Investigation into Fatal Shooting at 10085 Westpark Drive

The fatal shooting of a robbery suspect at 10085 Westpark Drive about 6:45 a.m. on Thursday (October 10) will be referred to a Harris County grand jury.

The identity of the deceased male suspect is pending verification by the Harris County Institute of Forensic Sciences.

The male shooter, 58, was not injured.

HPD Homicide Division Sergeant C. Duncan and Detective V. Nguyen reported:

HPD patrol officers responded to a shooting call in a business parking lot at the above address and observed a male with at least one gunshot wound. Paramedics transported the male to an area hospital where he was pronounced deceased.

A preliminary investigation and witness statements determined the male robbed another male at gunpoint. During the robbery, gunfire was exchanged and the suspect was struck. The shooter, who remained at the scene, was not struck by the gunfire.

Altercation motivated by assault earlier in the night included a misidentified group of motorcyclists

It was likely all a misunderstanding Thursday night when two people died from gunshot wounds on West 41 Street in Sioux Falls, police officials reported Friday morning.

A 23-year-old male, identified in a written affidavit as Francisco Alvarez III, died on the scene at about 10 p.m. at a Kum & Go gas station off Sertoma Avenue. His 44-year-old father, identified in the documents as Francisco Alvarez Jr., was taken to the hospital and died shortly afterward.

What happened in the gas station parking lot?
Sioux Falls police spokesperson Sam Clemens said the victims and their accomplices “mistakenly” identified potential assailants after an assault that took place earlier that night involving Alvarez III, one of the gunshot victims.

But the misidentified assailants, a group of motorcyclists involved in the shooting, were proven to be nowhere near the assault that night, based on video footage near the intersection of East Sixth Street, Clemens said.

The written affidavit states it began when Alvarez III came home “limping” Thursday night and told his mother, identified as 42-year-old Darinda Martinez, that he had just been “jumped” near their home near the 600 block of North Daisy Avenue.

Alvarez III, his 44-year-old father and his 14-year-old brother, who will remain unnamed because he is a juvenile, then got in their SUV to hunt down the supposed assailant(s) after a neighbor said they heard motorcycles when the assault happened and the assailants might be at Kum & Go.

Martinez followed in her own car when she realized her younger son had gone with Alvarez Jr. and Alvarez III, the affidavit reports.

Clemens said when the passengers of the SUV drove into the Kum & Go parking lot, they got out the car with baseball bats in their hands and immediately “confronted a group of motorcyclists they thought were responsible for the assault,” he said.

Martinez arrived right behind the SUV and grabbed a gun she happened to have in her car, the affidavit states. She told her 14-year-old son to get back in the SUV, the affidavit states.

“There were different conversations taking place,” Clemens said, before Alvarez III first swung his bat at 26-year-old motorcyclist Tommy Fischer, who then allegedly drew a concealed handgun and shot Alvarez III in the chest, presumably as self-defense, according to the written affidavit.

“Everything happened quickly,” Martinez is quoted in the affidavit, which states that she then pointed her own handgun at Fischer, who then fired his gun again and shot Martinez in the arm.

Lastly, Alvarez Jr. swung his baseball bat toward Fischer’s head and Fischer fired his gun in response, shooting Alvarez Jr. multiple times in the back, the documents state.

Three charges thus far
Alvarez never fired her gun but has been arrested on three counts of aggravated assault, court documents state. She was apprehended Friday morning.

Clemens said no arrests have yet to be made against Fischer because “laws allow for self-defense.” The case is now in the hands of the state’s attorney’s office.

Fischer is stated as saying in the affidavit that after firing multiple shots, he set down his gun on the sidewalk north of the gas station and held his hands in the air as police officers arrived on the scene.

Suspected burglar shot in Harvey

HARVEY, N.D. (Valley News Live) – A suspected burglar was shot in Wells County, Friday morning.

Harvey Police say around 3:35 AM, law-enforcement was called to the scene of a burglary/shots fired call on Brewster Street E. They say the suspect, who was on probation with the North Dakota Department of Corrections, was shot by the homeowner during the break in.

Police say the law enforcement provided medical attention until an ambulance arrived.
