of Hadeed’s business were not customers and were, therefore, making bonafide false statements. I wonder who has been making false statements in regard to Dan’s case/career? The article is non sequitur:
1. Negative comments re Hadeed were false
2. Hadeed’s business was hurt because of negative false comments
3. Therefore TAH negative comments about Dan are false
@TAH legal-eagle, question: when does discovery come into the legal process; id est: when does Dan have to prove his bona fides are, in fact, “bonafide?”

Bernath, I have stayed out of this cross fire until now but feel compelled to explain to you why your alleged attempt to use the Yelp case ruling to get IP addresses and names will fail. First, it is always a good idea to read the actual opinion in the case rather than relying and an aggregate news service (even one as good as Courthouse News.) If you had read the case, you would notice that the VIRGINIA Court of Appeals had jurisdiction over the case because the plaintiff’s business is in Virginia. The importance of the business will become even more evident in a moment. According to the contact page of this site, Jonn Lilyea has a postal address in WEST VIRGINIA. According to his site registration, the site is registered to an address in MARYLAND. You appear to be in the state of Oregon. The Commonwealth of Virginia does have an “unmasking statute” for defamatory speech on the internet. That point is noted in the Virginia Court of Appeals’ decision. (Code § 8.01-407.1) However, neither Maryland, Oregon, or West Virginia has any similar “unmasking statutes.” In fact, the State of Oregon specifically denies those seeking to unmask users on media sites protected by the First Amendment which this site is. (See Obsidian Finance Group v. Cox which is a 9th Circuit Federal decision, but one that relies heavily on the US Supreme Court Case of Citizens United v. FCC.) In other words, while you may may feel the Virginia case supports you (it doesn’t, but that is another issue,) there is no law that you can rely upon because you nor the site owner lives in Virginia. Secondly, even if you were to try and pierce the veil of anonymous speech, you would have to show a cause to do so as well as the exact speech that was wrong. Debunking false claims about anything doesn’t fall under the heading of libelslander. ‘Debunking’ is a means of exposing falsehoods to the light of day, as in debunking someone’s claim of being a SEAL when he wasn’t even in the service, or debunking someone’s false claim of receiving the title of Honorary CPO, when he didn’t.
There is no libel/slander involved there, any more than there is in telling the claimant directly, ‘you’re a f#@cking liar’. The appropriate response to someone who lies about himself like that is something like ‘liar, liar, pants on fire’. It’s especially appropriate when he has a self-confessed, documented (by him) history of being a compulsive liar. Bad actors like this tend to out themselves in more ways than one.
And the term ‘bad actors’ does not refer to a stage, screen or media career. It refers to someone who has a lifetime of being an inveterate asshole.
Oh, yeah — this combative approach by bernutsless will probably intensify into Friday, Feb. 21. While we, as a group, appreciate moderation and fair-minded discussions, he’s more likely to explode at us with increased impatience and combativeness, possibly even making threats.

I just noticed the “actor” claims. Have these been investigated somewhere and I just missed them? I looked on IMBD and didn’t find anything. I search Daniel Bernath and Daniel Abernath, which is stated as his “on air name”. With so many utter and outright lies on his page it’s hard to find or believe any truth.
